To the extent that there are ordinance codes which forbids street begging in Lagos, same shall serve as law. Therefore this law gives capacity for agents acting under its seal and authority to enforce its directives.

Any person thus detained, arrested, incarcerated or penalized for violating the law is deemed a "lawful deposition".

No one has yet been "unlawfully detained".
The arrest and incarceration of these people may be lawful, but once they are released from incarceration, their detention and forcible deportation are unlawful. Pray tell, who issued the court order to legitimize the detention? Which court?

Lagos state officials, knowing fully well that the action is unlawful, have denied any involvement in the illegal deportation. So who committed this appalling act against Nigerian citizens? NASS needs to open a major investigation.
Politics › Re: Lagos Dumps Beggars, Homeless In Onitsha by nduchucks: 10:21am On Jul 25, 2013
Section 35 (6) of our Constitution:

Any person who is unlawfully arrested or detained shall be entitled to compensation and public apology from the appropriate authority or person; and in this subsection, "the appropriate authority or person" means an authority or person specified by law.

The transportation and deportation of these Nigerian citizens constitute minimally, unlawful detention. Fashola and Lagos state must compensate these people and offer them a public apology as required by the constitution.

We need some human rights lawyers and constitutional law experts to file a lawsuit on behalf of these people whose rights are being trampled upon. They also need to claim monetary damages against lagos state. In the meantime, find 170 random Lagosians to deport back to Lagos. Nonsense!

manmacho: does the Nigeria constitution allow marriage between a minor and a major? i have never seen a reigistry that does that
It is free for all when it comes to traditional marriages. Obas, Obis, Emirs, and commoners alike, routinely marry multiple wives and underaged girls.
Politics › Re: Senate Denies Endorsing Child Marriage Law by nduchucks: 1:21pm On Jul 24, 2013
naptu2: Some have said that the ambiguity in section 4b could lead to the legalisation of marriages of people under the age of 18. However, others argue that it won't because, according to the Child Rights Act, it is illegal to marry anyone below the age of 18. The marriage would be illegal at the time it is being contracted, while section 4b deals with a woman that is already married. But note that the Child Rights Act has only been domesticated in 24 states.
In addition to the excellent points above, it should be noted that traditional marriages which allow for polygamy and marriages to underaged girls is essentially immune from the impact of the problematic constitutional amendment.

@Abagworo, this is quite unbelievable!! Back in January of this year Godsday Orubebe, accused Rivers State Governor and the Chairman of the Nigerian Governors’ Forum, Mr. Rotimi Amaechi, of disrespecting President Goodluck Jonathan.

Orubebe claimed, as you stated, that Amaechi had gone on air to say that governors of the Niger Delta states were ready to take over the construction of the East-West Road. The President's mother in-law has now been killed on the same road. shocked

Katsumoto: The suggestion that all Nigerians should return home before there can be progress/change is as ludicrous as suggesting that all Nigerians run for office.
I agree that the above is ludicrous. Note however, that I never said that ALL Nigerians should do as you stated above. You know very well that I will not allow you to put words into my mouth. You are simply arguing with yourself here.

Ndu_chuks, everyone knows that it is not your love for Southern Nigerians that leads you to oppose re-organization or disintegration, it is your love for the black gold.
Again you are misstating my position to score cheap points. I do not oppose re-organization, in fact I believe we'd be better off if we returned to the regional system. I oppose disintegration because I believe the resulting bloodshed would be too deadly and unacceptable.

I maintain that if you people love your country enough, you should return to build it, instead of leaving the nation building in the hands of the thieving leaders you criticize daily.
Politics › Re: Senators Who Voted To Legalise Underage Marriage. by nduchucks: 10:01am On Jul 22, 2013
Katsumoto: Well put - Nigeria needs to be re-organized or dissolved. I guess its better for these senators to discuss the merits of underage marriages instead of discussing the future of Nigeria.

Each day, Nigeria moves closer to violent destruction.
It is sad to note that you intellectuals in diaspora are only good at criticizing very loudly, providing suggested solutions to our many problems, but you are very poor or even cowardly, when it comes to implementing these solutions

For example, you want Nigeria re-organized or dissolved, but you have no blueprint on how that would be accomplished. You leave the implementation of these solutions at the hands of fellow Nigerians who are your senators, governors, and representatives. These same senators, governors, and representatives who you believe are incompetent and who you vilify for "supporting pedophilia".

I'm sorry to say that you people are part of the problem and enablers to your senators and reps. I venture to say that you are counting on the senators, govs, and reps, who you love to despise to implement your solutions - for that I say a very big shame on you.

So, Katsumoto and the Sam_Ikenna's of the world, I say to you, get your butts down here and implement these changes. Internet warriorship will not accomplish the changes you desire.

Politics › Re: Marriageable Age Of Places Around The World by nduchucks: 8:10pm On Jul 21, 2013
Traditional marriages have never been illegal in Nigeria and will not become illegal as a result of the constitutional amendment in question.

