Firstly, by Instituting the case alone and the manner he has surreptitiously taken this case has made Godwin Emefiele lose every credibility, that is if he had any.

Section 84(12) & its wahala. Every person in the Federal Executive arm is a political appointee excepting the President & his Vice.

In Oni v Fayemi, the Appeal Court ruled that while the Ministers are Public Officers, they are not employed in the Public Service of the Federation. The determination of Emefiele or any other public Officer will rest on the nature of their appointment.

3 types of employment are recognised in Nigeria;
A. Employment at will or servant holding an office at pleasure of employer, i.e. Master and servant relationship.

B. Employment by written contract of employment;

C. Employment which is governed by statute;

Ministers fall under Section A. (Their position isn't tenured and they can be fired at any time by the President without recourse to anything or anybody).

The CBN been a legislation of the National Assembly falls under C.
This is an employment with statutory flavour. The employment or termination is protected by statute or laid down regulations and it is usually tenured. However, the SC has said many times that employment with a Statutory body is not automatically clothed with statutory flavour but will be determined by the contractual terms between employer & employee in the letter of employment.

To have a statutory flavour, the appointment and removal of the employee must be defined in the enabling statute so that a valid determination of such employment is predicated upon the satisfaction of the statutory provisions. What it means literally is that: If the Senate does not support the President according to the CBN Act, the Governor will be reinstated if the President touches him.

I believe it is clear from the Act on screenshot below that Emefiele is employed in the Service of The Federation and should leave there 30 days before the date of election.

The question: Should The date of the election be 30 days to the Primary election or 30 days to the general election. A question for another day.

. It is a dead on arrival case. The party decides its primary procedure with reourse to constitution and the party's act.

Supreme Court Judgements have distinguished these facts. When a President dies, his Deputy takes over without that term counted for him..pre-2018.

. Before 2018 GJ could contest against especially with with SC ruling that he could contest again because he finished Yaradua tenure in his first term of office but as from 2018 I don't believe he is still qualified to recontest as the president. I strongly believe Section 137 is both retroactive and prospective. If he comes out to contest in 2023 there will be a lot of court cases until the SC clarifies section 137 of the new Electoral Act

I got caught up with something on my neck in my neighboood recently.

There's this woman (A) who bought a sewing machine from one woman (B) 9 years ago, suddenly woman B just came from nowhere to come and claim the sewing machine that she sold years back that she only use the machine as a collateral from woman A that she didn't sell it for her.

Now the issue is Woman A has sold the sewing Machine and also insisted that if truly woman's (B) use it as collateral for how many years now she would wish if Woman B paid her back with the interest on the money which the money is way much more than money for 100 sewing machines.

Now questions is, how will I go abt it cause I happened to be one of the landlords in my area( I guess I am the youngest) and we are called to come and judge over the matter.
1. Woman's A doesn't posses the receipt of the sewing machine and as already sold the sewing machine
2. Woman's B want the machine at any cost claiming she has the receipt with her and she will use it against woman's A in court ( If the judgement didn't suite her taste in landlord meeting)


Note: They've gone to police station around early February which they've told woman's A abt the important of receipt and also let it known to woman's B that collateral shouldn't be more than a year and after that the person you borrow something from might as well claim the ownership what you use as collateral (Don't know maybe there's any law backing it though)

. The lawalllws collateral to last for about a year. If it evident that you can not redem the collateral it will be sold and your remaining money will be returned to you if it is sold more than the money borrowed . In this case no written agreement btwn And B. For reconciliation the law on collateral will be apiled since there is no written agreement between them. It is however good that there are witnesses who can testify on this transaction btw them.

You can only take an Oath twice when elected. Jonathan only took his Oath of Office once as an elected President of the FRN. The law of 2018 is in effect but not retrospective.

. The principle of joint ticket applies to GJ and Yarhadua .Both elected as the P and VP respectively. If the P dies the VP becomes the president. He took the oath of office as elected president on the basis of joint ticket.In the opinion of the SC oath of office is in effect whether you are the President or you become president in case of emergency. Additionally minimum of 8 years is allowed to rule as the president not 9 years.What is your take on this?

I don't know where people get the perception of not taking oath more than twice. Geidam took his oath of office thrice.

The Constitution in 137(1)b:
A person shall not be qualified for election to the office of President if he has been ELECTED to such office at any two previous elections;

Was Jonathan elected President in 2010? He only became President by virtue of S146(1) & not by Election. The word is "hold the office". Be that as it may, with the new Act, the law is not retrospective, and must be seen as true, just and fair.

. The SC has not vacated its judgement on this matter in Ladoja vrs INEC 2008 referenced by FF . I think with the new act in motion since 2018 and precedence of the SC GJ is technically disqualified ftom having a rellection bid

In my opinion he is right GJ completed Yarafua tenure and took oath of office as the president .Later he took his second oaath in 2014. How many times will he take oath as the president ? Section 139 FF is explicit enough to disqualify him.

Hello house, the age of my spouse on our marriage certificate (church wedding cert) was wrongly captured (my own fault) and I will need to upload the certificate for visa application for spouse dependent visa application for my spouse to join me in uk asap. Common sense dictates that the age on marriage certificate should tally with her passport DOB .

Hence, I have approached the church for correction and they have refused blatantly on the ground that the mistake is not coming from them. So what other options do I have for proper documentation in this visa application,kindly advice.

. Is your husband in Nigeria? Can you show me the copy of the certificate to know if it is even acceptable. Many church certificates are fake initially.Then I can advice you on what to do next!

Sometimes, when the wet dream is about happening I'm conscious and try screaming the name or blood of Jesus but it seems am just very powerless and before I know it, semen has spilled out and I will remain like that. Sleep is distorted and all efforts to sleep is impossible.

Sometimes, when I go to bed early by 8PM and I get caught up by wet dreams by 9:30PM, it means sleep for that night is gone completely. I sleep maximum 2 hours daily because this stuff has messed my mind and life up.

Whenever I lie down to sleep, different uninvited thoughts start forcing themselves on my brain both those that happened today and the ones of years ago. I always try deflecting them by replacing them with bible quote or singing praise to God in my head.

I woke up since 2:30 am today with a wet burser soaked in semen and started typing this because I couldn't no longer sleep. Afternoon sleep is very impossible for me as it has never worked for even 1 minute

Where do I go from here? Depression is real when solutions are being defiled.

. All you have is psychological. When there are psychological issues a lot of unfounded illnesses will set in that no test can reveal. Wet dreams are common to many mature men. Because you keep having wet dreams you are anxious of what might be the problems and this leads to depression and accompanying unfathomed illnesses. It is like a.vicious cycle. Other news outlets are good. They are living up to their mandate. However, there is something special about Nairaland. The comments from young and vibrant nairalanders, make the news extra-interesting. Although some comments are divisive, most of them are educative.
