I have seen multiple threads and social commentary about xenophobia within the past 48 hours. The response is very vocal and strong and has even force some Nigerian politicians to react. This is in fact very commendable.

Where were you when Nigerians were beings slaughtered in Libya?

Where was your protest when Northerners kill and burn down stores of fellow Nigerians. This is a historical record that even the devil cannot deny. Northerners in particular have done far much worse than South African hoodlums can ever dream of.

Where was your protest when UNARMED civilians are slaughtered in cold blood for protests which happen in other countries everyday.

Where is your protest when army and police kill those who refuse to bribe them?

Where is your protest for the restructuring of NIgeria failed political and economic system?

There are just too many things I can think of that Nigerians kept quiet and acted like it is normal.

I mean are Nigerians just naturally born to be hypocrites?
I don't understand the sense of this post. People protest issues they choose to protest. You cannot question or impose your will on what another person decide to protest against. If you are pained or concerned about a particular issue, nothing stops you from protesting that issue.
What stopped you from protesting Nigerians being slaughtered in Libya, Fulani herdsmen, for restructuring, and all those things you listed. Are you expecting others to protest on your behalf, while you sit in your parlour watching bigbrother naija?

People choose to protest the xenophobic attacks in South Africa, because it is their perogative and they don't owe you any apology.

The ability to waive the lawsuit is at the discretion of the country where the lawsuit is happening, and I do not know of any treaty covering that.

The only treaty here is the one that allows a country to get sued.

Quitting this treaty will change nothing for Nigeria at this point.

It could only stop future lawsuits from happening but will have no effect on the ones that have already happened.

It is not always easy to quit treaties either. Poor countries are often coerced to sign treaties in exchange for foreign aid etc.

It won't be easy for Nigeria to quit the treaty, not to talk of smaller nations that are already under the armpit of the west.

Any country that quits the treaty will lose a huge chunk of its foreign investments.

Nigeria could survive if that happens but smaller countries might not.
Bullshit. No amount of treaty quiting will stop oil companies from leaving Nigeria. Portfolio investment - yes, but oil investments no.
Besides outside portfolio investments and oil how many western companies invest in the Nigerian economy. This is why I feel we should start removing out focus on the west and start exploring the east - China, Japan and South Korea. Western investment can be like a poison chalice.

South African companies do not have assets in Nigeria. That's the South African business model, they rent everything. MTN, multichoice and others. I am yet to understand shoprite ownership structure, but I am sure the physical structure is built by Nigerians investors.
MTN has no physical structure or asset in Nigeria, their headquarters at Golden Gate plaza is rented. Even cars they don't buy, they rent. All other offices are franchised. Same with multichoice. If you burn any DSTV office, you are burning a Nigerian business/ office.
How many South Africans are in Nigeria. I have only met 2 in my entire life. I am sure most people shouting "deal with their citizens " have never met a South African in Nigeria. Close to a million Nigeria lives in South Africa. Last estimate put it at 800,000. So in a tit for tat, we are greatly disadvantaged.

This is the kinds of disgrace we get not only from South Africans, but also from India, Arabian countries and even Ghana, when we mess up our country and feel we can run elsewhere.

Good and well researched write up. Kudos to the journalist that penned this, but I disagree with some of his conclusions;

1.
Why didn’t Buhari just pay?

Buhari is infamous for four terrible things:

1. Running a country into a recession within a short period.
2. Leaving the country for long periods of time.
3. Flouting agreements and court orders.
4. Delaying in appointing ministers.
All four got him into the current mess with P&ID.
Buhari not paying and those four things you listed do not relate. Buhari did not pay basically because of two reasons;
1. Nigeria did not have the money as there was a crash in the oil market (remember Jonathan was also borrowing anyhow to pay salaries and buy equipments to fight Boko Haram in his last few months).
2. Buhari did not believe in paying anything in the first place.