Today,no court of law or judge will issue a second marriage licence to you if you have already obtained a previous marriage licence issued by a court or a judge. That implies that you could not be legally married to multiple wives. Ironically, our courts will recognize your other wives as family members because they recognize traditional and customary marriages.

What am I implying? 99.9% of marriages to underaged girls do not take place in courts, so even if the new constitution is fully implemented, traditional marriages will continue as usual. Obas and Obis will continue to marry underaged girls, the Yerimas will continue to do their thing, polygamists will continue to marry multiple wives as they've done for possibly centuries.

This constitutional amendment is toothless and will have zero effect on the practice of polygamy and marriage of underaged girls. It is impossible to legislate culture and tradition, let alone enforce laws which ban tradition and culture.

You people are wasting your energies here. You should be protesting other important issues.

Where you go hide since, you and Eze Onlytruth? Good to see you smiley

I just stopped in to point out that 99.9% of marriages to underaged girls are Traditional marriages which are not controlled by the courts. These marriages will continue with or without the constitutional amendment which is currently causing yawa both online and offline among primarily, ignorant diasporans.

Until polygamy and underaged marriages are outlawed within the traditional institutions, theses practices will continue unabated in Nigeria.

Instead of calling for the recall of those senators, you should be calling for them to introduce bills which will outlaw the said traditional practices. Chances are, you will not be successful in that venture. Your outrage is misplaced.

This issue is not a religious issue but that of customs and tradition. Don't let people confuse you with a religious bigot.

Politics › Re: Shame On ALL Nigerian Women!!!! by nduchucks:
Katsumoto: Your comments are quite disappointing. You don't always have to defend certain actions just because they are actions of your Northern brothers.
The conjecture above is a baseless falsity which you cannot prove. I wonder why you are now comfortable with allowing your prejudices to do you in.

Attempting to compare the law in the US with the law in Nigeria is naive at best and disingenuous at worst. First, laws are better enforced in the US. Second, poverty doesn't force parents to sell their children to paedophiles. Whilst many US states permit parents to give consent, it is usually for those over the age of 16 and with someone who is equally under the age of consent, otherwise, it may result in statutory rape. What is the age of consent in Nigeria and was Yerima, (apply to other Nigerian paedophiles) under that age of consent when he married his pre-teen wife?
Only a fool and a very irresponsible human being would support pedophilia. Again you have taken what I wrote and extended it into a ridiculous realm. Many of you people are quite ignorant about the laws of your land and do not even realize that it is impossible to obtain a marriage licence in Nigeria where the spouse is not of age. Similarly, you cannot obtain a marriage license for a second wife through any court in Nigeria.

Even if the provision you are concerned about is not included in the amended constitution, people can continue to marry multiple wives and underaged girls as long as the marriage is traditional. 99.9% of marriages to underaged children and multiple wives do not go through the court system, so why are you all outraged? Every single Oba in your region will continue to receive underaged children as wives, the Yerimas of the world will continue to marry underaged girls with or without the constitutional amendment.

You people are better off being clamoring for better education and poverty alleviation instead of protesting a toothless constitutional provision. You should be more outraged because of Girls trafficking in Edo, the Baby factories in Imo, the girls‘ hawking in Abia, prostitution by underaged girls in Abuja and elsewhere.

16 - 18 year old girls may be physically ready to have children but are usually psychologically not ready for childbirth. Girls under 15 are unready both physically and psychologically for childbirth. That is why VVF is common in the Northern part of Nigeria. What kind of life is it for a gal to have had 2/3 children and divorced/separated before the age of 18?
You are stating the obvious, no one is promoting the above.

Garri the 1st: The bolded shows you're a backward fellow who'll rather remain in a messy spot while others make progress towards civilization.

I pity you.

cool
You are being unnecessarily emotional while ignoring what I wrote. Stop being lazy!!

As someone stated earlier, most of our mothers were married at tender ages but were not put to bed. I'll add that parental consent was not legally required when they got married. The new constitutional provision is actually an improvement on what obtains today.

What you should be more concerned about are Pedophilia, child sex slavery, and other horrendous crimes which still go unpunished, for the most part, in Nigeria.

It is quite interesting that a fellow whose handle is "Garri the 1st" has the gumption to refer to anyone as backward. Your name calling does not make your position more reasonable. P.S. If you are impolite to me again, I will curse you out in at least 2 languages.
Politics › Re: Shame On ALL Nigerian Women!!!! by nduchucks: 7:44pm On Jul 19, 2013
While I find pedophilia despicable, I am not so sure that the said constitutional amendment promotes pedophilia. It is still criminal to sexually abuse girls or boys for that matter, in Nigeria. The said provision as many of our constitutional provisions, is simply a carbon copy of what obtains in the USA i.e. Parental consent is required in order to marry a "under aged" lady.

Today, you can do that in Nigeria without the consent of anyone, because current laws do not require this consent. I submit to you that if passed into law, it will be a better law than what we currently have. You people are overreacting.

Girls under 18 have been given away in marriage in Nigeria for the past 100 years. So ogini ne big deal?

I believe that people are already working on a clause which defines a child as anyone below the teen age and which stipulates that children cannot be given away in marriage under any condition.
