It has to be authenticated in court by the person that took it. Even after proper authentication, defense can question it’s chain of custody from when it was taken as authenticated to when it was brought to court.

The Prosecution have to proof all that before it can be allowed into evidence, but the defendant must have good lawyers who know what they are doing.

Otherwise video are considered as heresay and can be argued as doctored and cannot be accorded by any court as an evidence of what they show.

I am not a fan of NBC. However, I think this judge interpretation of the law get K leg. Even in western countries ministries and and agencies impose fines. If the company feels the fine is unjust, they can go to court for the court to arbitrate.
May be this is just fake news. otherwise going by the logic you can not be issued with parking or driving violations unless you go to court.

You are comparing Apples to Oranges.

The baseline here is the Nigerian Constitution and not the Constitution of the United States of America. Yes, there are similarities but the two books are totally different.

A very good example is, the word "Impeachment" can be found in the America Constitution and also in Nigeria Constitution, but the meaning and applications are totally different. In the US to impeach the President simply means for the House to indict him or charge him with an offense but in Nigeria impeaching the President means removing him/her from office.

To understand the subject matter, consult the Nigeria Constitution, The Act establishing these Agencies and Case Laws in Nigeria...The fact that, the Act ascribe powers to a particular Agency does not mean that those powers are valid, they can be challenged and if they run contrary to the Constitution of Nigeria they will be stricken down.

Maybe i am wrong BUT This doesnt make sense. NBC is a regulating commission/body, it should have power to be able to sanction erring broadcasting organisation without having to rely on the judiciary.

Instead it is the broadcasting organisation that should file a case at the court if they are not satisfy with the sanctions imposed on them.

It is more like telling LASTMA, ROAD SAFETY or other precautionary and regulating agency to seek court intervention before impounding your vehicle for going against the law or NCC trying to seek court intervention before imposing sanctions on erring network providers. These are regulatory bodies, it is one of their main responsibility taken away from them while rendering them incapacitated.

Court process takes to long. We all know NBC is the only thing holding this mischievous and overly sentimental media houses by the balls and checkmating their excesses. If not, journalism would have been an insane crazy affair in this country. It should be the other way round. Anyone who is not satisfy with the sanctions should go to court not the regulatory body seek court intervention and interpretation before imposing sanctions.

The real question is....does LASTMA, ROAD SAFETY truly have the power to impound and impose fines on Nigerians?

Nigerians are just taking these things lying down because going to Court is expensive and consume a lot of time. Until a Court of Competent jurisdiction has adjudicate on these questions, it is premature to conclude that these agencies despite what they do everyday truly have such powers.

A Federal High Court had previous ruled against FRSC that they do not have the power to impose fines and that court followed the same logic as above that, they must pass through the Court to be able to do so and that, they cannot be Judge and Jury in their own case.

New York City is like a Local Government Area, it comprises of five boroughs aka towns viz: Manhattan, Bronx, Queens, Brooklyn & Staten Island.

I don't even think you have the power to reason properly, never mind logically.
Your friend Linearity says every procedure etc must be 100% screened and made sure to be completely risk free before embarking on it, like a delivery. The dude replied that 100% risk free procedures aren't guaranteed. And in fact, doing all the tests before a procedure like delivery is not possible. Investigations like liver, thyroid and kidney function tests, spotting profiles, renal scintigraphy etc are good but not always necessary before labor/deliveries. But if u can do them, fine and good. But the problem is they cost a lot, thus investigations are cut down to viral markers, PCV, urinalysis, VDRL.
If you are very rich, by all means do all. But when 95% of Nigerians can't afford them, it doesn't mean you can't attend to such procedures, but do the barebones investigations, and hope nothing happens. Or do you expect the doc to pay for those investigations? When you say we are morally obligated to save lives, do you expect us to do it blind(blind means without those costly investigations). Even when you put in your best as a doc, you still need the patient to do his or her own part, that is do all the investigations.
People in Europe and US youre pointing to are suffering. Ask them how much healthcare is over there? Its very costly because docs over there have learnt to cover themselves by requesting for in depth and extensive investigations before any procedures to prevent any issues(which would lead to litigations). We don't ask for such here but gradually due to the increasing litigations, we are doing that
I am not saying that shit don't happen or things must be 100%, there are no utopia world or scenarios out there.

