Hello please could someone help me urgently. We are applying for spouse and child dependant visa for my brother together with his wife who is the main applicant. On getting to paying IHS for him and the 2 children we have been asked to provide Her (his wife the students/main applicant) visa expiry date she just applied last night and we are using her GWF number to apply for her family.. i don't know why this is the case as she is even yet to do biometrics or get visa.. please does anyone have a similar situation or is there a new rule now?

All you just need to do is to include proof that your relationship is genuine and subsisting. Write a cover letter detailing the nuances of your relationship, include your traditional wedding pictures, joint accounts, joint bills, correspondence from your bank, government, healthcare provider etc. showing that you have been living together since or before your traditional wedding, evidence of jointly owned properties, financial maintenace towards your partner (if applicable), pictures with family etc.

I need proper guidance with my application regarding the below.
My wife and I got married last year. We only did traditional marriage and no court or church wedding. We don't have a child yet.
Since she is about to apply for a visa and we are applying together, I wish to know if doing court wedding next week (middle of July) and making an application the following day with the marriage certificate is 100% valid.

Since the marriage certificate is just a day old and we do not wish to backdate anything so that it will be 100% legitimate

3 months from when the name on your passport is changed. Even though the standard is that your name changed when you got married, until you officially change it on your passport, you will still be officially addressed by your maiden name. This is because many people decide to go by their maiden names after marriage so the name change isn't automatic. Your employer/bank will not change this except if it changes on your visa and for you to change it on your visa/BRP, you need to change it on your passport. Your passport/BRP and marriage certificate will be the common denominator in your name change.

I long figured that out about these questions but I always choose to see the right side of the question and answer accordingly, hoping that whoever reads the right answer (in line with UK reality and UKVI requirements) will have enough sense to do the right thing.

I have come to realise that no matter how long we keep harping on certain issues, some individuals will keep looking for ways to circumvent the system and do exactly what they want only to come back to complain when things go south. To your last statement… yes that question wasn’t genuine. You do read from a lot of people here asking that question or asking if a school ask for deposit before CAS, these are people with untouchable loans. If you have genuine money it doesn’t matter if school ask for deposit or not.

I choose to see the right side of the question Always better to have it on a card, in cheques or an account from where transfer to the UK.

Yea makes sense but most are asking the question for obvious reasons and confusing others with genuine POF I'm sure the POE officer would be wondering how far ....well most schools advise against carrying large amounts when arriving though so may be they are right leaving it intact

Ideally, you should have it on your person/card/account or have evidence that it has gone towards your school/travel expenses just in case it is needed at the POE. I choose to assume that that was what the poster meant when that comment was made - maybe something different was meant though.

How do you leave funds intact until you get to the UK when in actual fact you are meant to use same funds for your fees and living expenses? These POF packaging thing is going to ruin us all soon if care is not taken.

Your POF is meant to fund your school fees, living cost and other expenses, please try and get funds out of it before your trip ooo!

You don't need a right to rent document as your BRP stands as your valid evidence that you have the right to live in the UK and rent long-term accommodation.

Try Uni of Kent. I remember that some people usually get in at the last minute but this is subject to the spaces available on the course or if someone who had previously accepted the offer ends up declining thereby creating a space for you.

Really? That's odd because their international student deposit went up from £1,000 to £2,000 about 2 years ago for the acceptance of offer which secures your offer and CAS in addition to the funds in your account.

I printed my POF bank statement on the June 16 in order to get CAS. I just got my CAS now and will complete my visa application tomorrow. I want to ask if I am to print another bank statement for visa application because it’s already 21 days after printing the statement and given that my biometric date will be weeks from now, the 31 days grace for that statement would be over when I will be going for my biometrics.

Kindly assist with way forward because my school stated that I have to let them know if I want to use a new/updated statement other than the one I submitted for CAS and that will take more time.

It has to be from an international company or organisation, not an organisation that just operates in one country.
This can be evidenced by their letterhead showing their offices in 2 or more countries + contact numbers + email(s), web presence etc
The sponsorship letter must be on the letterheaded paper and stating how much they are giving you or stating that they will cover all your outstanding tuition/maintenance costs.

1. You can include a cover letter to explain this but ensure that you declare them on your student visa application. Note that you can opnly bring them with you if the father will also be coming or if you have a sole custody document from the court. Bringing them outside of that will be subject to the ECO's discretion and you will need to prove beyond reasonable doubts that no other option is feasible outside of them being here with you. Childcrae details in the UK, evidence that the other parent can't reasonably take care of them in your absence, cover letter from the other parent alongside the parent's passport details/copy etc.
2. As long as the birth details are correct, the document is original and has all the necessary info, you shouldn't have a problem.
3. Proof of funding - ideally yours but if the other parent is funding, then the parent has to state why it is not feasible for him to accompany the kids, TB test, Birth certificates showing you and their dad as their parents, Evidence of your status/studentship in the UK, child care plans, if they are below a certain age, pictures of you together, any financial contributions by you for them evidenced by receipts

Not necessary. Deed polls are not required for name changes due to marriage and updated BRPs have to be requested within 3 months of the name change (in this case, when the passport is updated to reflect the new details) in order to avoid paying a £1,000 fine.

