What the bill says VERBATIM
Section 7 of the bill, the controversial part which deals with defilement of children, states thus:
‎7. (1) A person who commits an act which causes penetration with a child is guilty of an offence called defilement.
(2) A person who commits an offence of defilement with a child aged eleven years or less shall upon conviction be sentenced to imprisonment for life.
(3) A person who commits an offence of defilement with a child between the age of twelve and fifteen years is liable upon conviction to imprisonment for life.
‎(4) A person who commits an offence of defilement with a child between the age of sixteen and eighteen years is liable upon conviction to imprisonment for life.

From the charges above, you can see that Yinusa clearly committed rape as Ese Oruru was abducted, induced, deceived and coerced all the way.

She NEVER gave consent.

Count 5 clearly shows that she is old enough to give consent but never did.

This goes to buttress my point that the age of consent is 11 and not 18 as things stand currently.

It says clearly in the story that the girl readily admitted going willingly. It was her MOTHER’S CONSENT that was the problem. If she had admitted consenting the guy would have gone free instead of getting 26 years!

It may be just a blog but in this particular instance they seem to know what they are talking about. How do u address the following:

**Are you relying on this judgement to peg the age of consent at 11 or you are relying on what the Constitution says? The child right act pegs the age of consent for sex at 18 years. The recent laws of 2004 and 2015 (whatever those laws says) doesn't invalidate the child rights act. The child rights act of 2003 is still a LAW in this country and that law says the age of consent for sex is 18 years.

Did u read it? It CONTRADICTS u! Clearly refers to her as a minor. Here it is, note the bolded:

“Yunusa was subsequently arrested was arraigned at the Federal High Court Yenagoa in charge No FHC/YNG/17c/2016 on a five-count charge of criminal abduction, illicit sex, sexual exploitation and unlawful carnal knowledge of a minor.“
