You are welcome buddy. SPV’s are legal and it’s regularly used by investors all the time. My point in all this is, 1) The project was not a scam. It was meant to benefit Nigeria 2) We are in this situation due to complacency and incompetence by Nigerians in government at all levels. 3) The P&ID guys decided to cash out on our incompetence. I used the JV agreements IOC’s have with the Nigerian government which they never get to fulfill their own part. The IOC’s decided to come up with the PSC concept since the FG will never do their own part, making us lose millions daily.
The project was a scam! Scams have some aura of legitimacy to make it believable.
I read the link and it's very laughable. There are so many inconsistencies in the report, that it is beyond belief, a sane judge can order Nigeria to pay $1.

Let me just quote the most absurd one;
In 2006 , former President Olusegun Obasanjo conceived the idea of building gas facilities that would supply gas to power stations across the country to improve power supply as part of his National Economic Empowerment and Development Strategy, NEED.
The power stations were never built as $16 billion was allegedly spent on the power sector with nothing to show.

P & ID, an engineering firm registered in a tax haven in British Virgin Island BVI, boasting a 30-year experience in managing engineering projects in Nigeria formally approached the Federal government with a proposal on August 7, 2008, submitted to the late President Umaru Yar’adua to build a proposed gas plant in Calabar.
Meaning it was P&ID approached the FG and not that the FG went to Ireland to call them.

Only dubious companies with lots to hid go to tax havens to register.

So the company's record of performance is only in Nigeria?

On 21 July 2006 , P &ID (Nigeria) Ltd was registered to serve as its operating company within the country, which was an affiliate to P & ID.
I thought they said they had 30 year experience in Nigeria? We're they operating illegally before 2006? So they registered immediately Obasanjo conceived the idea of building gas facilities that would supply gas to power stations across the country in 2006?

In the build-up to submitting the proposal, P & ID limited had carried out an extensive two-year scale of feasibility studies from 2006, involving the purchase of licenses for the technology required to operate the gas stripping plant, propylene plant, the production of detailed engineering drawings and its internal project management costs.
The firms include CB & I Lummus Technology Group in New Jersey, KRAN Developments in Johannesburg and ABB Limited in the UK which it claimed to have spent $29 million for their services during the feasibility stage.
Who send them work? Licences for what exactly? How can you say you spent $29 million when you have no contract with the government or anybody?

In October 2008, P & ID made its presentation at the Ministry of Petroleum Resources with the Minister of State(Gas), Emmanuel Odusina at the instruction of the former President, late Umaru Yar’ Adua.
They did feasibility studies in 2006 but made presentation to the Ministry of Petroleum Resources in 2008, I know understand o.

I don tire. The whole contract is a joke. You guys should read the whole report yourself and have some laugh.

Ex-President Goodluck Jonathan failed to complete the 2014 National Conference Report of which he is to be blamed.

Current President Muhammadu Buhari should take the blame for the poor management of the P & ID contracts as he failed to act timely to address the case.
Who told you the 2014 national conference was not complete? It was completed and it's reports submitted, it was never implemented.

Jonathan (or any president for that matter) did not have the powers to implement the recommendations of any constitutional conference, that power lies with the national assembly. Jonathan conference and all other conferences were political, it was only meant to stir up political emotions. Every wonder why most governments organise constitutional conferences towards the end their tenure? It's usually an attempt to buy more time.

Why can't the national assembly debate the recommendations of all the numerous conferences we have had down the years, with a view to incorporating the recommendations into our constitution?

Against the contractual counter-party, courts don’t care if the Board approved the contract.

The company (through the Board or shareholder(s)) could successfully sue such CEO/CFO...

After series of meetings, it was decided the project would be located in Cross river, and Addax petroleum agreed to supply the gas to P&ID for processing

Based on Addax agreeing to supply the gas, the FG signed the 20 year agreement with P&ID
Nigeria signed a 20yr agreement based on the promise of Addax to supply gas to P&ID? does or did Addax have pipelines and infrastructure to supply the required quality of gas to the agreed site in Cross Rivers? What was the contract agreement with Addax? We need to hear from Addax.