Of your four points, the one I disagree with was Buhari running this country into recession both times. In 1983, the economy was already in shambles, as the Shagari government had looted the country dry. We had no foreign currency to import basic commodities, that was why Buhari adopted rightly or wrongly the essential commodity policy.

Ditto for 2015, within less than a year, crude went from $100 to $30. What did you expect Buhari to do? Many other countries that depends on crude for foreign earnings also went into recession at that time.

I also disagree with this verdict;
Verdict: The fact remains that the deal was probably signed.

Whoever signed for Nigeria is not P&ID’s business. That’s Nigeria’s headache.

However, it might help if Nigeria can prove that someone forged a signature or something. Bonus points if P&ID was involved in the sham.

Winner: P&ID if it was signed. Nigeria if it was not.
Whoever signed the contract should be P&ID's headache. A person that signs a contract must have authority to sign the contract, or the contract is invalid. In any organization, there are those with the authority of signing a contract or signing a check. If a person not authorised to sign a check signs it and you present it in a bank, the bank will not pay you, even it is an authentic check from the organisation. Are you insinuating that a cleaner or gateman of NNPC can sign the contract and it is valid? It is the responsibility of P&ID to confirm that those signing the contract has the authority to sign such.
If the signature of the authorising officials is forged, that is another issue altogether.

3.
Even this does not make sense;
Buhari’s government: The 2010 contract with P&ID was void because the Federal Ministry of Petroleum Resources does not manufacture gas or possess oil or gas reserves.

P&ID: The gas was to be procured from Exxon Mobil and Addax petroleum’s OML 67 and 123, and not from the ministry.

The Truth: The Federal Ministry of Petroleum Resources was sourcing the gas from Exxon Mobil and Addax petroleum.

Verdict: This is a no-case argument. The Nigerian government should have never brought it up.

Winner: P&ID.
It true the that Federal Ministry of Petroleum Resources does not manufacture gas or possess oil or gas reserves, so they have to procure gas from exxon mobil and Addax. Now, was the Federal Ministry of Petroleum Resources expected to pay for the gas? Who was to build the pipelines, OML 123 is located offshore approximately 60 km south Calabar in the Gulf of Guinea. Who would bear the enormous cost of the pipelines. What of the pipelines to the power stations to be scattered all over the region? Did P&ID expect all these to be built instantly or within a couple of years. Will there not be budgetary provision for the pipelines if it was to be built by the FG?


Buhari is jittery now because the company and a US court is threatening to seize our US assets and reserves, which to me is bullying. I think developing nations should stop buying assets in western nations and holding our reserves in their banks. This episode has shown just how vulnerable we are.

Going through the comments I am really not surprised at the thought processes of most posters. Rather than focus on the glaring fact that a government staff who should be working for the public he is employed to serve is appearing for the president in his capacity as a private individual, some have turned it to a partisan issue while others are predicting that the EFCC will suddenly start investigating her husband afresh. These ones are just morbidly excited at the prospect of lynching any PDP member, past or present.

The latter is not out of place though because all public institutions have now become the private property of Buhari just because he is president! We have a long way to go...

What the hell are you saying? I think you are confused. Being incapacitated means transfer of power should be effected as soon as possible. To avoid any power vacuum.

That charade with Jonathan by the cabal was illegal. With proven incapacitation should bring about immediate transfer of power. A contract on that scale can never ever be approved by a government official legally without the signature of those 3 officials in situations of incapacitation. In fact that contract was very fraudulent and illegal if Yar’Adua was incapacitated and it was not signed by Jonathan. Even before power transfer it can be successfully argued that Jonathan had the authority to sign on behalf of the Nigerian government in the case where the President couldn’t and, they will win the case in court. Certainly never an NNPC official.
You are arguing here and there and everywhere. Jonathan could not act as president without the process of declaring the president incapacitated being followed. The constitution describes how a President can be declared incapacitated on health grounds, and this process was not followed. Believe me you are not more knowledgeable than Jonathan and his advisers.
That the contract was fraudulent is not in doubt. A contract of such magnitude could not have been signed without the knowledge of the attorney general, NNPC, the due process office, finance ministry and the FEC. Jonathan could not have done much, because information on the state of the president was hidden from him and Nigerians in general. Where I blame him is that he should have revoked the contract immediately he was sworn in as acting President less than one month after the contract was allegedly signed, he should never have agreed to enter arbitration on a contract he knew nothing about.

