premp: Hello, i sent my application for student visa extension Tier 4 on 25th September, 2012. They have taken the money from my bank account, QUESTION: how long will it take for this whole process and ultimately my VISA to arrive? I am also troubled as now i don't have a job from 10th October, and i have no visa because its sent away for extension. Would love to know suggestions about getting part-time job or anything thats possible without VISA at least until it arrives. Thanks.
Did they send you an acknowledgement letter? After the acknowledge letter they will send you another letter after 3wks or up to a month for biometric, you will be given the option to do your biometric either in post office or at the immigration center in croydon (if you live close to London) or any other immigration office close to you.

After the biometric it takes upto 5months or less before you hear from them again.

geeez: Well I arrived the UK yesterday and I'm currently at my cousin's with my son. The UK border force didn't really stress me. Less than six questions. No mention was made of why I didn't use the visa all these while. She just asked what I do, when last I saw my cousin (asked me twice at separate intervals), what my cousin does in the UK, how long I'll be staying and then she took our thumb and index fingerprints and let us through.
Congratulation for getting through without much stress. Enjoy your visit.

rhymz: that story looks like some concocted BS from Hint Magazine and its likes.
Again, I am yet to read any formal report from any reputable news outlet where it is reported that homosexuals were jailed or killed in Nigeria just on the suspicion that they were gay. Reports like this one wreaks of mediocre fairy tale concocted BS.
Indeed, what reputable Nigerian newspaper are you talking about?

rhymz: Pile of Crap!
How can they say he will die if he is deported to Nigeria, how na!!
Like seriously, how many Nigerians have been killed or jailed for being gay?
Lets be clear here, nobody gives a 4ck what anyone does in the privacy of their room. Na when you wan begin display such nonsense in public that it becomes a problem with the law. Nigeria or Nigerians do not kill homosexuals, you might be harrased by overzealous homophobes but being killed??!! That's a stretch, I am yet to read any report of a homosexual being killed in any part of Nigeria. The west should stop this nonsense antics of giving a dog a bad name just to hang it.
His defence attorneys should stop using that miserable line of argument just so he can get off the hook. No such thing happens in Nigeria, Naija may not tolerate homosexual behaviour, we don't kill them either.
And these stupid journalists should stop misquoting the laws, last I checked, Naija still operates the old Sodomy laws set up by the british colonialists not the suggested 14years pending at the National Assembly that is yet to be passed or get any serious attention again since the last time.
If homeboy is not gay but is claiming to be one just to get gay asylum, good luck to his 4cking quest but he and his lawyers should stop peddling lies and outright exaggerations to make it seem like sending him to Naija is synonymous with handing him a death sentence.

Billyonaire: He generalized it, he didnt say 'a few', didnt say, 'many', his statement sounds, like all of us can. And I totally am upset with such generalists' philosophy, its crazy.
....just like you think that Nigerians abroad are washing plate to survive?

Billyonaire: Thank you. Thank you, And Thank you. but no one should say Nigerians can change sexual orientation to gay to get VISA to UK. Thats some unforgivably shitty talk

....but that is what is happening here now and many have done before, so what is misleading about his comment?

Niyex1: Yes O! Lawyers have a way of making their clients look desperate to travel maybe because of Political war or for security reasons. Ask a lawyer, they know how to canvass stories & make their client look like a desperate young man who needed help..
So you think that UK embassy will give him visa to go and claim refugee in the UK because his lawyer claimed that he will die in Nigeria if not given a visa?

Niyex1: Wow, well to my own best of knowledge.. I think what your friend needs to do is to prove beyong reasonable doubt on why he made such errors.. Lying on the application kinda connects to why he changed his date of birth.. That was a delibrate attempt to deceive the ECO & that's terribly wrong.. The best he can do to get out of this situation is to get an expert lawyer who's extremely intelligent to canvas the decision made by the ECO or better still he can get a reduced ban or even get lucky without no ban if he should declare himself as a refugee.

Refugee where? In Nigeria?