Addax still failed to meet up, I think at this time GEJ was in power and Diezani was asked to ensure Addax complies
How do you expect Addax to meet up with its expectations? You think building gas pipelines and infrastructure is an abracadabra? You just wave your magic wand and poofs gas starts flowing into P&IDs facilities (which was non existent as of that time anyway)

After a whole lof delays and frustrations, P&ID wrote to the FG that they were no longer interested and subsequently took the case to the international court of arbitration who decided that UK courts would be the location to hear the case
It was even P&ID that said they were no more interested. If the company was registered in Nigeria, why not take the FG to Nigerian courts?

This was where they came to agree to pay a compensation of $850m
If GEJ, agreed to pay $850m, why didn't he pay before he left office. He could have diverted the money he borrowed for paying salaries to pay for the money he negotiated for.

Then comes in the PMB and his team, no one paid any attention to the ruling due to non-nomination of a substantial minister to take charge
Even though I do not support the failure of Buhari to not appoint an oil minister, I would never have supported him paying a dime of that money. He came in when crude fell to $30 and Nigeria entered a recession, where did you expect him to get $850m from. If he paid, and the economy finally crashed as some people are wishing, they would be ecstatic saying Buhari crash and economy Jonathan built.

And the rest is history

The whole episode is a good example of the incompetency of the people in authority. From top to bottom. the project was meant to guarantee power to the gas plants but at the end of the day, the Nigerian factor came to play!!
How would the project have guaranteed power? What was the installed capacity at that time? What was the transmission capacity as of 2010? Where was the pipelines all over the Niger delta conveying the gas first to P&ID's processing plant, and then the pipelines conveying the gas to the power stations?

If d court has said 9bn dollars should be paid, I am pretty sure that will be done unless an agreement is reached btw both parties. We forget that even d bulk of our currency and international passport are printed overseas.
You that knows about international trade, how does this qualify as international trade?

The citizens of this country are being swindled everyday by their own government. Few days before the election, we watched two bullion vans drive into the house of a prominent politician in this country. Lots of people hailed him and the rest went in the dark to get sorted. The EFCC till date did not release a statement on the issue.

If you live near bourdillon road, you will know that bullion van going to Tinubu's residence is not a strange affair, but a regular one. During the last salah, I saw two bullion vans enter the compound. Billion vans entering houses of high net worth individuals is a common occurance in Nigeria, no big deal. But of course, during elections PDP and its allies makes it a political issue.

I find it funny and quite nauseating that the administration that purportedly signed the agreement and would not honour it for 4years could be absolved of ANY blames. Jonathan was in government when the agreement was sealed, was substantive president till 2015 and couldn't honour the agreement; all he found worthy to do was negotiate a whopping $850mil for something Nigeria stood to gain nothing from. And you expect an incoming administration of Buhari with the economic challenges that greeted his early days in office when almost every penny had been frittered away by the Jonathan regime, to busy himself settling that staggering amount of debt. I think the rightful thing to do at the moment is to find out was truly transpired while also renegotiating terms with the coy. Heads must role!

I am against renegotiating anything. The whole project is useless to Nigeria. Build gas pipelines to where? If Nigeria need to build and process gas infrastructure, we know how to go about it. We do not lack gas to power our megre power stations at the moment. The best Buhari can do is compensate the company for any physical investment they have done in Nigeria after an independent appraisal. We don't have money to dash any foreigners with their Nigerian collaborators.

You are assuming there was a project in the first place. There was not project, just signed paper committing Nigeria to pay billions of dollars to an unknown Irish company. A project must have project design, evaluation, costing, budgeting, implementation and management. This so called project had non. Even the attorney general said he was not aware of the contract, how can Nigeria enter into an agreement with anybody without the knowledge of the attorney general?

