The Ekiti state Governor, Ayo Fayose has accused President Buhari of manipulating the just concluded Kogi state elections. He said “Having manipulated the election substantially, what they plotted by covering up Audu’s death for hours against Islamic injunction, was to declare a dead candidate as elected governor of Kogi State to pave the way for the emergence of his running mate as the governor-elect.” According to Sun Newspapers, Fayose accused the President of using the Attorney- General of the Federation (AGF) and Minister of Justice, Abubakar Malami (SAN) to change the 1999 Constitution and the Electoral Act 2010. He also added that “only the Supreme Court can resolve issues not envisaged by the Constitution like the one that happened concerning the Kogi State governorship election.” Following the cancellation of the results of the poll in 91 polling units, the Independent National Electoral Commission (INEC) declared the governorship election held in Kogi, inconclusive. A police corporal has been arrested for allegedly killing his wife in Egbeda area of Lagos. The suspect identified as Yinka Oloko reportedly shot his wife by accident on Tuesday the 24th of November 2015 in the bedroom of their rented apartment. The corporal attached to the Special Anti Robbery Squad in Ikeja arrived home on the evening of the incident and started undressing with his wife sitting on the bed. While removing his pistol from the holster, he mistakenly shot his wife on the lap, leading to commotion in the apartment. Oloko, assisted by neighbours, was said to have rushed the woman to a nearby hospital, but she reportedly died before they got to the hospital. The Nigeria Police did a wonderful job today, Wednesday November 25, 2015 when some of its officers engaged some armed robbers in a shoot out and killed five suspects in Ibeju-Lekki area of Lagos state. According to the News Agency of Nigeria (NAN), apart from the suspect killed during the fierce gunbattle, one of them was arrested alive with bullets wounds. Police sources informed that the suspects had engaged policemen from Elemoro Division in Ajah during the severe shootout, and five of them lost their lives on the spot. The source said: “The police in Elemoro got information that the suspects were operating at Abule Parapo, opposite Awoyaya in Elemoro area of Ajah around 2 a.m. “The suspects engaged the police in a shootout as soon as they saw them. Two locally made double barrel shot guns, one cutlass and iron cutter was recovered from them. “The gang had been terrorising residents of Ajah, robbing and raping women.” After the shootout, the corpses of the dead and the injured suspects were reportedly taken to the Lagos state police command headquarters, Ikeja at about 12.15 pm, NAN reports. The case has since been taken over from SP Sani Limawa, the Divisional Police Officer at Elemoro by operatives of the Special Anti-Robbery Squad (SARS) for further investigation. The leader of the Biafran agitatiors, Nnamdi Kanu will reportedly spend another 90 days in custody of the Department of State Services (DSS), following an order by a Federal High Court in Abuja. The 90-day extension availed the DSS is to enable further investigation into the allegation of acts of terrorism and financing of terrorism levelled by the government against the Biafran leader. Mr Moses Idakwo, counsel to the security outfit, disclosed this at Kanu’s trial on Monday, November 23. Idakwo drew the attention of Chief Magistrate Shuaib Usman, to the federal high court order of Justice Adeniyi Ademola, granting further detention of Kanu for another 90 days. He buttressed that the Biafran leader’s continued detention was also owing to his inability to fully meet the requirement for a bail granted him. According to Premium Times, Shuaibu Usman, had issued an order for the bail of the accused on the condition of presenting a surety of Grade Level 16 with a landed property in Garki or Wuse areas worth N20 million. However, Idakwo asked the magistrate court to step down from the trial of Kanu on the ground that the court lacked power to prosecute terrorism charges. Kanu’s counsel, Mr Vincent Egechukwu Obeta, objected to the order of the court and the application that the magistrate court steps down from the trial. Obete informed the court about the affidavit before it, noting that the prosecution refused taking the necessary step to confirm the location of the surety’s plot of land. President Muhammadu Buhari has appointed Aliyu Aziz as the new director general and chief executive officer of the National Identity Management Commission, NIMC. His appointment came after the expiration of the tenure of Chris Onyemenam. A statement by Abdul-Hamid Umar, the General Manager, Corporate Communications, of NIMC, said Mr. Aziz was a pioneer staff of NIMC and the director, Information Technology / National Identity Database Department of NIMC before he retired in 2014. Mr. Aziz holds a B.Eng in Civil Engineering and M.Sc in Structural Engineering (with Specialisation in Computer Aided Design) from the Ahmadu Bello University (ABU). He has more than 30 years of post qualification experience in Engineering & Information Technology, spanning both the private and public sectors, Before he joined NIMC, he was the Information Technology Adviser to the Minister, Federal Capital Territory Administration, where he pioneered the