what is the definition of transmission ? why was BVAS procured? what was the intention of BVAS? was it limited only to biometrics verification or did it include instant transmission of results? why was IREV created? what is a contract? was there an admission on tape of the INEC chairman telling Nigerians the results will be transmitted electronically from the polling unit ? was that statement from INEC chairman a form of social contract with the Nigerian electorate ? what are the penalties for contractual breach? Is promise a form of unwritten contract? Are unwritten but verbal contract or promise admissible in Law? IF so, was that a promise? IF it was a promise, was it kept? IF it wasn't kept, does that amount to fraud? What is fraud? Is this act an of dishonesty to create a false advantage ? what is the barometer of ethics? was it crossed? were the people tricked by INEC and his Chairman using state resources to believe and subscribe to the lie?

when case don wear pant - you go know why to go court no be good thing for both who dey want case and those wey no like case grin
. BVAS can only be used to prove overvoting. It is not negotiable. As for transmission of results there is no hard and fast rule as long as provisions are available to carry out check and balances on results. For example every ward has a returning officer who will collate all results from the polling units. All the ward returning officers will submitt at the local governments. The local governments returinig officers will submitt at the state collation center. From there to the nationall collation center in Abuja. If there are no questions at the poling units, lacal government and state level ,no question at the national level. In all the three stages votes can be legally cancelled according to the INEC regulations. Aggrieved parties may go to court. but I am very sure nothing will come out of it. Non use of BVAS to transmitt resukts from the polling units is not strong enough to affect the outcome of the election.

yes that was how Professor Oserhiemen Osunbor called it until Oshomole defeated him in court to restore his mandate

Facts are a stubborn thing to deal with and when faced with "earth shaking facts" - 90% of corrupt Judges will bend to accept the truth

grudgingly - My question for you is - Since judges are meant to interprete the constitution - HOW CAN ARIWOOLA interprete it that

what is written in the constitution which the blind can see - Is not "NOT" there in the constitution ?

Instant Electronic transmission from the polling unit is an undeniable part of the electoral act of 22 - when that fails, election did not happen

HOW ARIWOOLA WILL SAY THAT IS NON-EXISTENT, LET HIS OYO STATE TRIBE EXPLAIN IT TO THE WORLD SINCE BEING FROM OYO STATE makes him not to read the law as applicable - chai, I wish FRA was still alive, na him food be this --- ROTIMI WILLIAMS grin - Willy the Law
Apart from the fact that it is also difficult to investigate presidential election results in Nigeria because of time frame and the spread of areas or states covered by the election, BVAS is not mentioned in the ellectoral law and the INEC reserves the right to conduct the election not minding any emergency that arises during the exercise. The SC will jot give any judgement that may create tension in the country. Finally constitution supercedds the electoral acts. The constitution is silent on electronic transmission of results. In sum,it is a waste of time and an attempt in futility!

Inconsequential!

Before general elections, Buhari started disturbing Nigerians on the need to use BVAS, Buhari took the matter to the Senate to look into it and approve it.

To cut the story short, Senate President the rubber stamp Senator endorsed it as usual.

After general elections, Senate president came out and denied the use of BVAS, claiming that they never approved BVAS.

My problem now is, what about all the billions approved for the so called BVAS machine, did Buhari put the money in his Bank account, or Ahmed Lawan took the money huh

I advise EFCC to arrest Buhari immediately he leaves office. The amount of embezzlement of public funds going on in this APC administration is alarming.

I keep telling people that Buhari is a pretender, he is just like the more you look the less you see 💯
EFCC : We will arrest him just as we arrested Obasanjo , and Jonathan after they left office as the presidents with our bilions of naira in their pockets.

Nobody can go to court and win at the PEPT and SC. The time frame for the litigation and judgement is so little that the case cannot be logically presented. For example will you bring evidences from 36 states and 774 local governments? Such a case is always dead on arrival and just an academic exercise! Falae vrs Obj 1999. OBJ vrs Buhari 2003. Despite the obstacles, BAT won.

Tinubu: Won in South West, North Central and North West

Atiku: Won in North East

Obi Won in South East and South South.

Congrats to Jagaban!
. What the IGBOS don't realize is that they cannot present any president without the support of the core North and entire North. That makes YORUBAS to be wiser than them and more trustworthy in the perception of the North! For IGBOS to rule inNigetia they will parley with the SS. Both SE and SS will come to SW.SW will take them to the North for consultation. That is all.No tribe or region can forcefully produce president in Nigeria without other tribes Tribal symbiotic relation is a stepping stone to presidency in Nigeria

Kobonaire4:
Here is a thought. 13.1 million people did not vote for APC, out of the 21 m who did vote.