All I am saying is that, given the multiple cascading events that took place in this case and the fact that it happened in Nigeria, where maternal mortality rate is among the top 10 in the world, more often than none, there is culpability with the professionals who had a duty to care.

In a situation where 1 in every 22 women would die during pregnancy in Nigeria says a lot about our healthcare system. Agreed the majority of these deaths are due to lack of care or access to care centers, but a good portion of them like the case in point happened in care centers in Nigeria.

So in situations like these, my default position is to blame the care center until proven otherwise. I agree that I am biased (so factor this bias in understanding my position).

However, if you look at the bright side, it shows that I have a lot of faith in the Nigeria care centers that, they can really do more and in most cases, it is not really the money that makes the difference, but the value attached to human life by the care center personnel.

Don't take my word for it, visit a few care centers in Nigeria and see how humans have been reduced to commodities, everything that goes on is transactional despite budgets covering these items. The state House clinic in Abuja had a budget of about N20 billion but bu the President's wife told us, you can't even get Paracetamol there and the President travels abroad to treat his ear infection.

Firstly, no medical student would be allowed to carry out a Caesarean operation. I know this because I'm a doctor trained in Nigeria.I initially thought it was done by a resident,who is a qualified doctor already, but now, we know it's a consultant who did it.
2) Complications are sadly, part of operations and normal standard procedure anywhere in the world is to inform the patient of these risks. Rarely would you see any "experienced professional" who hasn't had a complication before. So, it's not damaging.
3) I've explained why she had kidney failure in the previous thread. It's not due to "tampering" with her kidney.

I took time to locate and read your previous comments on this subject, the truth is I am not persuaded.

Yes, there are complications every surgery hence one is asked to sign below the dotted lines before anything can be done.

But the multiple cascading failure here leaves one with nothing but to question the know-how and professionalism of the doctors involved here.

It was a child birth that resulted in excessive bleeding. This is totally under the control of the Doctor in charge, if the right tests medical screening are carried out, excessive bleeding can be anticipated with proper remedy in place. It is most likely the knife cut some place it should not have touched leading to the bleeding.

Secondly, when the bleeding occurred, it is totally under the control of the Doctors to monitor and protect her other organs, they cannot just say excessive bleed lead to organ shutdown’….she was right there under your watch.

Thirdly, she was put on dialysis due to kidney shutdown and died within few days from what again?

The Hospital are I order for setting up the MDT because too many things went wrong and someone should be held responsible.

This is not good for the Hospital and their rebutter does not erase the negative light this event has cast on them.

I understand the man is angry and hurt,so I don't blame him for his write up.Also, this is Nigeria, the public tends to believe whoever puts the story out first, especially if they are the aggrieved party.
At least, we now know it was a consultant who carried out the operation, and not a "student doctor" as claimed in the initial story.
Makes one wonder what else might be been embellished in the initial story.

Because the hospital said so? Also, during operation many doctors are involved including student doctors.

Plus, it is even damaging that it was a professional that carried out the operation because if I recall, the husband said, during child birth, the wife experienced a complication and they were advised that her womb have to be taken out and in the process of operating the womb, they tampered with her liver or kidney.

Also the hospital here stated they invited the husband to a multidisciplinary meeting, which means the hospital knew there was fault on their end to have setup a disciplinary team.

Recently, the supreme court ruled that Americans have a right to carry firearms in the public for self-defense, they also ruled that domestic abusers also have rights to gun, in these ruling all the six (6) conservative Republican and self proclaimed pro-life Judges voted YES, the only three that saw the dangers in that ruling and voted NO are the ones you are bashing here.

Yes, the monarch use to have prerogatory of mercy aka royal pardons which have since been delegated out.