implementation of the first e-government solution that won a Microsoft award in 2006. He served as the Sub-committee Technical Chairman on the Presidential Committee on Harmonisation of ICT which resulted in the formation of Galaxy Backbone. He was also a Deputy Director, Information Technology at the Bureau of Public Enterprises and the Principal Consultant, Management Information System (MIS) Department, Afri-Projects Consortium. He was a director at the secretariat of the Presidential Implementation Committee in the SGF’s office saddled with the responsibilities for the Implementation of Government Decisions on Consumer Credit System, National Outsourcing Initiative and Harmonization of Identification Schemes in Nigeria. A Nigerian visitor allegedly tried to smuggle 98 capsules, containing 1.6kg of cocaine, in his intestines the Dubai Criminal Court heard. An anti-narcotic officer suspected NE, 42, and when asked for his passport, the passenger tried to run away using the emergency exit. Police chased and caught him, searching him, he admitted to having capsules in his intestines. However, he denied knowing what the drug was. He said that he was to receive a call to hand over the capsules. NE released 98 capsules that contained cocaine. The court will reconvene on January 28. The Lagos State Government has warned Lagosians against eating exhumed and contaminated chicken that are in circulation within the state as they pose a serious health risk to everyone. The Commissioner for Agriculture, Mr. Toyin Suarau, said some imported poultry products that are contaminated were seized by the Nigeria Customs Service in Badagry and buried but were later exhumed by some people who planned to sell them to unsuspecting members of the public. ADVERTISEMENT Suarau disclosed this on Saturday while receiving officials of the National Orientation Agency who came to inform Lagosians about the dangers of consuming the contaminated food. The commissioner said the imported poultry produce was preserved with chemicals like formalin which was poisonous, adding that it could lead to slow death. Suarau said the poisonous products were not as nutritious as freshly processed poultry meat because imported poultry meat had been preserved for months and years with dangerous chemicals. The little hope that your “change” mantra brought to the poor man is fast becoming another tale in the book of presidential lies. So, for you to really understand the ramification of your decision, I urge you to come for a quick tour of down town. Don’t worry sir; it won’t cost you a thing. We will ensure that your visit is as comfortable as we can. Yes, we know you don’t take ‘shepe’ or ‘mishango’ or ‘Ghana root’ mixed with ‘draw-draw’. But don’t worry, we will have enough pure water available for you to cool your feet, wash your face and quench your thirst. It is true that the streets down here are littered with broken water pipes and heaps of smelly refuse dumps as a result of lack of government presence. But babu wahala, we will see to it that your danshiki doesn’t get so messed up. It will be nice to have you address the youths and explain to them why you have taken the decision to throw our streets into darkness and expose us to more terror from armed robbers. The incident happened on Friday 6th, November 2015, in her house shortly after she came back from an event she attended with her husband. The two younger brothers of her husband used cutlass and other weapons to attack her. By Paschal Chiduluemije It is a common saying that before you blame the hawk for its wickedness (of preying on the chicken), you have to first of all blame the mother hen for exposing her children to danger. Apparently, this adage goes to provide a good analogy that invariably speaks volumes about what obviously is expected of all the cowardly and uncivilised elements who are wont to and, in fact, have been criticising the peaceful protests being staged by the pro-Biafra agitators across the length and breathe of the South-East and South-South geopolitical regions in Nigeria as well as across major city centres of European countries, all demanding in unison for, inter alia, the unconditional release of Mr. Nnamdi Kanu, the leader of the Indigenous People of Biafra (IPOB) and the Director of the famous Radio Biafra that reportedly operates from London. Therefore, left to common sense, which unfortunately is lacking in these armed chair critics of pro-Biafra protests, neither Mr. Kanu nor the growing number of his supporters and fellow members of the Indigenous People of Biafra deserve, in the smallest ounce, any blame over the spreading protests. Rather, at the very root of it all, the actual blame/criticism squarely and befittingly goes to no other than President Muhammadu (Baba-go-slow) Buhari, and his ilk, whose extremely poor understanding of the operation of the rule of law, democracy and/or democratic governance is not only odious but equally anachronistic. As it were, President Muhammadu Buhari appears to be dead inclined to think that a country is deemed to be governed by rule of law when its rulers arrogate to themselves the extra-judicial power to arbitrarily interpret and determine not just the laws of the state but also when and how to obey/apply these laws to effect and at their convenience. This is indeed most unfortunate. Now come to think of it, what exactly is