Even leaving this aside, the constitution of Nigeria dictates that for someone to be qualified for the seat of president, he/she must be educated up to High sch level.

Tinubu has been confirmed to be educated up to a degree level by the University he attended, this shows him eminently qualified for the office.

What else are we looking for?? He was admitted to the University, has a valid transcript of academic records, what else?

If you attend a school and lose your certificate, the sch can re-issue an alternative document to confirm your study and graduation.

It is only an uneducated idiot that would attend a school, lose his certificate and then go and procure a fake certificate to cover up for the lost one, when you can easily approach the institution to re-issue an alternative confirmation of your degree or whatever.

It is not the existence or not of the certificate that is the most important as regards qualification for the office of the president.

The authenticity or not of the certificate only comes to play as regards perjury.

Unnecessarily waste of time trying to impeach the Deputy Governor instead of concentrating on governance.

Even if INEC gives you theirs, you also need yours before you can allege tampering with the figures therein.

The result sheets are in multiple folds. The parties gets their copies, INEC gets theirs.

You can obtain an order of the court to get the result sheet. But it seems the LP legal team are more interested in the scanned ones on the IREV. And it is confusing to me because it is from the physical result sheet that it was scanned to the IREV. The physical result sheets therefore is more important. If you claim the copy on the IREV is blurred, collect the physical copy from INEC and then subject it to forensic analysis and then bring forward evidence that it has been tampered with. Why are u fixated on the IREV??

I never wanted to do this and this is a very embarrassing situation but I need help from nairaland users.

I have an older brother in his early 40s. Since I was a child till this very moment, this person has been a torn on the flesh of my parents and the family in general.

Sometime in 2020, with the help of my elder sister's husband ( the HR) we were able to find a job for him as a supervisor in a factory and then I and my immediate elder brother (another sibling of mine) contributed money and rented an apartment for him in Lagos and then bought some property to furnish the apartment. To our surprise, my elder brother starting forcing his sexual advances on junior female workers and if any of these girls reject his advances he would start threatening the girls that he would get them fired with the help of the HR (My sister's husband). Forunately my sister's husband found out what was going on and rejected my brother's request for the female workers to be sacked. This started a war between my elder brother and my sister and her husband.

My elder brother eventually left that company (note he wasn't fired he LEFT by himself) and went back to the village. When my father heard this he almost collapsed as he knew the trouble that was coming his way.

Since he returned to the village he started assaulting my parents and I had to send money (about 400,000) back to Nigeria for him to rent a flat just so he could leave my parents alone. My brother stayed in that apartment for 3 months then started fighting his landlord and then told his landlord he couldn't stay for the year and demanded some part of his rent back,he took his rent, returned to the village and picked up from where he left by fighting my father ( a very old man). Its so bad that my father sometimes leaves the house (The house that he built as a family house) and stays outside for hours before returning home.

Please do we have restraining order laws in Nigeria and is there a particular police division in the Nigerian police or legal system that can be used to address an issue such as this?

I'm tired and I'm considering taking a drastic and extremely aggressive decision to resolve this situation once and for all.

Unfortunately, the only soothing words I can offer is that you are not alone in this frustration. I'm also still searching for a solution.

However, you need to find a way to take your parents away from him. God forbid, but if this continues, his troubles will reduce their lifespan and quality of life.

They should find somewhere to be going for a long stretch from time to time. The only negative side of this is that he'll sell the family house on one of those times they are not around, except if you have other strong members of the house living there.

National Identity issues ideally falls under the purview of the Ministry of Interior. Buhari regime pushed it to Communications supposedly to tap into their competency in IT matters. But there is no visible progress.

Like I said before, throwing out the entire petition one by one on flimsy excuses doesnt necessarily make it right. It was exactly as expected cos this is Nigeria where the 'Nigerian Factor' supersedes the rule of law. The 'Nigerian Factor' is the reason its impossible for courts to remove a sitting president, not necessarily cos the president got there legally. The Nigerian factor is the reason Tinubu and the APC camp has been totally unperturbed by all the petitions all these while; they know that they have the system 100% in their grasp.

