For spouse route, it can be immediately after

fatima04:
Congratulations, now the race is over. Let's celebrate. Meanwhile I thought one needs to have ILR for 12monhs before you can apply for citizenship
TravelRe: Living In The Uk-life Of An Immigrant (part 2) by Bourne007(m): 10:11pm On Jan 30, 2022
H2B started in 2013. One thing the govt is extremely good at is the regular update of the gov guidance wink

kode12:
This site was made in 2014, and hasn't been updated since then from what I can see. What's been listed also doesn't seem like an exhaustive list, more so, they further made the distinction "Public funds do not include benefits that are based on National Insurance contributions".
The best course of action would be to get the DWP or HMRC to confirm I guess.
TravelRe: Living In The Uk-life Of An Immigrant (part 2) by Bourne007(m): 9:26pm On Jan 30, 2022
If not on this list, then it's not termed as Public funds

https://www.gov.uk/government/publications/public-funds--2/public-funds

kode12:
You know I was having this same conversation with someone the other day. This is a possible trap that will get people in real problems down the line. The same feeling I have towards LISA's as well. The government adding 1K to your funds if you max the LISA is essentially public funds.
I'm still researching the guidance on this, but for anyone without ILR all these schemes with the government offering support could end up being a greek gift
TravelRe: Living In The Uk-life Of An Immigrant (part 2) by Bourne007(m): 9:22pm On Jan 30, 2022
The H2B Scheme is not categorised as Public funds.

Ralphlauren:
They've casually mentioned that they used the government's help to buy scheme which means all they had to do was drop 5% deposit.

I hope they are aware that such schemes are tagged as public funds. Good luck to them if they are not indefinite leave to remain holders as at the time they made the application . . . . Only an idiot with an eye on UK citizenship will claim public funds and think they can get away with it . . . .

Studying on a Tier 2 is allowed as long as it's approved by your employer and doesn't interfere with your job.

ModelLook:
I have a question. If an employer decides to sponsor you to the UK by giving u a COS and Tier 2 Visa.

What now happens when u decide to maybe study a course in the University in UK after some months.

Will you have to switch back to Students Visa where u only work 20hrs per week while u study or u just continue on the Tier 2 Visa where u can work unlimited?

Thank you.

He simply switches visa to dependant visa since wife is sponsored

hustla:
Hello

I have always had one funny scenario in my head

Lets assume that someone (M) comes into the UK on a 2 yr student visa and then luckily gets Sponsorship immediately after school

He then brings his wife into the UK who studies maybe nursing / MPH when she enters. His wife also finishes after 1 yr and gets her own sponsorship

If the husband, due to some issues later loses his job with the sponsorship, is there any way his wife can help?

Aunty.. Show us

Applicants can pay using ppl in the UK with no issues whatsoever whether by card or bank transfer. Waec is not the same thing with funds

LegalTc1:
Madam, what I said is very correct. Many schools have different policies on acceptance of WAEC, payment method, payment by use of proxy etc and he should contact his school to confirm what is applicable to his school.

If tomorrow, he has issues in getting acknowledgement of tuition fee deposit, will u resolve it for himhuh
will the school accept his excuse that someone on Nairaland adviced him to pay through a proxyhuh

Don't push someone to make a mistake that u will be no where to resolve.
TravelRe: Uk Student Visa/tier 4 Pbs - Your Questions Answered Part 6 by Bourne007(m): 6:59pm On Oct 24, 2021
This is so incorrect oga. Anyone can pay regardless of who the person is

LegalTc1:
On issue 3. It is better u pay with your own account or confirm from your school that u are allowed to pay through a proxy(your brother).
Many schools are strict on this and will never record a payment for you if it was made through someone else. Goodluck.

See monitoring spirit grin

You can't just jump to conclusion without knowing the facts. As of 2013, I am pretty sure most on this thread would have advised the same. PSW (if you know what the meant) closed to all applicants on 6 April 2012. After studies and no sponsorship or other means, it's as good as leaving the country. His comment said at the moment , current hostile immigration climate so I don't know what you are all about.

Now that there is PSW, lots of students are trooping in and the immigration rules are relaxed and friendlier esp due to brexit.

As for the NO part which is even completely not related, Can you yourself work 20 hrs per week in naija, (still pay rent and bills) and pay off a debt of N2M not to talk to £10k

The incompetent caseworker just listed the normal immigration rules with no specific reason as to why she's refused. If you have time and can wait up to 28 working days (sometimes longer), go for admin review. It's a straightforward win

If you have the funds and no time, you can reapply

Hi All,

Please what can someone do in this case that first daughter is refused child dependant visa based on the reasons stated on the decision letter but the wife and second daughter visa application was granted on the same application and documents. Birth certificate, consent letter, marriage certificate and family pictures were added to the application. Please kindly advise if we should do administrative review or reapply immediately? Anybody with this similar experience before, what happened at the end?
TravelRe: Uk Student Visa/tier 4 Pbs - Your Questions Answered Part 6 by Bourne007(m): 1:51pm On Oct 19, 2021
You should have seen it through while you were working on a backup application. Like I said, I don't know if section 3C will apply or be extended after winning JR. This might easily come with a ban so don't get your hopes high. Maybe worth requesting his full immigration history ukvi holds about him.

https://www.gov.uk/government/publications/requests-for-personal-data-uk-visas-and-immigration/request-personal-information-held-by-uk-visas-and-immigration. Once he gets the details, he can then address them

Ideally he should have filled IS101 form so it's on record and they would have responded with a letter. Hopefully the return tickets will be enough proof.

TheGreatGod:
Thank you @ Bourne007,

I am glad you said my friend have a realistic chance of success.