that offence against Nnamdi Kanu for the sake of which he is still being unlawfully kept incommunicado in the DSS dungeon without trial or prior prosecution, conviction or sentencing? For goodness sake, what exactly is the justification for Kanu’s unlawful arrest in the first instance and his continued incarceration by Mahammadu Buhari’s government whose increasing authoritarianism in a supposedly democratic milieu is not only becoming a notorious embarrassment to all sane minds but also is transcending into a potentially explosive threat to peace, stability and security of Nigeria and Africa as well as a grave source of international concern? (As has been recently catalogued and timely communicated to the international community by the opposition Peoples Democratic Party). Like members of the public have been duly informed and updated by the team of lawyers holding brief for Mazi Nnamdi Kanu – led by Barrister Vincent Egechukwu Obeta – emphasizing that their client has long been granted bail by a court of competent jurisdiction and that despite having meticulously met all the stringent and almost impossible conditions set out and as contained therein, and which incidentally goes to show the ever law-abiding and non-violent approach so far adopted by the pro-Biafra agitators, Mr. Muhamadu Buhari and the “deep state” within his government have rather decided to remain unlawfully obdurate and, in fact, hell-bent on holding Mr. Nnamdi Kanu down in the DSS “dark room” (which perhaps is a deliberate attempt to cause him blind) with the probable intent to ensuring that the people of the Biafran enclave are pushed to wall and thus compelled to unveil their deadly fangs – like the terrorist Northern Nigerian Boko Haram separatists are doing – before eventually taking a reasonable course of action or doing the needful(?). But like I noted earlier in my previous write-up – titled President Buhari: Release Nnamdi Kanu Now (published by Saharareporters, among others) – given that the Radio Biafra is reportedly registered or licensed to operate in the United Kingdom and in which circumstance Mr. Kanu – the Director of the station – implicitly pays tax and other payments due for it as and when due, who then between the relevant British regulatory authorities and Mr. Nnamdi Kanu should in the prevailing circumstance be held responsible for whatever is deemed to be the outrageous content being aired by the station? Or shouldn’t Muhammadu Buhari and the “deep state” elements within his government be wise enough to know that only through the use of diplomatic processes and/or channels that the alleged offensive content being aired by the so-called pirate radio station could be contained? Meanwhile, granted that the British government has not till date found any good reason(s) or seen anything wrong, outrageous or ominous in the quality of the content being aired on the Radio Biafra to warrant the immediate withdrawal of its licence or even stop the station from operating within its clime or with the aid of its enabling airwave – notwithstanding the recent futile attempt by the British High Commission in Nigeria to misrepresent her government’s legitimate and unalloyed support for the just cause and the right of the Indigenous People of Biafra to exercise their inalienable right to seek self-determination(as enshrined in and guaranteed by the United Nations charter and sundry other international treaties, and) as was hitherto and legitimately sought by the people of Scotland through a well organised and globally watched referendum that ultimately saw the vast majority of the Scottish folks voting to reiterate their preference, faith, solidarity and commitment to the oneness of the British state – one wonders therefore what constitutes the substance of the charges being levelled against Mazi Nnamdi Kanu by Muhammadu Buhari’s government. Curiously, granted the fact that never in the history of this mere “geographical expression” has any plebiscite been organised to determine whether or not there is actually that voluntary resolve among the federating units or the diverse peoples of various nationalities co-existing within this mongrel entity called Nigeria since the attainment of its flag independence in 1960, one therefore wonders wherefrom President Muhammadu Buhari seemed to have derived his recent faulty and risible submission that all the people/nationalities living within this Lugardian contraption are in complete accord with their prevailing hellish existence which obviously is only next to the type of existence obtainable in the kingdom of Satan. The female bursar of Rivers State Polytechnic Bori, Lilian Ikombia Davies, and a lecturer in the department of management sciences of the University of Port Harcourt, Dr Iba Lebari, have been reportedly kidnapped at different locations in the state on their way home after work. The bursar of the now Kenule Saro-Wiwa Polytechnic Bori, may have been trailed from Bori before intercepting her at Akpajo-Eleme, along the East-West road in Eleme local government area of Rivers state on Monday, November 16. On the other hand, the Uniport lecturer was said to have been kidnapped by unknown gunmen at the close of work on the same day Davies was also abducted. Since their abduction on Monday, the whereabouts of the victims remained unknown. The management of the University of Port Harcourt