Originalsly:That front grill seems very very fragile. I guess they didn't make these cars for long term use. I don't see these cars in the next 10 years looking okay with that front bumper. |
tintingz:Better for her to acknowledge. |
tintingz:You seem not to get the point and at this instance I would back off. Folk tales are not copyrighted materials same way no one holds the copyright to the Bible or Holy Quran. I guess the intricacies of what constitutes a copyright goes over you and I would agree it's a bit complex. So I would cut you some slack for not getting it. Listening to Simi's song alone shows it's highlife and who else was known for his famous highlife style of music? Conincidence? Of all the names in the whole world to use as Protagonist. Simi and her Manager couldn't find a replacement? Conincidence? The breaking beats at the start and the subtle percussion in Uwaifor's Joromi and the it's computer imitation in Simi's own is just conincidence I guess. I don't need to do a back and forth with you. You just talk around things without giving clear cut evidences to support your claims. Copyright do not cover phrases? You seem to not know what you are saying. Copyrights do cover expressions. Here's another quote. I hope it doesn't fly over your head as usual. a perfect example is the song "Money for Nothing" by Dire Straits. there's a throwaway line in the background that goes "I want my...I want my...I want my MTV..." which is sung by Sting, who's not in the band at all, but was lead singer and songwriter of another band called The Police. The reason is that the melody is identical to a part of a Police song called "Don't Stand So Close To Me", but with the title lyrics instead: "don't stand so...don't stand so...don't stand so close to me" to avoid a lawsuit before the song even came out, Dire Straits got permission from the Police and their publisher to include it, and Sting ended up singing the part, too. really random." so are expressions/phrases covered by copyright or not? The Robin thickk Blurred lines case that you guys like to quote wasn't even because of just lyrics but because of just that the groove was similar to that of Marvin Gaye's Got to give it up. Intellectual properties aren't things you kid with. I am not a fan of some aspects of copyright laws but definitely they are there to protect people. This would be my last response. |
tintingz:Let me explain better. It's not only about the lyrics alone. Listen to the sounds, the rhythm, the flow of words, the use of instruments and its immitations . That's what copyright laws are after. If I tell 10 people to write a story about a mango tree. There would be 10 different ideas and storylines. You can't copyright "story about a mango tree" but you can copyright the individual 10 different ideas that came up. If someone imitates whether knowingly or unknowingly any of such because he read one of the stories previously or has heard of it before. He has infirgened on the copyright of the person. Let me give you a quote so you understand better. "Copyright law is against copying; if you come up with the exact same melody by yourself, then it's fine, as long as you can PROVE that.Good luck proving such. To prevent people from abusing this, there's a rule that if you've had access to (heard, for example) a previous creation (in this case, the song) and your work is similar to that previous creation, then it will be presumed that you did copy and you have to prove you didn't (not easy). You can also be found to have "subconsciously copied". Balancing this is the rule that if you didn't intentionally copy, you won't be required to pay damages, only enjoined (ordered by way of injunction) to stop infringing the original copyright (so you can't sell your song etc.)" You wouldn't want to be in her shoes in court. Drop those N200 earpiece they sell on the streets and use a better earpiece to listen to the songs before making judgement. Wish we had sound engineers on nairaland. just a few hours work analysing both sounds and giving an informed verdict. |
bukatyne:They can't because it even sounds strange and illogical to any sane person. You have a so called friend and from 7am in the morning till 7pm in the evening you couldn't find a place for you guys to visit as big as Lagos is and all you can do is teleport yourself in the middle of the night for a sleepover? Abeg help me ask her . To discuss what? It can be excusable and understandable if they went clubbing, it was late in the night and she couldn't get a cab back home and had to sleep over but this her own scenario doesn't even seem sensible at all. She makes the case of "actual" rape victims watered down by taking the discussions from the real life experience of people in such terrible situations to such folly she posted online. |