This particular case is a contract gone soured. The New manGer is saying he wasn't involved when that contract was signed. hence it's none of his business.
So tell us, what exactly is his business? Just be wasting our money traveling abroad? Only 90%, I thought it was 900% completed. So Amaechi was just dashing Chinese Railway Corporation billions of dollars for the same project to be completed.

There was no contract. It was only a scam by traitors to share our national treasury with foreigners. The so called contract did not pass through any contract process. There was no attempt by any party to execute a contract. How can you agree to pay for a 20 year profit for a business that had not even started? How can you calculate profit, when business has not stated? No equipment costs, no production costs, no running costs, no product even.

It's not Buhari's responsibility, it is the responsibility of the people that signed and negotiated the contract to find where they would find $9 billion to pay and unknown company.

Nigeria and Nigerians had won several court cases over the decades both in Nigerian and international courts ordering shell to pay several billions of dollars for oil spillages and unethical practices in Nigeria. The British government should deduct the fine from shells internation accounts and give us the rest.

We have successively always voted in governments who are reactive rather than proactive. This government for some reason just added the 'blame it on the previous administration' to that regular playbook.
What scares me is that the way things work in Nigeria successive governments will continue to use this passing the blame tactics and the citizenry will continue to bicker amongst ourselves based on some sentimental, tribal or religious attachment.
I fear for our future.
No government in this world and I mean no government will pay that money. Countries pull out of agreements between countries, the worst will be breaking of diplomatic relations, not to talk of agreement between government officials ( not government ) and foreign individuals.

You people and referendum, it's like an obsession. Did the people and government of Greenland ask for a referendum? You want to impose a referendum on Greenland, the way IPOB want to impose a referendum on the whole of the Niger delta?

As Danish citizens, Greenlanders have all the rights and privileges of Danish citizens. Do you know the social security privileges and benefits of a Danish citizens? The US doesn't even come close.

1. Gerrymandering does not affect presidential or statewide elections because the whole state votes for the candidates standing in a statewide elections. Every voter in the state from every county and congressional district votes and the votes are counted together. Gerrymandering affects house of reps and state Congress elections because only a portion of the state votes for the candidate so if you want your candidate to keep winning all you need to do is redraw the map of the specific district to contain the parts where more of your supporters reside and your party will have the upper hand in elections there. Both parties do this in the states they control so it's not an issue of one party or the other.

2. Mitch McConnell's election is a statewide election so gerrymandering has no effects on it as you claimed

3. I defended Trump's attempt to buy Greenland because he has absolutely every right to aspire for that if he wishes, he is not breaking any law or any precedent by doing that and I think it was a smart move on his part.
At no point did I say I didn't defend Trump's right to buy Greenland like you lied in your post again. What I said I didn't defend was his diplomatic spat with the danish PM over the Greenland issue, I didn't defend it because I felt the spat was unnecessary

4. Stop fooling yourself, No Democrat candidate can beat Mitch McConnell in Kentucky.
When I say you are too deep into Trump's ass you complain. How can you support Trump's offer to buy a land and people not for sale? I am sure you will defends trump if he proposes to buy your whole family with wife, mother and sisters included.

When the US bought those territories you love to use as examples, it was practically barren land, with little or no human habitation, being administered by a country far away. If it was populated, I am sure the people would have fought for independence from the US. The marshal Islands was captured from Japan during WW2, and used for their nuclear tests. They fought and gained independence after being under the US for 40 years.

Greenland has a population of about 57,000 people, running their own government and economy. What happens to these people after Trump buys Greenland? Will the people become us citizens or they will be asked to vacate their ancestral lands for the US to occupy?

In all these grammar, I did not see what was sold or what was bought? No government will give away millions or dollars just because a piece of paper was signed. If so then government officials can just sell the country with a piece of paper and arbitration panel I London or Japan will just ratify it.
If this was done with a reasonable country, it will be seen as a declaration of war.

