Let everyone ask their parents and grandparents how far about the Nigeria they lived in. That's the only way you'll be sure this nation is making no head way. If you haven't travelled, you won't have any reason to question your sense of 'being' and intelligence in Nigeria. When you live in a zoo for too long, you'll only know how to survive like an animal (e.g DSS vs NCS). There are very few sane people left in this country, that alone should scare you. |
Like oil and water, the politicians have made sure the masses never mix. Sadly, to their own hurt. The only reason I don't downplay the potency of spells. Many have been zombified. ubest1:Finally, someone with brain. In LP's reply to INEC's final address, they did say INEC has not demonstrated that the top documents (Ec38As) actually exist. If they do, why then did they certify iREV, oblivious of the fact that by law, certified documents means copies of originals. Otherwise, how then did they declare a winner with blurred or blank results? People don't know that 'noncompliance' is LP's best case. INEC was hoping they'll harp on the claim that they won. In all of LP's reply I have never seen a stronger argument. They played it well. Only discerning minds know how to work a system that's rigged against them (INEC). |

Lotanna2:The substance of both cases are different, INEC certified 2 different things for the same purpose. I wont dwell on the issue of certification since the respondents didn't dispute them. In fact, Wole (SAN) even attributed the blur to printing, photocopying error etc. Meaning they acknowledge it's from INEC, and what was used to declare BAT (the response is online). In any case, no matter how we interprete it, there is one incontrovertible fact, INEC didn't follow their prescribed guidelines (which are like laws on their own) and admitted to it by calling it 'glitch'. Unless, the court discountenance that fact, I don't see how the election will not be cancelled. |

The answer is, INEC couldn't certify them, instead they blurred the uploaded copies to hide the irregularities, and they didn't dispute them as same as originals (see attached). There are laws even backing it. I don't think you appreciate what it means for a petioner to prove a case against a complicit umpire. INEC was trying to protect themselves and BAT, but they failed in both. By certifying 18k blurred results, how then did they declare BAT? 18K PUs is substantial. That's why I said what the petitioners could rely on is the NON COMPLIANCE issue (PO did well in that area). Someday in the future, our laws should not make INEC a judge in it's own case.

Lol. Let me try and understand your arguments for once. It is true that neither PO nor AA could prove they won the highest lawful votes cast. I read both responses thoroughly. But guess what? The 1st respondents couldn't prove that BAT did same. Why? the umpire (INEC) simply conducted elections and flew the evidence to Mars (figurative). They couldn't defend what they declared (e.g. EC38A for rivers). PO was able to prove however, that he won in Rivers and Benue (making a total of 14 states). Now, the thrust of both petitions is NON-COMPLIANCE with electoral law. It has also been established that INEC guidelines are not rhetoric, they're backed by the law with which it operates. Possible verdict: Rerun (unless the court feels such departure from the law is not substantial). The FCT issue will set a precedent, no need arguing about that. Lotanna2:You should have also read AA's reply about the 'burden of proof'. With what results did INEC declare BAT winner, if they certified the iREV results? Were there any other results with them? If yes, why did they not use them in their defence? In simple terms, INEC had no defence. But they may have won on one ground: a possible rerun since they dont have hard copy evidence of all valid votes cast at PUs. Whether BAT will participate is an issue no one can preempt. I have read both, try and do same. If for anything, it won't make you argue blindly. |

How are we now going to know now that you've voted a disaster? Aren't we back to where we have always been? (The what ifs and maybes). Leaders are as human as the rest of us.