That is the authority of the federal government should each level be incapacitated. Petroleum minister cannot sign without the signature of one of these officials. If the president is incapacitated, approval must go to VP and then Senate President if both President and VP are incapacitated
No such thing in the Nigerian constitution. If the president is incapacited, the vice president becomes the acting President and if both President and vice president becomes incapacited, the senate president becomes the acting President for a maximum of 3 months, before another election is held to elect a new president. Presidential duties cannot be transferred without the transfer of power either in acting or substantive capacity.

No serious company that does business will sign a contract with a government official who does not have the authority to sign that contract. Whether the authority is perceived or implied because it can be voided by another government tomorrow. The government official does not have any authority to sign. Authority goes from President to Vice President to Senate President, if both President and VP are incapacitated.

Companies must also take responsibility to avoid being culpable and avoid losses. Especially in a country like Nigeria where government officials are fraudulent. Only the company will lose because government official will disappear into thin air.
The vice president or senate president has no role in crude oil contracts. It is only the president and the petroleum minister that can approve crude oil sales contract.

Baru even came out to state that he and the board of NNPC are not answerable to Kachikwu as Minister of State for Petroleum but only to the President and substantive minister who Buhari doubles as.

Baru will claim he secured that contract with Buhari's signature and approval even though Buhari had since notified the Senate officially that he had handed over the presidency to Osinbanjo and from there proceeded on medical leave for close to 3 mths at which time he remained reclusive to the world.

Now the question to ask is why has the president, EFCC, Malami refused to state who signed the P&ID contract on behalf of NNPC ?

They first accused Jonathan but when they saw that this won't fly, the laid it on Yar'adua.

Now just see as these idiot rats are even exonerating Lukman as "very honest". What defines honesty? Is honesty enough to stop investigating someone under whose administration a fraud was committed? This is the same lame lies Buhari has used alongside claiming ignorance of corruption under his watch as Minister of Petroleum during Obasanjo's military rule and PTF chairman under Abacha.

EFCC should release the contract document for us to see who signed on behalf of the NNPC.

They won't dare reveal this because the same shaddy character was and still is part of the recycled Yar'adua cabal that currently holds power in the presidency and his name is Mohammed Barkindo!

The alleged NNPC contract was oil lifting contracts and not structural or supply contracts. NNPC nominates and approves companies that lifts (or sells) Nigerias crude oil to foreign buyers. There are two market in the crude oil market - spot market and contract. Only the president and the oil minister that can approve the sale of nigerias oil to foreigners, there is no role for FEC or even the vice president in crude oil contract sales.

God bless you. Granted that Nigeria is cursed with evil leaders, but I still don't understand why many people are still relying on a useless national grid for electricity. I use solar system both at home and in the office. I enjoy 24/7 electricity absolutely free!! How can one live in the equator where the sun shines non stop and still pay for electricity?? Even if Nigeria would start producing enough electricity to go round, I still will never connect to national grid again.
I also spend next to nothing on water and rent is relatively cheap too. I mean paying 350k for a three bedroom flat with 3 toilets/bathroom, all tiled and neat. However, Nigeria is still a nightmare in many other areas of life such as terrible roads, insecurity and lack of maintenance on public amenities.
So, in a nutshell, both sides of the divide has its pros and cons but while a few Nigerians can even afford to make this argument, a vast majority of others can't. Therefore, to each his own.
God bless you. Nigerians are Olympic champions when it comes to complaining and making excuses. I always wonder why people - even the rich and wealthy don't go so solar instead of always complaining of NEPA. People are crying that NEPA is giving them estimated billing of up to 30,000 monthly with less that an average of less than 6 hours a day, this is in addition to fuel and generator maintenance costs. Some people are owing their DISCOs up to N500,000. A good solar installation is about N1,000,000, or at least N1,500,000.