If those 13.1 million people had voted for one party, APC would have been voted out. But because they voted for 3 different parties, the votes got divided, and APC won the election.

The truth is, APC lost this election. Most Nigerians did not vote for them, nor do they like them. But they won because Atiku and Peter Obi and Kwankwaso and Wike could not at the very least compromise with each other.

That is the sad cold truth. A disunited opposition loses the election.

Like I said, APC did not win this election, the opposition lost it.
. I have been justified that no Hausa man will hand over to an Ibo man. I have been justified that. if the North did not betray him he would win.Yes the North stood by him.. Tinubu chose well by using Sheyimma as his running mate. That made him get votes in the North. Freedom at last for the South. Eyi ta seru to labe Hausa..Glory be to God

Politics › Re: Tinubu Fails To Make 25% In FCT, It All Becomes Complicated Now- A Lawyer by ejimatic:
FatherOfJesus:
Olisa Agbakoba, a senior advocate of Nigeria (SAN), has asked the Independent National Electoral Commission (INEC) to clarify section 134 of the 1999 constitution (as amended) which specifies the requirements for a candidate to be declared winner of a presidential election.

Section 134 of the 1999 Constitution provides as follows:

1) A candidate for an election to the office of President shall be deemed to have been duly elected, where, there being only two candidates for the election:

(a) he has the majority of votes cast at the election; and

(b) he has not less than one-quarter of the votes cast at the election in each of at least two-thirds of all the States in the Federation and the Federal Capital Territory, Abuja.

(2) A candidate for an election to the office of President shall be deemed to have been duly elected where, there being more than two candidates for the election:

(a) he has the highest number of votes cast at the election; and

(b) he has not less than one-quarter of the votes cast at the election in each of at least two-thirds of all the States in the Federation and the Federal Capital Territory, Abuja.

Although commending INEC for their “great job to ensure free, fair, verifiable, credible and transparent elections”, Agbakoba said the clarification was needed.

“I am a little worried,” he said.

“I reviewed section 134 carefully, specifically, subsections 134 (1) (b) and (2) (b), and wondered if “two-thirds of all the States in the federation and the federal capital territory, Abuja” means either of the following:

“a) that a presidential candidate must score not less than one-quarter of the votes cast at the election in each of at least two-thirds of all the States in the Federation which means 24 states, the 24 States will include the federal capital territory Abuja as a “state”, or

“b) that a presidential candidate must score not less than one-quarter of the votes cast at the election in each of at least two-thirds of all the states in the federation which means 24 states and in addition to meeting the one-quarter requirement in 24 states, a candidate must also win one-quarter of the votes cast in the federal capital territory, Abuja.

“In this sense, a presidential candidate must have one-quarter of the votes cast in the federal capital territory, Abuja, in addition to scoring not less than one-quarter of the votes cast at the election in 24 States of the Federation, to be duly elected.”

The former president of the Nigerian Bar Association (NBA) added that there are three major questions arising from his interpretation.

“(1) Is the requirement that a presidential candidate must score not less than one-quarter of the votes cast at the election in each of at least two-thirds of the 36 States of the Federation; does this mean that the Federal Capital Territory, Abuja is incorporated in the 24 States?” the statement reads.

“(2) Is the requirement that a presidential candidate must score not less than one-quarter of the votes cast at the election in each of at least two-thirds of the 36 States of the Federation; does it mean that the presidential candidate must also score not less than one-quarter of the votes cast at the election at the Federal Capital Territory, Abuja?

“(3) Can a candidate that scored not less than one-quarter of the votes cast at the election in 36 States of the Federation but fails to score one-quarter of the votes cast at the election at the Federal Capital Territory, be duly elected as President of Nigeria?

“Finally, Section 134(1)(a) provides that a candidate for an election to the office of President shall be deemed to have been duly elected, where, there being only two candidates for the election, the candidate has the majority of votes cast at the election, but Section 134(2) provides that a candidate for an election to the office of President shall be deemed to have been duly elected where, there being more than two candidates for the election, the candidate has the highest number of votes cast at the election. The Constitution describes the winner in two different languages.

“One, the winner must score the majority of votes and the other, the winner must score the highest number of votes. This is confusing.

“To be honest, I am not quite sure of the right answers to my questions. I just thought to bring this to your attention as something you might wish to clarify to the public.”
APC will be declared winner . Aggressive parties will go to court and the Supreme Court Wiill interprete it as optional to satisfy the two requirements.
