BusinessRe: Cost Of Incorporating A Ltd Company At CAC by omogidi234(m): 5:22pm On Feb 12, 2008
@ [b]Femi_ko
you have heard the true gist from Thunder74, incorporation depends on a lot of factors i.e. who is doing it, share capital and when you want your certificate. The procedure is as follows: 1. You submit names for availaility search, it takes like 2-4 days to get it approved depending on whether or not CAC system is functioning properlly. There is however a faster means which is online i.e. submitting the names through the internet from the comfort of your home and getting result within 24hrs. (you are advised to drop more than one name and they must be generic). 2. the CAC forms are prepared for your signature. 3. The MEMART is prepared, stamped based on the share capital. 4. The documents are submitted at CAC. 5. You have your certificate.

the following may be useful:

fee to incorprate within 1 week (5 working days from the date of approval of the name)= N250,000
fee to incorprate within 2 weeks (10 working days from the date of approval of the name)= N200,000
fee to incorprate within 3 weeks (15 working days from the date of approval of the name)= N150,000
fee to incorprate within 4 week (20 working days from the date of approval of the name)= N100,000

if you are comfortable with my figures please do not hesitate to get in touch with me at arinnet08@gmail.com or kleandenation@yahoo.ca

Bros, I hail. There is practically no lawyer who will give you free advice- is like asking you to go and organise a free show. The only advice I have for you locate a good lawyer in Oshogbo pay their bills and instruct them and they know what to do. Otherwise, you can contact me on kleandenation@yahoo.ca. I am in Lagos.
BusinessRe: How Do I Register An Entertainment Company In Nigeria? by omogidi234(m): 2:26pm On Jan 10, 2008
bros I hail your courage. You will agree that no matter how lawless Nigeria appears we still have laws. Ok these laws stipulate what you must do b4 you can be said to own a company. the first point is that you have to register a company with the CAC and this is done by CAC accredited lawyers and accountant, and then you will register with whoever is regulating the indusrty you are venturing into. Coz each indudtry has a regulating body.
BusinessRe: Naija Bank Credit Cards? by omogidi234(m): 2:12pm On Jan 10, 2008
Well from the little I have seen, I think the GT Bank mastercard is a global phen,  I once heard a person who said he was stranded outside and he called his Gt branch to move some money into his card, it was done immediately and he was able to use his card far away where he was. Also, recently I was doing some hotel reservations for a client in a UK hotel and I paid successfully through the card on the net here in Nigeria. the card is denominated in USD but can be used to pay in other currency all that would be done is conversion  at USD rate. I have applied for mine. It should be out in the next 10days.

You are right. One of my own passed all the test, they refused to call her. She was advised to call I think the Personel Manager. They called her finally and told her that she passed or something but that they are not employing her. She almost cried.

Bros i wish you well in terms of patronage. But as for the 1 week incorporation, I am Lawyer and I know what it entails to register a company at the CAC ABUJA. I do not know how feasible it is.
I agree with you that it sounds somehow impossible. However, you should bear in mind one day incorporation which is legally approved by the CAC itself at a fixed rate. So it means you have to get your documents ready within 4 working days and on the fifth day you will take it to CAC for one day incorporation. You know this can only be done for LLC and Business name. No matter how smart you are IT and LTD/GTE will span minimum of 3-4 months because of the process involved. You know we do not register IT and LTD/GTE so much in Naija. So you can register your Business name or LLC in 5 working days. Cheers.

BusinessRe: How Can I Get A Patent Right To A Product In Nigeria And Maybe Africa by omogidi234(m): 3:06pm On Nov 13, 2007
Gbosh:
Hi omogidi234,

Clearly understood what your were talking about concerning PATENT/TRADE MARK.

i want to know when importing a product, what can I do to be the sole marketer or distributors here in Nigeria.

Please, advice.
Pretty straight forward, the first thing you do is you get a power of attorney from the manufacturer empowering you to sell the product here in Nigeria. If the product is non- food & drug you will register the product as a trade mark and move on. However, if it is in the class of food & drug after the TM registration you know the next point would be (NAFDAC).

olofinjeje are you sure you are not a lawyer? Anyway lotex you have heard the truth from competent hands and mouth all I can add to it as a lawyer is the practical and action aspect. if you don't mind you can mail me at kleandenation@yahoo.ca and we take it up from there.

pardon my slip of tongue!
InvestmentRe: md by omogidi234(m): 2:41pm On Nov 12, 2007
olofinjeje:
The solution given was almost accurate-
1. If your father died and left a Will you must go and obtain probate(that is done in the High Court) and you can only obtain probate if you are named as an Executor to your father's Estate.
Once you obtain the probate documents this proves that your father is dead and that you or who ever is named as Executor/s can actually access and deal in your late father's property and assets which includes all bank accounts and shareholdings.
You can then follow the steps laid out by WALCOLM.

