As a Nigerian electricity consumer, the law is clear regarding some of your basic rights to electricity consumption in the country. Knowledge of these basic rights will equip you in preventing their violations, and where violated, will assist you in identifying the type of remedy to seek to that effect.

So, what are these rights?

Before proceeding to listing these rights, it is expedient to mention that the NERC[2], which is the statutory agency of the Federal Government of Nigeria that regulates and manages electricity supply and consumption in the country, is empowered by the Electric Power Sector Reform (EPSR) Act[3], to ensure an efficiently managed electricity supply industry that meets the yearnings of Nigerians for stable, adequate and safe electricity supply.

Incidentally, the Act further mandates the Commission to ensure that electricity Operators recover costs on prudent investment and provide quality service to customers.

It now behoves on us to ascertain whether or not these duties saddled upon the agency are being met.

Let’s consider some of these rights.

All new electricity connections must be done strictly based on metering before connection. That is, no new customer should be connected by a DisCo[4] without a meter first being installed at the premise:

As a potential prospective consumer of electricity, it is your right to have a meter installed in your premises before any electricity connection should be made. You have the right to request for an installation of meter for free. Where there is no such installation and electricity is connected to the subject matter premises, any bill brought in respect thereto will be considered as illegal. Please note that this right does not extend to people who, by illegal or unauthorized means, got their connection.

All customers have a right to electricity supply in a safe and reliable manner:

As an electricity consumer, it is your right to enjoy a stable and safe electricity supply. By stable manner, it means that you are to enjoy uninterrupted power supply, and where there is a failure, outage or unavoidable interruption in that regard, the defaulting DisCo is expected to responsibly notify its customers (the consumers) ahead and tender due apologies for its shortcoming.

By safe manner, it simply states that you should not lose any of your property or electronics or anyone as a result of faulty or dangerous electricity or power supply or interruptions. Where for instance, your TV blows up as a result of power surge during supply or interruption, such a consumer is entitled to recover damages against the DisCo, for example, Ikeja Electric.

This right also does not cover consumers who procured their connections illegally or through unauthorized means.

All customers have a right to a properly installed and functional meter:

Every consumer is entitled to have a well functional meter which must accurately read the quantum of electricity consumed by the individual consumer. Where there is no such functional meter, the DisCo in charge is prohibited from accessing consumption based on estimation except if such estimated billing falls within the stipulations of the NERC.

All customers have a right to be properly informed and educated on the electricity service:

It is the consumer’s right to be properly informed and educated on issues relating to electricity services. As was earlier said, it is the right of the consumer to know the reasons for a power outage. It is also the right of the customer to be properly guided on how to avoid electricity risks among other things.

All customers have a right to transparent electricity billing.

No consumer’s billing must be shrouded in secrecy; every consumer has the right to know how his billing came to be. Every billing, whether estimated or metered must be transparent to the consumer otherwise the consumer shall reserve the right to contest such billing.

All Un-metered customers should be issued with electricity bills strictly based on NERC’s estimated billing methodology:

For consumers that do not have meters, your estimated billing must be assessed using the methodology recommended by the NERC on estimated billing.

It is the customer’s right to be notified in writing ahead of disconnection of electricity service by the DisCo serving the customer in line with NERC’s guidelines:

This is one of the most frequently violated rights. This right simply states that where Ikeja Electric or IBDC etc. is coming to disconnect you for whatever reason, the regulation stipulates that you are entitled to a one-month written Notice before such disconnection will be valid and legal. Anything other than that is a breach of your right to which you the right to lodge a formal complaint to the DisCo serving the customer, where the company refuses to act, to NERC via the appropriate channel.

Self help? I repeat that the House is not a rubber stamp body and does not have prosecutorial powers.

Nothing concerns the House with the NJC. The House does not report to the NJC.

The NJC recommended the Judge to the Governor and not to the House.

The governor based on constitutional provisions sent the nominee to the House for confirmation.

The House during screening found her unsuitable, due to inconsistencies in her records. Nothing concerns the House with NJC I repeat.

All they needed to do and which they have done is to send her back to the governor that nominated her that they have found her unsuitable due to the following reasons.

It is the governor's duty to inform the NJC and further recommend her for criminal prosecution.

The NJC has the duty of recommending another judge to the governor based on their own findings if it aligns with that of the House.

How many times do you think the NJC recommended her?

The forgery allegations were baseless, that's why the NJC recommended for CJ more than once.

The house has the power to recommend that the acting CJ be investigated by the appropriate agency they are not a rubber stamp agency waiting for the governor.

The NJC is not a rubber stamp of the house, their findings do not allign.

The House has a right to screen her, and if they find inconsistencies in her records, they also have the right to deny her confirmation based on that.


The House is not a rubber stamp zombie. They have a constitutional role to play in the appointment of a Chief justice in the state.

Wrong again, forgery is a criminal offence not a civil misdemeanor the house can utilize against an appointment. The right thing for the house to do is to report the judge to the NJC.

Their is a proper procedure to be followed, the house is simply resorting to self-help.

I am a Christian i have read criticism from different quarters how the governor denied the confirmation of the woman as substantive Chief judge of state and i believed then but with the 4 points of falsification allegations against her there's no point playing the card of religion sentiment here, her disqualification, denial and humiliation is justify.

If she altered her certificates as claimed, then she has no moral right to be a judge.....if on the other hand, she didn't alter anything or she has not been charged for the alterations, then they had no right stopping her
That is not for the assembly to decide. It's for NJC to decide.