Yes the application he made when he has section 3c doesn’t help his case, that is why he withdrew the section 3c. Besides at that time a lot of rules where changed, where the courts were not allowed to look into my friend article 8 case if he hadn’t place this article 8 before the Home Office for consideration. That’s why he have to withdraw the 3c application and put a fresh human right claim.

All the same, during the process of Judicial Review after it was successful and a new decision was made by the Home Office, a removal direction was set against my friend, though not served on him, it was when he challenged the new decision, was when he realized that a removal direction was set against him BUT THE REMOVAL DIRECTION WAS DEFERRED BY THE HOME OFFICE themselves, when they realized he was challenging the new decision and it was never issued to him till he left the UK voluntarily. The deferred removal direction was sent to his legal representative, which forwarded it to him. He has the copy to present.

Thirdly, when he was going out of UK, he was never given a voluntarily departure letter. In fact at the airport they just check his passport by the immigration officer and allow him to go freely. No document was given to my friend and no stamp given on the passport but there a an electronic record with them in which the immigration officer used to allow my friend to go.

In addition, my friend have his return ticket to proof his case that he returned and a stamp on the Nigerian passport he used to return back to Nigeria, which was stamped by the Nigeria Immigration Services.

All the same thank you for this. Really grateful.
TravelRe: Uk Student Visa/tier 4 Pbs - Your Questions Answered Part 6 by Bourne007(m):
@Bolded If he hadn't withdrawn his application, I would have said he stood a good chance. On the same day he withdrew his appeal to make a fresh application, he didn't have no section 3C leave. As of 2014, one had 28 days to make another application despite it's an out of time application.

Even though he won JR (quashing a decision), I don't know if section 3C will apply/be extended. This you will have to double check. You can also read it up
https://assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/953205/3C-3D-leave-v10.0ext.pdf

Voluntarily leaving the country within 2 weeks (max is 28 days) according to the immigration rules may help his case. Just make sure his attaches his IS.101 form, Voluntary departure letter, the appeal numbers etc.

Also, explain this in details with a cover letter in next application as some CWs don't look up ones immigration history.

All the best to your friend

TheGreatGod:
Good day All and @justwise,

Please I am asking this information on behalf of my friend.

My friend enters the UK in 2009 and stay there legally till 2014 (4 years legal stay). On the 17th January 2014, he withdrawn his appeal to the First-tier tribunal in UK and put a first application for leave to remain on the same day-17th January 2014.

The application made on the 17/01/2014 on human right grounds FLR (FP) end him with no leave to remain and he challenged this by a way of Judicial Review to the UK court of appeal.

The UK court of appeal orders my friend to submit a new application to enable the home office to consider his case properly. The second FLR(FP) application was made in February 2016, this was still when my friend have no leave and as ordered by the Court of Appeal.

The second application made in February 2016 FLR(FP)-human right application was refused again and certified as unfounded. This 2nd application was challenged again by my friend by a way of Judicial Review to the Upper Tribunal and won. The Home Office agreed to the withdraw the decision and pay the applicant cost of Judicial Review, which was sealed by the Upper Tribunal.

The Home Office reconsider the decision against and issued a new refusal with certification of the human right claim, which again my friend challenged by a way of Judicial Review to the upper tribunal but this time finally lost the JR.

Note: All these JR till the last one lasted my friend 4 years without leave to remain in the UK. It was when the final JR was refused by the Upper Tribunal after reconsideration was when my friend left the UK VOLUNTARILY ON HIS OWN EXPENSES AND RETURN BACK TO NIGERIA. This was 2 week after the last JR.

Now, my friend is in Nigeria and living in Nigeria for more than 3 years now and he is about to apply for a Skilled Worker Visa.

Please what are his chance of success based on his immigration history coupled with the fact that he overstay when he have no leave, undergoing Judicial Review and in the process a decision was withdrawn and later new decision was removed. My friend is thinking of explaining all his situation in a cover letter before he applied but he is seeking the audience input on his situation before he applied.

Thank you all and @justwise and your input will be highly appreciated. Please assist a friend.

You should be able to by going through CBN site https://www.cbn.gov.ng/supervision/Inst-MF.asp

Valentinoreal9:
Ok, some MFBs can be used. However the ones that are supervised by CBN. I work in one and we used to handle for our clients and they all travelled with no issues. However I will suggest you use a commercial bank. You can’t confirm if the MFB you are using is regulated also, most people use MFBs cos of their cheaper rate. But again high risk. Pls use commercial bank.

Any person with a valid driving licence issued in their country of origin is permitted to drive in the United Kingdom for at least 12 months.

You actually don't need to process International driver's licence to drive in the UK. Just the Naija driving licence is enough.

ijeshaprincess:
You will not be allowed to drive in the UK with your Nigerian Driver's License at all. Hence the need for the International Driver's License. The International Driver's License allows you to drive in the UK for one year but at a higher Insurance rate(e.g if normal rate is 40 pounds, you will pay around 100 pounds).
You will need 2 passport photograph, your personal details, name of country where its to be used and 17k Naira. It may not cost that much in Lagos as I was given this information at the Licensing office of where I am domiciled and was informed that it will be sent to Lagos. And will be ready for collection in 1 week.

Yes. You just need to apply for MN1 Naturalisation for your child

mukatic:
Good morning, all.

Please I need some insight on British Citizenship.

Can a child born in the UK while his/her parents have Tier2 visa (before receiving ILR), claim/become a UK citizen after the parents have stayed for five years and received the ILR?

For instance, the parents had just spent one year in the UK after coming in with a three-year Teir 2 visa and gave birth in the second year of the visa. Can they apply and get citizenship for the child after five years of stay and receiving the ILR?

Thanks.
