TravelRe: General UK Visa Enquiries - Part 5 by Taal17: 11:54am On Sep 12, 2023

Hello

Thanks to all the input from so many people on this thread. I have a bit of a weird or not so weird one, I am currently in the UK with my wife and kids on a student visa, I want to invite my mum for a visit but a bit confused.

Background I came on this year on a student visa with 2 kids, I work part time as I am schooling, and my wife works full-time. I also have a brother who is schooling in the UK with graduation in November.
We want our mum to come for his graduation and then also visit her grandkids.

The issue we are having is who should apply? My brother that is graduating, he can get a letter of invitation from the school but his income won't be sufficient to cover her expenses. Or should I apply since my wife and I have combined good income and her grandkids are here.
On another note I was thinking if we should combine the reasons for her visit, provide graduate invitation from school and then my wife and I who would sponsor the trip due to our combined income, should also do a letter inviting her to visit grandkids. Would that be an overkill?

My mum is currently a pensioner but wouldn't be able to sponsor the trip on her own.
I would like the wise counsel of you all. Thank you @Ashirioluwa @giselle237
The form will ask if she has relatives in the UK, let her add your brother as well.

Then she'll add under reasons for the trip visiting you her grandkids and your brothers graduation.

You'd still be the primary person providing invitation

Good morning NLS, pls is there anyone here that can guide me through the UK visa process pls ? I’m asking this respectfully ! I do not want to go through an agent. . I’ll appreciate anyone who’s willing to help.
The point of not using an agent is to do it yourself.
The guidance you want is in what you study and read here. No shortcuts.
Study and read this thread. From the beginning page 1 to current page. It will only cost you time not money

Please I need clarification about this Ethiopian airline free luggage rule.
Can't I use a duffel bag to carry my things? Must it be a box?
The duffel bag is lighter and contains more things and on their website I'm seeing that luggages must be a box 55x23x44 or else it won't be checked in or loaded in the aircraft or something.
Not sure this matters just make sure it does not exceed the measurements.

It's still human beings that load luggage so bulk items are a health risk to staff

@Taal17
Thanks. I've had my GC for a few years but trying to decide what to do next cos I don't see the point if it doesn't look like I'll be moving to the US in the next couple of years. I was gonna move to be with my parents and siblings however I met my husband and got married couple of years ago and he's not wanting to move to the US in the next 3 years.
Things can change and I think you may wanna speak to him about the benefits cos if you lose it and he suddenly sees the need then
E.g makes it easier to get long term visas to other countries
Access to business opportunities in the US
Medical care - for example we dont have covid vaccines right now in Nigeria so if you needed it you simply just hop on a plane
Get a job and earn in USD - inflation in Nigeria is kinda cray and with the possibility of remote work you have a number of options to earn in another currency as a way to sure up your naira

Let me just drop this here as well.... I dont think if the roles were reversed your husband would consider giving it up and I doubt you as his wife would let him do the same

It’s actually possible to pay for your school fees before resumption. I don’t know about other schools but I know about mine. I paid for a year already even though the school refused at first but as soon as I registered for my fall 2021 courses and my bill was raised automatically, I was able to pay for a whole year.
Wow, that's a problem because how do you get your money back if something does go as expected.

Good Afternoon
Sorry to bother
There is an urgent issue my friend is facing.
She just got admission into the national university San Diego and she was told yesterday by the institution that she has to defer her admission till next year fall because of covid-19 precautions and she has to decide before the end of tomorrow unless they will cancel her I-20.
She received the admission early in March and has planned everything, she paid fees, booked plane tickets, gotten accommodations and now she has to cancel everything.
She has tried to speak with the school but for the most part she has gotten no reply and the ones that do reply reiterate the same thing.
Is there anything that she can do about this situation?
She cant force the school to open physically, what fees dd she pay? i doubt it was school fees because I dont think school will let her pay whens school ahsnt resumed
Does she even have her visa?

About her children they can go as children born out of wedlock. Is allowed
The children will be interviewed as well, especially if they are not young. Will the children also be able to keep up the lie whilst be interviewed.

She will have to swear under oath at the interview to tell the truth .

If the husband is okay with not seeing his kids till how many years in the future no wahala.

Her choice, the family lives with the consequences either way.

Lee1303:
No but she doesn’t want to wait longer here. Please what are the risk involved?
Depends on whether she wants to keep up the lie, which is hard to do. If she is discovered it will be misrepresentation and that's cancellation.
Even if she keeps up the lie, will her children do the same?

If she does get the visa , her husband can not go, she will have to get there, wait and all of a sudden come back to nigeria (remarry him) then go back and file for him and somehow prove that she just happened to have met him after visas were approved. If that goes through it could take about 2-3 years for him to join.

So that's her choice - it's risky.

That isn't true, the CBP officer has the power to decide if your primary residence is outside the US and revoke your GC.
Nope, CBP can start proceedings but the decision on revoking is only by Immigration Judge after findings have been made so they CBP cant revoke your GC

If you've got your GC but not ready to migrate for a few years how can one keep it valid?
The visa they put in your passport after approval is not the GC. You must enter the US before the expiry date on that visa. Once you arrive in the US it is then stamped. After that you wait for the actual GC which is a card , it will be posted to your address that you indicated.