tintingz:You can use a song without permission 50 years after the death of the Artist. That's according to US copyright laws. I don't know what the Nigeria law states Copyright don't cover things such as names but it does cover ideas which can be very broad in copyright parlance, beats, tunes , rhythm and everything in between. And I can tell you....Rhythm is everything and that's where Simi's would be found. The way you pronounce a word can be copyrighted and even if you used another word in it's stead that is similar and pronounced the same way. You have infringed on the copyright of the original owner. For example If I shouted in my song "break break break it" then whitsle and you did the same but with the words "Drake Drake Drake it" then whitsle. It can be classified as infringing on my copyright because it is an idea of mine. I can give you tons of examples of this where it was rules as an infirgenent and the artist were required to pay royalties or drop the music from the market and stop all promotional sales. So just imagine that and now consider what Simi did. Even funny is cases where Artists under a label sold their copyrights to a particular music to a record label and after sometime they leave the label. The copyright law states they can never ever make a song that sounds like anything they ever made when the copyright to such is held by someone else. There are may examples where Artists had to buy back their copyrights to be able to even sing their own songs. Sunny Ade was in such a mess sometime back. I can assure you if Uwaifor should pursue this and his lawyers do their homework he would win it 100%. A careful listening of both would show you Simi's own did infact sounded exactly like his at some point. Do a karaoke of both and start from there. You don't even need to listen to the lyrics to find such. |
sKeetz:you that you have found your destiny. What did you buy for your mum at 17? Kindly please tell me what legitimate biz a 17 year old does that he could afford such. |
Penthomi:As much I would want to address her concerns. I have never seen such naivety and stupidity combined in one person. So she has a boyfriend and what actually did she tell him before agreeing to spend the night with the guy? That she is going to sleep over in her cousin's house or what? I guess. Someone you barely knew. Someone your so called boyfriend doesn't know . You just knew him from a friend of a friend. As much as you want to avoid victim blaming, this case turns every common sense discussion upside down. What if he were to be a ritualist and had kidnapped her? What if her friends actually pawned her in for the slaughter?. People just don't for once just think things through. No one even knew the address of the guy . He just booked an Uber for her and like her sil..ly self hoped into the car in the middle of the night. Like why for heaven's sake ladies can't just even think about their personal safety for once. Once most hear basic things like ice cream, fast food and night outing. All commonsense jump out of their head. Like are you guys that fuc.king hungry or what's so special about things not more than 5k that you could treat yourself to? She should call her mum and narrate her ordeal to her and hear her mum sing her praise to high heavens. Mtshweee I still can't believe an adult above 18 actually did what she did. |
You see Nigerians. most are liars and dubious. Because something didn't go your way does not mean it wasn't fair. Most don't have conscience and we keep on blaming the politicians and our leaders as if the politicians weren't previously ordinary Nigerians. If you sack all government officials today and replace them with Nigerians you would still get the same result or even worse. Just take a look at the guy up there saying someone didn't fill a form but was preselected. Haba...how come? Oya provide the details of the so called person and he has gone deaf and dumb. And our Oga software engineer Donkalio. Can you kindly please tell us with facts how it has been hijacked? You just don't make stu.pid allegations without proof. You provide irrefutable proof. That's how to critique. That's how to you put government on their toes and not just crying wolf about everything and anything. If you don't have concrete evidence as regards malpractice please kindly keep your mouth shut lest you sound like a derelict. |
[sup][/sup] deepwater:And how did Dangote force a pasta maker out the market? Till today, Indomie , Honeywell have almost total market share of the pasta and noodles market. So what are you saying sef? You guys just follow stereotypes and run with it. Till today, Portland is still growing strong, same with Unicem and even AshakaCem. So where's all these monopolies we hear about come from? |
@sterope, Pocohantas, zoaroster and Ibkayee There are only 12 notes. There are 12 one note melodies, 144 2 note melodies, 1,728 3 note melodies, up to about 61 billion 10 note melodies. This might seem like a lot but of essence not all note will sync. It's a big headache for copyright enforcers. Analysing both songs shows that they have different lyrics and instrumentals but a step down they had the same keys at some point. Where Simi's was dropping the keys was almost as same as that of Victor Uwaifor's. If you take a keen look as an example. At the start of Simi's Joromi there was a breaking beat and it can be likened to to the breaking beats of Uwaifor's Joromi. A lot of examples can be cited and I am on mobile so there's not much to type. Simi's case is not even helped that much because the song had the same name for the Protagonist and sounded like old school highlife music of yesteryears. Naturally people would say she got her inspiration from Uwaifor's song. Uwaifor's Joromi used percussion and guitar mostly while Simi's is a mix of computer tunes and some beats. One can't off the cuff disregard the old man's claim. If we had any sound engineer to help analyse it then we can conclusively say it did or didn't infringe on his copyright but until then I wouldn't pass a judgement. |