If Africa was better you wouldn’t be running from the continent. Learn to be gracious for the opportunity to live in another country. At the very least don’t try to bash.

You are displaying the typical American mindset of arrogance in ignorance, and thinking every other person should live by your values and standards.

Every culture has their values and standards, and not everyone want sees excessive thirst for wealth (or should I say material ) acquisition as a measure of being better off. In fact it is this adoption of American values that have destroyed the very fabric of our African society.

Americans disparage other countries more than any other country on earth. American visitors to other countries never respect the host country's traditions, values and cultures, but always sought to impose their own.

I can't never live in the US, even if given a free green card. I got a 4 year visa in the mid 80s, and went on a tour of major US cities, to even see if I could settle there. I left after 3 weeks and never went back. After 3 days, I ran away from New York. The 24hr noise and crowd was too much for me to bear. I even took a tour to the Bronx then, and it was an eyesore.
I travelled through Los Angeles, Orlando and a brief stop over in miami. The only place I really enjoyed was Santa Monica, it was peaceful and lovely.

Yes, we have problems, very huge problems, but that doesn't mean other countries don't grapple with their own issues too. The greatest problem of the US is the ever widening gap between the rich and the poor (apart from gun violence). Yes, the US has a huge poverty problem, and they have to accept and deal with it, instead of hiding it. It is what is giving rise to all the social tensions in America, it is what gave rise to Trump and his Base.

The problem with nigeria basically is that we are using our own hands to tear up the country. The politicians are bankrupting the country by stealing our money (with foreign collaborators) and stashing it in foreign banks, the youth are destroying the image of the country by involving in various crimes abroad, and the press and social media is destroying the last shred of reputation by washing our dirty linen for the whole world to see, even exaggerating it. Others hide theirs.

What most Nigerian at home don't know is that there is significant poverty is the US, even though it is no where near what we have in Nigeria. The bottom line is poverty is no respecter of race or country. One needs to imbibe an attitude of hard work and never accepting failure to make it anywhere.

Read this report of poverty in the US;

On Sept. 12, the U.S. Census Bureau released national poverty data for 2017.

The headline was that 39.7 million people were poor in 2017. This works out to 12.3 percent of the population or 1 in 8 Americans. The good news is that the U.S. poverty rate has fallen since 2010, when it hit 15.1 percent, and is now where it was before the Great Recession.

The bad news is that poverty still exceeds the 11.3 percent rate of 2000 and far too many people are poor in a country that is so rich. Another bit of bad news is that things look even worse if we use what many scholars like myself believe is a better poverty measure.

Your first salary was £2700 after tax, so how much was your net. You must have been earning close to £3,800 net per month. I even forgot to ask, was that weekly or monthly? Wages are paid weekly in UK.
A £500 a month (which is £125 a week) house in UK is a shitty house, or was it in some remote village outside London?

Tax can kill you in UK. They can tax you out of existence. Then the rent or is it mortgage is out of this world. Transportation nko? That one na ogbonge. The only cheep thing is UK is food.

With a population of close to 2 million consumers, you are asking what people are doing to become millionaires? In Lagos with a population of over 20 million, you can become a millionaire selling only kuli kuli. I know many igbo guys that came to Lagos with night bus with only a nylon bag containing their whole belongings, and in ten years become millionaires selling car parts, electricals, building materials, etc.

Not every one enjoys a better standard than us. That only applies to the highly or moderate educated Americans. Poor and non college educated Americans have poor standard of living. Many Nigerians who go and are unable to work with their certificates have really tough lives. I know some people (graduates from Nigeria ) that do 2 to 3 jobs just to survive. One told me, 4 of them rented a self contain apartment, because the monthly rent for a self contains is as expensive as a yearly rent in a 3 bedroom apartment in a suburb in Lagos.