You can change it by deed poll, then wait until your passport is about to expire in 2 years time. Then send your deed poll certificate to have the BRP changed, then get your passport in the new name on your BRP.

Deed poll not required for name changes due to marriage. Request for updated name on BRP must be made within 3 months of changing the name on your passport.
Passport needs to be renewed first as the only name that can go on your BRP is the one on your passport.
If you want to change immediately,
1. apply for a new passport in the name you want to use.
2. Apply for a new BRP and follow instructions here: https://visas-immigration.service.gov.uk/product/biometric-residence-permit-replacement-service

If you want to wait till when it is time to renew/extend your visa/BRP,
1. Apply for your passport in your new name few months before BRP expiration.
2. Make an application to extend/renew your visa, fill out the form with the new name on your passport, give details of your previous name, passports visas and whatever has changed.
3. Submit your marriage certificate + new passport to support the change in details.
4. Register your biometrics and wait for your BRP in your new name.

Or can the person just start using the new name here while the BRP and Nigerian passport still have the maiden name since there is a marriage certificate?
Note that the marriage took place shortly before the visa application commenced and the Nigerian passport still has up to 2 years before expiry.

Hi, AR response/decision is usually communicated within 2 weeks though it can sometimes take longer than that. Passport return after a successful review/passport submission has no time frame.

Wait! The school needs your POF in your own account before CAS which has not been given but you have already submitted an application and about going for biometrics? Please explain as this doesn't make sense to me because UoK usually asks for non-refundable deposits before issuing CAS and CAS is usually granted after they are satisfied with your financial evidence.

after i got my unconditional offer, my school ask me to show POF before getting CAS .. My POF which was in my spouse acct was ready to go but upon sending to school , i was told it has to be in my own acct as the MA. so i had to move it and then wait 28days.
while waiting i sent a mail to school asking for deposit details so i can just run that during the wait but got a response saying they have not ask me for any deposit and that i have no such conditions to fulfil.
Now i have applied for my visa and biometrics is ds week.... i just want to double check bcs of how i see everyone talking about deposit - is it that some school don't require deposit while others ask...

That shouldn't be a problem as long as it is in the right field. In Nigeria, names are usually arranged LAST NAME, MIDDLE NAME, FIRST NAME while in the UK, it is FIRST NAME, MIDDLE NAME, LAST NAME. It only becomes an issue when your First name is used as your last name and vice-versa.

Exactly what the school said. She has to reapply/defer to the next session, get CAS and apply again. I know that this is not what you hoped to hear but it is what it is. Alternatively, she can can apply to another school but I'd say stick to the current school since they might process the CAS faster thios time and hopefully, UKVI will return the passport faster the next time to avoid issues.

The CAS department told her to wait for new CAS for September intake and that she can not use the June Visa. Please what can she do at this point ?

* Student visa - Migrate to other visas from this. Any time spent on the student visa doesn't count towards the 5 year route but counts towards the 10-year route. Time spent for BSC, MSc/MA/MBA etc, PhD counts towards 10 year stay as long as it is legal without any breaks.
* Spouse visa - usually 5 years excluding time spent on other visas. In some cases, 10 years if leave is granted outside immigration rules - usually for in-country applications.
* Innovator visa - 3 years to PR
* Start-up visas - Can stay for an initial 2 years but needs to switch to another visa to achieve PR.
* Temporary Worker - Government Authorised Exchange visa - You can stay up to 12-24 months. Eligible to switch into Global Talent Visa
* Global Talent visa - 3-5 years depending on the field.
* If in the UK, you might be able to get PR through other routes outside the immigration rules depending on your situation.

No, it is not. The ECO might or might not send NSF mails to ask for it so better to have the required documents before biometrics.

It is advisable for someone to submit visa application without TB test result and then submit the TB test result at a later date.

The date that my brother was booked for TB test is 30Th of this months.

Thanks for breaking it down as I didn't have the luxury of time to go into a detailed explanation. The SMS system is a UKVI system and just as organisations get their sponsorship licence from UKVI so you can't separate the 2 in the true sense of it.

The above doesn't negate my earlier comment that a CAS statement doesn't need to be uploaded once the applicant uses the correct number without error. Whether it is submitted or not, UKVI (the ECO) will still run a check to ascertain the information on the application as correct.

As an organisation, if someone submits a document/or document that has the wrong number which doesn't match the complaint, I'd then ask for the correct document/reference or invoice number etc just to clarify and effectively deal with the complaint/situation. Asking for the updated/correct document or number doesn't come into play and is not my 1st call except an error has been made in the initial submission.

CAS is electronic n virtually generated.
Nevertheless, I still stand on what I said earlier that NSF can be sent to upload it because I was aware when it happened.

- a data record virtually created
- by an education provider (school)
- through the sponsorship management system (SMS)
- with a unique reference number URN
- this education provider acts as your immigration sponsor in the UK.

This same SMS is also used for issuing CoS by employers who already have the license to sponsor with the Home Office under Tier 2

UKVI is just a fraction of the Home Office. The Home Office manages this system as part of its duties - immigration (UKVI), security (MI5), law n order (Police) etc