Guestlander:I see you are far well read and abreast about things and not coloured by silly ethnic inclinations. You should ignore those things. Arguing with them is akin to arguing with agberos at Oshodi isale. You can't beat them at their mudslinging game. If anyone would come here and still shout GEJ and say he was a definition of democracy then that should have told you that person has an IQ less than my shoe size. |
@op. you need to write to PENCOM. If they didn't remit to a PFA for you then they didn't also remit for others. Wish we had class action lawsuits in Nigeria. Na to gather other employees and sue the company into bankruptcy. maybe when many compamnies go under for failure to remit pension funds, others would sit up. People abuse laws because our laws are very lax. Reading through the PENCOM act shows that not remitting funds only attract a fine of around N250, 000 which is paltry and they were just making moves to make it an economic crime not to remit funds to a PFA. This country just weak me.. |
whitering:If I am ever going to live in Yaba. I would probably just not use a car or anything flamboyant. The robbery of things there is extremely high. Anytime I see someone come to report a case of lost laptop at work , I can bet it happened in Yaba 90% of all times. |
Sterope:You should help us ask them |
Why do people just post things without a background? That road was fully constructed in 2013 and well paved with drainage from Ilasa up to Ojuelegba. The community around there damaged that road with illicit dumping of refuse in the drainages. Just visit the area after a small rain and witness the flooding. As much as government is to be blamed at least 90% of the blame should be shared by those communities. You should ask why that portion and the one in front of the Hausa community is the only bad portion in a 6km stretch of road. |
Ain't this one of the roads the clueless one was parading round that he has constructed just 2 years back and was using it as a campaign theme. |
chiochio1: abbeyfel: ogtavia:Those debating about her use of seat belts should take a step back and watch the accident scene. There's blood on the pavement which was far from the point of impact but not on the dashboard of the car, airbag or seats. If she wore her seat belt and seeing that the airbag deployed she would have walked out of that accident with injuries but not death all things being equal. The pictures shows she was thrown out of the car and hit her head against the coming trailer or pavement. It's simple physics. Run and throw yourself against a wall and imagine what kind of damage you would do; and that's you running at prolly 0.5mph. Now imagine someone being thrown at speeds of like 50mph against an opposing force. It would take a miracle for her to survive such. The seat belt restrains you and keeps you in a static position and minimizes or removes impact. There's no debating that fact. |
zinizta:Can you please stop writing in all caps? Thank you |
zinizta:At what point do the Nigerian Army stop behaving like animals? This is 2017. I am sure these people didn't confront them and most likely were just randomly picked. Even if they were confronting them, this is inhumane even serial killers are never to be tortured let alone people seeking a country of their own whether peacefully or violently. |
This is not only worse but despicable. The Nigerian army has no right to pass on judgement to anyone no matter the circumstances. For anyone to support this shows they truly do not understand the importance of justice and what it entails. I am very sure that there is someone amidst them who is innocent of "whatever alledge" crime they might have committed and notwithstanding all deserve fair justice in an open court not this. |
This is so wrong... |
Sterope:It's certain the money was moved using mobile money. Most mobile money transfers require the last 4 digits of your BVN or ATM card which is public knowledge and goes against the rules guiding use of Passcodes or PINs. I am an IT person and it's a sacred rule that passwords or whatever should never be written or printed down somewhere. Funny enough your BVN or last 4 digits is freely accessible by not only bank employees but the average Joe on the street. The banks are very culpable. Most of these services are automatically added to your account without customers consents. Take for example the GTB mobile USSD. All accounts were auto linked without prior authorization of the customers. I am stating this as a fact. Is the bank not liable if such medium were used to swindle one of it's customers when they had no idea such existed in the first place? Have you seen the receipts of a POS transaction?. For fu..cks sake. Most banks use the last 4 digits of your ATM to confirm transactions and funny enough all pos receipts that both the customers and the seller get have the first 6 and last 4 digits clearly printed. If you want pictorial evidence I would give it to you. All someone needs to do is get my phone and use duplicate copies of receipts and they would be transferring money out of my account. I never for once agreed to such setup. So tell me , are these banks liable and on top of that very silly or not? Is that not reckless and jeopardizing the security of your customers? Is that not willful negligence? The customers were not in on it and definitely did not sign off on such so the banks should come explain how a medium I didn't sign up for was used to take money out of my account. You can't defend this so please don't even try. As stated I wish we had a very viable justice system. I wouldn't need to work another minute of my life by suing such reckless behaviour. |