Maintaining your LPR status has its own regulations, you are not expected to stay extended periods outside the US since it is to be your private residence. Some POE may quiz you, however it is only a judge that can cancel it.
Typically no more than 6months out of the US , if you want to spend up to a year outside the US then there's another application you can make so that you can do that officially and get a SB1 (returning resident visa)

Please has anyone immigrated with derivatives? I am FB1 and not married but have 5 children. Will I be asked to do DNA for my children? At the interview
You will get to add your children to your case, but the DNA thing I think that depends on if they request for it.

Some people are current before DQed, many are DQed before being current. What's your take?
The embassy will only schedule interviews for those that are DQ and that their PD is current.

The dates for the interviews is what only consular staff can answer cos who knows what rhyme or reason they use to set the dates or whether they use first come first served or if they prioritise some categories over others.

Booking doesn't mean honoring it. When you get the interview letter on July 12 with the interview date as 21 July, you will understand. Again, it's valid for twelve months.
You need your interview letter to do the booking, the crowd at the medical facility there is nothing you can do about it.

Medical is valid for 6 months that is clear on the embassy site. Your visa is validity is ends on that validity, if the 6 months expires before your interview date you will pay for another one FULL PRICE.
It means if you did Medical on April 2021, interview in Aug and approval in Sept 15th (maybe due to supplementary documents) then your visa validity will be Oct. Then if you cant buy ticket or move out on time its a big problem.

Whoever got DQed as around October 2019 and beyond and have not got any interview letter should start thinking of refilling DS260 and keep, book medicals, do police report again (it must have been two years now), AOS (recent documents) and get your birth certificates handy for uploading. If you forgo your given date because you can't meet up, embassy has you at their mercy on rescheduling. Please try to be proactive and forestall this. Again, if anyone is aging out, try to recalculate the age with CSPA.
I would strongly advise against booking your medicals please, medicals are valid for 6 months from the date you conducted it and it is that validity that would be on your passport. If your interview is finally scheduled after that 6 months you will need to do another medical.

Then the DS 260 - I dont think you can refill this form until the consulate send you that mail to go ahead and fill another form. You wont be able to access the DS-260 to update it.

great forum guys, please I need some clarifications.
My pd is Oct 2012 for F1 initially. I got my approval 2019 submitted DS-260, civil documents and paid fees to USCIS.
I did indicate on the application that I got married in 2017. What actually happens now that my status has changed?

I submitted supporting documents in Aug 2019 and the only message I got on my profile was in the lines of...Due to the numerical limitations on immigrant visa issuance prescribed by law, this petition is not eligible for further processing at this time...
Is this some sort of denial due to my status change? My foreign state of chargeability is South Africa
It just means you are now F3, so you need to check where the status of F3 is on the visa bulletin, I doubt your pd date is current right now. Your category changed so everything changed

However I had been current for probably 9months before I got DQ'd

Do I have to write them to switch me to F1 or should I just be in this category
I think your Mum is supposed to inform them NVC or USCIS, but really it doesnt matter since NVC has already asked to submit documents.

I expect for both F1 and F2B your pd has passed so you are on the queue to be interviewed as soon as you are documentarily qualified. DQ can only happen when you have submitted your documents and it has been accepted.

Nothing you can do right now apart from submitting your docs and get DQ, then wait for interview

Irepchrist
Have you gotten interview date yet?

I'm surprised that taal17 was acting surprised..
But it seems I'm the only one on the visa class..

Though my mum is a USC now..
That is because it is F2B in the visa bulletin and it is F2B under family category on the trave.state website, so I am very unaware of the same visa category being called F24

But if that is what you have on your profile then i suppose it can be the same...

If your mum is USC then you become F1

Visa approved
June 8th
Time: dunno couldn't go in with a digital watch.

Doubt my transcript would be of any help because my interview was incredibly brief.

I was asked only 3 questions:-
1. Why are you going to the US?
2. Where are you going?
3. What do you do?

I noticed that people who were interviewed before me were asked more questions than I was.

The man barely looked at me. He spent more time typing away on his computer.

My appointment was for 9am but my big head didn't make it to the consulate till like 9:30.

There was no queue at the entrace of the screening hall probably because everyone but me came early enough. The security guards asked for bribe before letting me in. Typical.

There weren't a lot of people there so I didn't have to wait long before proceeding to the interview hall.

There were 3 VOs and for some reason they took their time with the applicants and asked quite a bit of qquestions. They weren't even rushing.

I saw a few F1 applicants young and not so young get denied. Some parents who went with their kids got denied as well after tensioning them with more questions.

NOTE: those who agents for their entire application process should be careful. Filling a ds-160 form isn't hard, take your time and do it yourself.

Two people who used agents were sent back at the screening hall. One of them had a confirmation printout that said june 8th 2021 but when they checked their records it was for March 2022.

Try to at least log into your profile to see the thing yourself. Print your confirmation yourself instead of showing up with some document some shady guy gave you.
I had a similar interview for mine, it was short. VO barely looked at me just looking at the computer.
Then I have had visa interview denied that was that short, I have had approvals that I had a longer interview where the VO asked a good number of questions too.

I truly believe its the DS 160 that's the determinant of how the interview will go.