2.if your father died without a Will -you must obtain Letters of Administration also from the High Court-this will be given if there are no disputes or anyone challenging your authority to deal with your father's Estate.

Please note that death duties may be payable on the valuation of the Estate(all your father's assets) and this duty(amount) must be paid before the courts will grant you the Probate or issue the Letters of Administration.

Without one of these documents no broker or Bank will deal with you. Those shares will just remain as is ,and all dividends will be unclaimed.

My advice is to get a good and competent Lawyer to assist you.

An aside to all investors in shares and properties when you are buying them do so in a company name-so that when ever anything happens in the futurethere will be no death duties payable as companies exist in perpetuity(they never die)
olofinjeje are you sure you are not a lawyer? Anyway lotex you have heard the truth from competent hands and mouth all I can add to it as a lawyer the practical and action. if you don't mind you can mail me at kleandenation@yahoo.ca and we take it up from there.
BusinessRe: IS this company Legitimate? by omogidi234(m): 2:30pm On Nov 12, 2007
Hi Guys, i am lawyer and I must say i appreciate the angle at which dafidixone is looking at this. Please if any Nigerian company want to transact business with you, i don't think it is harmful to ask for its registration No, so that you can instruct people or lawyers to conduct a search on the company at the CAC ABUJA, its directors, shareholders, registered address e.t.c these are the factors any foreigner should consider before going into business with any Nigerian company. Please note that a company's name does not suggest it is fake or scam until you have all those details.

Hi, sure you know the difference between patent and trade mark. Please note that you will only be given patent for what has not been manufactured/invented before. So if what you want patent for is new entirely that is good. Please mail me and we will talk more: kleandenation@yahoo.ca

BusinessRe: Trademark Registration in Nigeria by omogidi234(m): 7:55pm On Nov 02, 2007
igbonla, I must commend you for your reply. However, my view on this was/is not to rubbish yours/others. I am not interested in the pay but I believe if we are sharing ideas we should share ones that will not put pple into problem in the future. please Igbonla take the pain and go to FHC and you see cases on TM which all border on the issue I raised earlier. I practice law and I see these things replayed everyday. That is why I said "My advice: walk up to a Lawfirm where they practice T.M and give them Instructions. You get a good job done for you" Igbonla I do not intend any harm. I just need people to get the true positions of things.
BusinessRe: Urgent-i Need Business Ideas With 500k by omogidi234(m): 8:06pm On Nov 01, 2007
Topsy, I was going to begin to download some stuff on feasibility study until I saw what lucyc wrote. I salute her. I have had cause to post one or too things on different threads today and my position has been that you have to be different. You don't do things becoz everybody is doing it. Now, making money is a function of solving people's problem. You can make more money when you solve these problems in an usual way. Not this one everybody is doing pure water and you rush to it, bottled water and you rush into it. My advice, you can spend 100k out of the 500k to do research and feasibilty study. Find out what people need in not only your area but the whole of Ogun State and noboby has been able to provide answers to. I will give you an example. Somebody recently did a feasibility study and found out that 75% of generating sets made all over the world end in Nigeria. (Now he went round all the 6 abi na 5 continents- You may not have to do that) and entered into the Biz got cheaper and better Generating sets- Your guess is as good as mine. He is making big pay. Please do your home work well.

TravelRe: 2 Options - US And UK. Which One Should I Choose? Very Urgent! by omogidi234(m): 6:08pm On Nov 01, 2007
If you already have a student visa for U.K Congrats. I will advice you to opt for U.K. I know for sure In Scotland you have 2 years to work legally after your studies. The rest of the U.K put in motion something similar to that in July 2007 but it is just 1 year. However, you know the difference, you can evade tax In the U.S until you are caught while you cannot evade tax in the U.K. You know the implication of paying tax from the little you have. I am sure you will know that is the reason why our people in the U.S can spend pay "anyhow" so to say unlike the ones in the U.K. The choice is yours.
BusinessRe: Trademark Registration in Nigeria by omogidi234(m): 5:16pm On Nov 01, 2007
Ekobase/Seun, you have heard the truth of this matter from Aproko with due respect to all other opinions expressed on this issue. But please permit me to add that TM sometimes span a year, this talk of 15k or 20k will not fly. The folks telling you these will just file the name, collect your money and move on. This stage could be likened to 20%. There is a handy example involving Virgin Soft drinks and one other Virgin bla bla at the Federal High Court Lagos Annex (I will not say more coz the case is still on going). Now what happened was that the other guy did know that Richard Brandson's brands already has something similar to HIS fully "registered". I guess he contacted somebody who probably did name search, file the name collected his money and moved on. From my own view, Richard Brandson's brands will win the case. I am taking pain to say all these so that you will not run into similar error. My advice: walk up to a Lawfirm where they practice T.M and give them Instructions. You get a good job done for you. Otherwise I can do it for you but expensive is an understatement. Aproko where are you?