Sterope:They aren't liable on paper but the bank is a fully liable if this was tabled in a law court. You look at the environment you work in and prevent most of these things by not allowing such access to people in such categories. For goodness sake what does a pensioner who can't make use of gadgets need mobile and Internet banking for? They can't read nor write and the bank goes on sweeping application of new products without the consent of their customers. All these useless banks with their dumb thinking. A bank enabled a mobile platform on my account that I never asked for and I had to go all the way to block it. Just imagine how easy it is to prey on such old people when all they have as security is just a useless OTP code and last 4 digits of theit atm card . Something they have no idea of and how it can be used against them. Someone who can't read nor write. I wish we had class action lawsuits in Nigeria. Would be fun to sue all these dum.b people and corporations we have in the country who can't see an inch above their noses. We ask why old people have apathy to new technologies. This is one of it. Tell me why another pensioner would put their money in the bank when they can be screwed over by lapse in security by the banks. So what's the essence of BVN registration when you can't trace funds transfer from one account to the other? Truly.....this country is a joke. |
So much ignorance on this thread. The I or V in an engine is about orientation, V indicates the cylinders in an engine are oriented in a "V" fashion and "I" means they are an inline fashion. Also most i4 engines in production now have much more power than v6 engines that were produced like 3 to 5 years back and still yet they are 3 to 4 times more fuel efficient. I see someone shouting up and down about noise or whatever. I truly don't get what that is all about. |
If they arrest this lady again for spreading falsehood one would pity her. She's just jobless and trying to be relevant. That picture has been online as far back as 2014 and it is not the daughter of any federal lawmaker neither are they lesbians or whatever.
|
When Fashola penned a 20billion extra for contingency plans in his budget, kids and your fellow uncultured and unlearned lawbreakers around here were running their mouth needlessly saying he was corrupt and they were out to steal the money. I guess you lots didn't know those funds is what is used to fix unforeseen damages and emergency repairs like this. I hope a senator from Benue can release money from his pocket to fix this. When you fail to plan...using "God would not allow it happen to us" mantra. You already failed. |
Thecassanova:Klopp is the motivating factor and style of play of the team. And those players fit in perfectly to the system and would definitely not sit on the bench. So who won't go? Between a very friendly boss with a sweet environment which allows you to grow and make mistakes and an hostile environment . Which would you choose? |
EgusiShankly:Empty barrels make the loudest noise na. Liverpool is a team of class. You don't need to be shouting like agberos to know a team is superior. ![]() |
adaweezy:Yeah sponsored posts. You would do well to keep quiet and kindly exit the thread. Take a drive to Osborne - Ilubirin heading towards the 3rd Mainland and experience tyre ripping holes and gaps. That has been there for over a year now and nothing done about it. Or take Marina towards the State house onwards Bonny Camp. A whole section of that road has completely failed and the other part riddled with potholes. Or is it the underpass before the UBA house leading to Marina? Or kindly take Ebutte Meta towards Herbert Macaulay Way Yaba and come back and respond to this post. Or go to VI, Bar Beach bus stop to be precise and see how the road there has turned to a one way drive because of large craters on the road. If such could be happening in VI now imagine what would happen on the mainland. I purposely don't even drive through Apongbon at night even when it is the shortest route home because of the bad roads leading to severe traffic there giving pick pockets and thieves a filled day there. The Road Maintenance team are the worst i have seen in years. Not even an effort to fix major roads. Lagos was celebrating 50 years of excellence painting and erecting useless monuments when basic infrastructure like roads were going extremely bad. i have had to change my back bushing and upper arms twice in the last 6 months due to bad roads. A colleague has had to buy 2 new tyres in the last one week both tearing apart from the sides due to bad roads. I clearly think the Governor seems to be sleeping or LSWPC is headed by a dumb and deaf career politician that knows nothing about road maintenance. |