Libel kwa? When we say IPOB - both leaders and followers are stark illiterates, they start getting insultive. ICJ was not set up for libel, but for genocide and crimes against humanity. There is a complicated process before the ICJ can even begin to try alleged war crimes and, besides the ICJ can only only bare it's fangs against African leaders or learders from third world countries, the US and the other world's powers don't even take the ICJ serious. Al-Basir of Sudan had been declared wanted by the ICJ over a decade ago, he is still walking free ( well free in his country's prison).

Kanu is not hiding but he disappeared for over a year, so much so that even his people did not know his whereabouts. Kanu is not hiding, but he cannot step foot in Nigeria.
Kanu only has mouth. He only talks his sheepish followers into endangering their lives, so he can scream genocide to the ICJ, US, UN, UK, ISRAEL, ETC.

Monday Ubani, former Second Vice- President of the Nigerian Bar Association (NBA) on Wednesday said Japan cannot stop members of the Indigenous People of Biafra (IPOB) from demonstrating against President Muhammadu Buhari because the constitution of Japan protects freedom of speech and expression.

He said protests against leaders who are attending foreign meetings and summits is a normal practice all over the world.
IPOB are not demonstrating against Buhari as UBA Ubani claims, they are in Japan to arrest Buhari (sorry Jubril El Sudani ) and forcefully obtain his DNA.
Now, how will Barrister Ubani call that a normal practice.

While urging President Buhari to address the grievances of the IPOB members, Ubani said while the President may not do that in Japan where he is currently participating in the 7th Tokyo International Conference, he can do that immediately he returns to Nigeria so that IPOB members who felt they have been treated badly can have a sense of belonging in the country.

“When people have agitations, it could be a group or certain persons against their leaders, they usually manifest such grievances by protests and sometimes they can even follow their leaders to wherever they go in the world to express their grievance. We saw it whenever all these international leaders gather for any event, those who are protesting on climate change always come to the venue to protest and express their grievances”.
What are the grievances that IPOB want Buhari to address? That he should submit his DNA to kanu to proof he is not dead?
or he should order a referendum, which is beyond his constitutional powers as president? It is only the national assembly that can include referendum in our constitution.

Or that he should abdicate his office as president because of hatred by Igbos for his sins during the civil war?

What exactly are ipob grievances?

“I think IPOB members are saying there are certain things that the President has done back home against IPOB members and they are there in Japan to express those grievances. I have never seen leaders trying to engage those protesters on the international fora to discuss issues”.
What has the president done to IPOB that was not done to other groups challenging the authority of the president ? Kanu and his group were becoming lawless and causing all sort of nuisance. They were issuing threats to security men, hausas, Yorubas, and even promised to bring the presidents head on a plate. The were forming, Biafran Secret Service within a sovereign Nigeria. No government in the world will tolerate these nonsense.

IPOB main goal is just to cause anarchy and chaos in nigeria, just because they hate the current president.

If you could remove your head from Trump's ass for a second, you will see that these two territories were offered for sale by their owners themselves. Russia was in a war in crimea, and did not want the extra burden of defending a large "unprofitable" land far away from the homeland with very little population.

Same issue with Virgin Islands, the island had become increasingly unprofitable and expensive to govern from Denmark, so they were looking for anyone to sell too. Mind you this was in the 18th and early 19th century, where travel and communication with a territory far away from the homeland was difficult.
Now, what is the basis of Trump offering the buy a territory in the 21st century, that is already autonomous, with a defined government. That is an insult to the people and government of that territory. Did they tell you or Trump that they are broke or unable to defend the territory?

It's fairly easy to confirm the identity of so called Nigerians on execution list in Saudi Arabia, just a Facebook or Google search should reveal their profile, unless they are using fake names. Most of the FBI arrested criminals are found either on Facebook or Twitter.