in a reaction condemned the kidnap of Lebari and called for his unconditional release. In a statement issued by the deputy registrar on behalf of the institution, Williams Wodi said the kidnapped lecturer had some medical issues that needed regular medication and should not be in solitary confinement. As at the time of filing this report, it was not clear whether the Rivers police command had made any official statements over the two abductions. Editor’s note: In line with the case between the Criminal Code Tribunal and the president of the Senate, Bukola Saraki, Femi Falana, a human rights activist and Senior Advocate of Nigeria, in this opinion piece with Vanguard, examines the ruling by the Supreme Court and why it should not stand. On May 13, 2015, President Goodluck Jonathan signed the Administration of Criminal Justice Bill into law. Both chambers of the national assembly had passed the bill to modernise our criminal justice system. In particular, the law has abolished stay of proceedings and interlocutory appeals by merging all preliminary objections with the substantive case in any criminal case instituted in a federal court in the country. The revolutionary intervention of the law was occasioned by the unending trial of politically exposed persons in corruption cases. Abacha v FRN In fact, the last straw that broke the camel’s back was the case of Mohammed Abacha v FRN, which had been stalled for 12 years on account of the preliminary objections raised and argued from the high court to the apex court by the defense counsel, Mr J. B. Daudu SAN. At the end of the “Israelite’s journey,” the Supreme Court ordered that the trial be commenced de novo at the federal capital territory high court. Having been completely frustrated in the circumstance, the federal government was compelled to discontinue Mr Abacha’s corruption charge involving the theft of N664 billion under the pretext that the case would be “amicably” resolved! Before then, the Lagos state government had been forced to abolish stay of proceedings in criminal trials following the prosecution of Major Hamza Al-Mustapha over the murder of Mrs Kudirat Abiola. The trial had lasted 13 years on account of several preliminary objections and interlocutory appeals that were pursued from the High Court to the Supreme Court. Contrary to the misleading view of many senior lawyers that the abolition of stay of proceedings in criminal trials is illegal it has been judicially decided that statutes that oust the jurisdiction of courts to stay proceedings are constitutionally valid. In FRN v Nwude (2006) 2 EFCCLR 149 at 161 it was held by Justice Oyewole J. (as he then was) that section 40 of the Economic and Financial Crimes Act, 2004 which abolished stay of proceedings is not an infraction of the powers of the court. According to his lordship: “Inherent powers of the court only come into play in the absence of express statutory provisions and the court then fills in the gap by invoking its inherent powers to do justice in a given case… the intention of the legislature in this instance is to remove impediments in the way of the administration of justice.” Ajiboye v FRN Similarly, in Ajiboye v FRN (2013) 17 WRN 127 at 145 the Court of Appeal (per Justice Ogbuniya JCA) struck out the application for stay of proceedings on the ground that “it was incompetent in the face of the sacrosanct prescription of section 40 of the Act which clearly ousted the jurisdiction of the court over it.” It is trite in law that jurisdiction oxygenates all proceedings in our courts. Accordingly, the exercise of judicial powers by any court without jurisdiction is bound to end in a nullity, regardless of the industry invested in it. With the enactment of the AJCA, the suspension of criminal cases by all accused persons has been effectively stopped in Nigeria. Therefore, any judge who orders a stay of proceedings in any criminal trial does so illegally and is liable to be sanctioned by the National Judicial Council. It is unfathomable that the Supreme Court decided to return the country to the status quo ante in a rather brazen and bizarre manner. The tribunal ruling Given the ouster clause contained in section 306 of the AJCA, the Code of Conduct Tribunal ought not to have delivered its ruling in respect of the preliminary objections filed by Dr Bukola Saraki. The ruling should have been read together with the judgment after the conclusion of the trial. It was the premature ruling of the Tribunal which led to the filing of an interlocutory appeal in the matter. Instead of declining jurisdiction to entertain the interlocutory appeal that has been abolished by the AJCA, the Court of Appeal ordered a suspension of the trial at the Code of Conduct Tribunal to await its decision. According to reports, a male student of the University of Professional Studies, Accra stabbed his girlfriend to death late last night/in the early hours of the morning. The unidentified student allegedly stabbed the lady severally in the neck, chest and head after he suspected she was cheating on him. The body of the deceased has been sent to the Alfa Hospital at Madina. While the accused who attempted to commit suicide after the heinous crime is being treated in hospital. According to Ghana's Starr News, the boy is in critical condition after his failed suicide attempt. A 300 level student of Federal University, Dutse, Jigawa