NJC Recommends Compulsory Retirement Of Chief Justice of Nigeria Walter Onnoghen


The National Judicial Commission (NJC) has recommended Walter Onnoghen, Chief Justice of Nigeria (CJN), for compulsory retirement.

After deliberating on the petition filed against him by the Economic and Financial Crimes Commission (EFCC) on Wednesday, members of the NJC unanimously agreed that Onnoghen has lost the moral authority to continue as CJN with the litany of allegations bordering on misconduct.

The NJC — which handles disciplinary issues of judicial officers — sat under the interim leadership of Umaru Abdullahi, former president of the court of appeal, who had to act because Onnoghen was already under suspension.

The council also concluded that Tanko Muhammad did not commit any offence by making himself available to be sworn in as acting CJN without the recommendation of the NJC.

These recommendations have been passed to President Muhammadu Buhari for approval, Soji Oye, the council’s director of information, informed the media on Wednesday, although he did not make the details public.

Buhari suspended Onnoghen on January 25, 2019 following an order made by the CCT. Recall how the Anti-Corruption and Research Based Data Initiative (ARDI), a civil society group, launched the legal move to remove Onnoghen.


The group had filed a petition against him at the Code of Conduct Bureau (CCB) over alleged false declaration of assets.

The CCB is empowered by the constitution to investigate public officers, after which it would forward its findings to the appropriate body for trial if the allegations are confirmed.

It had listed a number of allegations against Onnoghen — notably false declaration of assets.

The Nigerian Communications Commission (NCC) has said that the National Computer Emergency Response Team (CERT) will soon be established, to curb cybercrime.

The Executive Vice Chairman, NCC, Prof. Umar Danbatta made this known during the 87th Edition of the Telecom Consumer Parliament (TCP) on Monday in Lagos.

The theme of the TCP is ”Challenges of Cybercrime: The Role of the Telecoms Service Providers”.

Danbatta said that the provision of CERT was to ensure efficient response to security incidents within the cyberspace.

He said that CERT was essential to monitor and deter threats that could exploit information system vulnerabilities.

According to him, NCC must be in the forefront in ensuring that telecommunications networks are secure enough to ensure Nigerians who want to subscribe to the telecommunication services do so without any fear of their security or privacy being violated.



”CERT is not a team of human beings. It is a team of computers networked together, designed to checkmate incidences of cybersecurity on the telecommunications network.

”The lab that is going to be doing this is already set up, the equipment have been supplied, so what remains is just the configuration.


”The intention is to ensure that telecommunications network is secure, because in addition to all the benefits of the digital revolution, the post-Industrial Revolution we so much talk about, there is a risk dimension that results in the erosion of privacy and security,” he said.

Danbatta said that there was the need for CERT, as the demand for high-speed internet in Nigeria, Africa and across the globe by telecommunications consumers was rapidly growing.

He said that in today’s digital economy, the internet, and by extension broadband, was enabling people to carry out their personal and official activities in a more efficient and effective manner.

The EVC said that there were benefits and risks of the use of cyberspace and both had to be properly managed.

He said that the telecommunications service providers operating in Nigeria would be expected, more than ever before, to strengthen their cyber-risk protection systems and architecture.

According to him, the time has come for organisations and telecommunications service providers alike, to begin to use next-generation authentication as against the hitherto username-password authentication system.

”The International Telecommunication Union (ITU), in a report, says the latter is vulnerable to hacking and all forms of cyber attacks.

”It is our belief that implementing these suggestions and more, will help telecommunications service providers and other Internet-dependent organisations in sustaining their activities in an increasingly-connected world.

”The suggestions will help in containing the menace of cybercrimes on their finances and reputation, on their employees and customers.

”The Mobile Network Operators also need to educate their consumers, regardless of their sizes and scopes of operations, and equip them with tips they need to get protected while using the internet on their networks,” he said.

The Director, Consumer Affairs Bureau, NCC, Mrs Felicia Onwuegbuchulam, said that the TCP provided high-level engagement and interactions with consumers, service provider, the regulator and other stakeholders in the telecommunications industry.

Onwuegbuchulam said that the programme has become a veritable platform for addressing critical industry challenges affecting consumers and other stakeholders in the telecommunications value-chain in Nigeria.

She said that the day’s Telecom Consumer Parliament brought to the front burner the problem of cybercrime, which was bedevilling the industry at the moment.

According to her, it is common knowledge that access to high-speed internet or broadband is getting more pervasive and available to Nigerians to enable them achieve more efficiency in their daily activities.

Digital Economy lawyer Adavize Alao expressed express surprise at the NCC’s attempt at setting up a National Computer Emergency Response Team (CERT). According to the IT lawyer, “The NCC does not have the power to set up a Computer Emergency Response Team as the authority to create one has been delegated by section 41(C) of CyberCrime Act to the Office of the National Security Adviser”.

The lawyer also stated that although Nigeria needs a CERT, the legitimate process must be followed to set up such a highly essential platform.

Meaning from this mans explanation, the other judges only declared Adeleke the winner because the supplementary votes casted didn’t follow the proper electoral law.


In other words, the tribunal has[b] nullify the rescheduled election[/b] and the whole election is still inconclusive because the gap between the leader(Adeleke) and the runner up(Oyetola) is still less than the cancelled votes.


Adeleke should not rejoice at all. His victory is on a thin ice and even an untrained lawyer can overturn then tribunal judgement.

The Tribunal did not say the rescheduled election was faulty but rather it should not have not been held in the first place because INEC did not have the power to cancel the results of polling units in the instant case for rescheduled elections to hold