The detail of the refusal is as thus:
You ave declared no refusals of a visa to any country, including the UK. However, d records show that in 2007 you made an applicatn for a student visa which was subsequently refused. In that application you submitted a passport with a diff DOB.
You have made false representation and failed to declare fact material to this application. The misrepresentatn and concealment of material facts undermines ur stated intentions to the extent that im not satisfied that u r bein truthful abt the pur pose and duration of ur proposed visitand therfore nt satisfied.
I there4 refuse ur applicatn under para 41 and 320(7a). On what ground can he appeal?
olubunmi4u: He was refuse student visa on the basis of no enough funds.
Your 'friend' submitted two different date of births, one in 2007 when he applied for student visa and another this time around.

In his current application he lied about been refused a visa in 2007, that is 2 serious immigration crimes that carries 10yrs ban.

If he wants to appeal then in his appeal letter he needs to explain why he used two different date of births and lied about been refused a visa in 2007.

diamond30: Hello justwise, i was refused visiting visa to UK base on the fact that the ECO said i do not have prove that i have fiance available to me for my trip, on the application i included my salary slip, my business evidence appointment letter etc, they claim that i have more money in my account than what i receive as salary, i told them i do business aside my job, i stay with my family therefor i don't pay for rent. what do i do, i was refuse visa 2month ago, when do u think i can reapply. another problem is my salary is been paid by hand not bank.since then i normally deposit my salary into my account this is the second month and i intend to do it for 3 month, do you think it ok? please advice.secondly since August i started paying my salary into my account minus 10k, will that affect the visa if am to reapply cos it different from what is on my pay slip. i intend doing this for 3month and October will make it 3month.this month i paid the complete month, just that of last month. please advice.

geeez: Thanks justwise, I just stumbled on some information on the ukba website:

Checking your visa

Your visa contains the following information:

1. 'Valid from' date. You cannot enter the UK before this date.

2. 'Valid until' date. You must leave the UK by this date, unless you have successfully applied for permission to extend your stay. In some immigration categories, you cannot apply to extend your stay. We suggest that you apply for permission to extend your stay (if you are allowed to do so) at least 4 weeks before your visa's 'valid until' date.

You can arrive in the UK at any time up until the 'valid until' date, but remember that this is also the last day that you are permitted to stay in the UK.

3. Length of stay. This is the maximum length of your stay in the UK. If you have a multiple-entry visit visa, it will be the maximum length of your stay in the UK on any 1 occasion.

4. Entry terms. If your visa says 01, you may use it to enter the UK only once. If your visa says 02, you may use it to enter the UK twice while the visa is valid. If your visa says "MULT" (multiple), you can enter the UK a number of times while the visa is valid.

UK visas are normally valid for multiple entries to the UK, until the 'valid until' date.

5. Visa category. This is your immigration category while you are in the UK. You must meet the requirements of this category while you are in the UK.

6. Conditions. Any specific conditions attached to your visa are listed here. For example, if your visa does not allow you to work, it will say so here. If your visa says 'No recourse to public funds', you cannot claim most benefits, tax credits and housing assistance that are paid by the UK government. If you are in the UK as a visitor, you cannot use the National Health Service except in an emergency.

http://www.ukba.homeoffice.gov.uk/visas-immigration/general-info/visa-holders/

Does the bolder text exclude Nigerians?

The answer is no but you seems to misunderstand my point about you traveling just few days before the expiration.

justwise: Travelling just a week before the expiration of your visa 'might' be a big issue at the POE.
If you are stopped at the POE the immigration 'may' want to know why you left it this long, what was the reason and date you stated in your application form when you were applying for the visa in April and does that still valid?

Your answers to those to questions (if asked) will determine whether you will be allowed in or not.

ayobj: If you insist on travelling, options are that you use a busy aircraft eg BA.the UKBA officer may be overwhelmed with the crowd.
Also, you can use an airport outside london; manchester, newcastle, glasgow etc...........you just maybe lucky.

You really don't have a good case.
All the best.it seems no matter what we say here, you will still take the trip.
How will that work? No immigration checks in those airports? How will he land at Newcastle or Glasgow without touching down at Heathrow airport first?

olubunmi4u: @ justwise,
I ave a colleague that applied for family visit with d wife and was refused while d wife was granted. He was refused on d basic that he did not acknowledge he had applied before in 2007 under a different DOB Treduced age). He was refused under 320(7a) false representation or misrepresentation. He was given right to appeal, what chance does he have not to be banned for 10yrs.
Was he given full right or limited right to appeal? If he was refused under 320 (7A) then i don't think he was given full right to appeal.