State, Bashir Musa was said to have been killed in a fight over a girlfriend last Friday. It was learnt that the trouble that led to the death of Musa began when his girlfriend, Aisha Sale, a student of Jigawa state Polytechnic who is befriending six others including the deceased, all from same university visited one of her boyfriend in Yalwawa quaters of the state capital. The under 17 Junior National Team (Golden Eaglet) has returned to Nigeria from Chile after their victory in the recently concluded FIFA U-17 World Cup. The team returned to Abuja from Chile this morning. I sincerely hope the Senior National Team (Super Eagles) will use their victory as an inspiration. They have made Nigeria really proud. Inspector General Of Police, Solomon Arase has approved the setting up of a Complaint Response Unit (CRU). The 24/7 multi-platform which will be officially launched on Friday, November 13, is aimed at promptly addressing real time complaints, concerns and queries regarding activities of officers and men of the Nigerian Police Force. Briefing journalists at the Force Headquarters in Abuja on Monday, November 9, CSP Abayomi Shogunle, Officer in charge of (CRU) said the initiative is “community- oriented complaint management system” and is aimed at winning public trust and confidence as police forces all over the world are becoming more open to the citizens and the public. He also noted that the Unit is designed to provide a veritable platform for the public, to report rising cases of professional misconduct by police officers, such as torture, extortion, and taking undue advantage of the public. CSP Shogunle added that the unit will be operational in all the 36 states of the federation, including the Federal Capital Territory (FCT) with the central control Room situated in Abuja Nigeria. "What the police leadership has done by establishing this unit, is to send a signal that…the era of impunity is over, and that professional misconducts by police officers will no longer be tolerated, and they are not supported by the management of the Nigeria Police Force." Shogunle said "It is also to show that necessary actions are being taken by the force to ensure that the gap that existed between the police and the citizens, are closed up." CSP Abayomi Shogunle also disclosed that the unit would be composed of detectives from all over the federation; Investigators, Provost departments, while every police station will have an officer from CRU attached to it to treat injustices meted out to Nigerians by the police and report back to force headquarters within 24 hours. Hmmmmmm complaint response unit for police, hmmmm fingers crossed. Zenith Bank PLC have in recent years prouded themselves as the biggest and the strongest bank in Africa not only Nigeria even though they still make the same notion here in Nigeria. But does this mean they are above the laws of this country? When you visit other banks and visit Zenith Bank, you find out that it seems the law governing them is different from the one governing the other banks. My experience today on BVN Issues..... I visited Zenith Bank today to register for BVN (Bank Verification Number) and they refused to register me. These are the questions they ask me...... 1. They asked me if i have account with their bank, I said no. 2. They ask why I don't want to go to my bank and register for the BVN, I said my bank is far and more over too much cue. They finally told me that since I don't have account with their bank, they can't "capture me" if i should quote the customer service personnel. Why? I can't explain. According to the directives of the central bank, and i quote "The first step is to obtain a BVN while the second step requires the account holder to link the BVN with his or her bank account(s),” he said. Mu’azu also said an individual could enroll for a BVN without necessarily having a bank account. Such individual can then submit the acquired BVN at any bank he/she wishes to open an account". Na wa oooh, why must this bank almost always flout the orders of Central Bank of Nigeria and even the law of this nation? They even later gave me conditions that if i must register for BVN with them, I should open an account with them. When i asked their requirements for opening a savings account, what they told me stoned me guys. They said i must provide the following: 1. Means of Identification 2. Utility Bill 3. Passport Photograph 4. N10,000.00 - Initial Deposit For savings account? are they crazy? According to the constitution of Nigeria, I don't think i even need more than N10 (Ten Naira) to open an account. Though I stand corrected. If this government prides themselves as been under the law and respects judicial proceedings, I think they should stop making too much laws and start enforcing the ones already made. Must I have N10,000.00 (Ten Thousand Naira) to open an account just because it is Zenith Bank? This days ladies no dey agree again. Is all about showing your selling point to see potential buyer which in this case is men. Even if they have a man in their life, they will always look for better once by dressing to fit the culture like my girl friend told me the other day. Can you really allow your girl dress this way to go out or even accompany you to somewhere even though say na club una dey go? This is outrageous and ladies plz and plz and plz. a lee o da ooo.