After all isn't it the same country where a senate president who didnt even contest primaries was declared the rightful senatorial candidate in the election? Make una enjoy una lawless country abeg!
It is a fact that Peter Obi's case is watery. There is no way a Presidential election can be overturned on such a watery case, it is an invitation to anarchy. If tables were turned, same will apply. If it was Peter Obi that won the election and APC is approaching the court to overturn the victory on the basis of not scoring 25% in FCT, Peter Obi's supporters would have cried foul.

The 25% issue in the FCT does not make any logical sense if one looks at it dispassionately. It doesn't make any sense at all. Looking at it logically, it defies any objectivity and even looking at it semantic wise, it is still subjective and can be explained both ways. But you cannot interpret a law only on how the grammar was constructed alone especially where there is controversy. Other points will have to be put into consideration in such a scenario.

I have since moved on when I saw that there was no hard evidence that he won the election. I initially thought he was robbed as well, but weeks after when there was no clear cut evidence that he won and was robbed except for Rivers state, which can still not change the outcome of the entire process, I moved on. I even took my time to check the IREV results of the polling units around me that I wrote down their results down during the election and I confirmed them to be accurate.

He and his team didn't do enough work in the SW and the North, and that was the basic reason he lost the election. He couldn't even muster 25% in 24 states (especially the North and the SW) and his votes in the traditional PDP zones were preyed upon by the PDP.

The greedy Atiku contributed to the loss. It was the turn of the South, he should have stepped down and supported Obi. But greed, arrogance and selfishness made him insist on contesting.

The case was in the US and not in Nigeria. US said their case is a civil case, are you trying to tell them they are wrong??

Kindly note that forfeiture is not conviction. Even if it was a criminal case with conviction, it happened more than 10 years ago and therefore a candidate cannot be disqualified on the basis of that as the limit of disqualification for a criminal conviction according to Nigerian electoral law is 10 years.

Sincerely, there is no legal case in that angle, just a moral one.

And LP can only milk the moral weight of that case before the election.

All the legal examples you gave cited Section 299 of the constitution which happens to be a general provision. But Section 134(2) which mentions "...AND FCT..." is a specific provision specifically guiding presidential elections. I'm not a lawyer but one thing I know for certain is that general provision cannot supersede or override a specific provision.

Even Tinubu's camp knows the 25% provision to be a problem, reason why Tinubu had to warn the PEPT that overturning an election just cos of the FCT 25% clause could plunge the nation to anarchy; what he basically implied there is that "Yes the full requirements were not met, but for the sake of avoiding anarchy, let's overlook this minor issue." It's up to the courts to tell us whether emotions and subtle threats supersede the constitution.

Politicians have rigged the whole system. All electoral disputes have to be settled before an incumbent takes over not after when the same person has hijacked all government institutions and you expect him to just let go like that. The people will never have their way if things continue to be done this way. Since 1999 all electoral disputes have always gone the way of the incumbent. No future in sight for this country.
The court requires sufficient time to seat. And even nature abhors a vacuum.

Except if you want us to be conducting elections 6/12 months to the handover. And this also, can throw up issues. A winner waiting a whooping 6/12 months before taking up the mantle. I do not think any country does that!

Kindly note also, that the court of first instance is not the final arbiter of election disputes. It will still go from there to a higher Court for Appeal.

For Presidential election ,its own Tribunal is the Appeal Court, and then goes from there to the Supreme court (the process to final Supreme court verdict may take up to 9months).
For gubernatorial, the cases starts at the Tribunal, to the Appeal and then finally to the Supreme court (the process may take up to 12months)
For legislators, the cases starts at the Tribunal and ends at the Appeal court. (may take up to 9months).

They know they wont win it. Lawyers usually file a lot of frivolous motions to waste the time of the court. They usually know there's no case in that angle. But still go ahead anyways. Not only will it waste the time of the court, their opponent will also spend time defending the motion.

If the courts start responding with heavy fines, they will stop the practice.
