A state governor CAN NOT take "back" land belonging to the Federal Government (or its agencies), because such land never belonged to the state in the first place and the Land Use Act (LUA) expressly states so (please go and read the LUA, it is a short piece of legislation and should not take you long). Moreover, contrary to what you have stated, a governor CAN NOT do whatever he likes to the land and can most definitely NOT transfer the land to Benin Republic. You should run these your views past those 10 lawyers you say you have in your family. I am sure that they should be able to enlighten you a bit and disabuse your mind about all these your preposterous views. Ask them to run you through the gamut of case law on the Land Use Act - and believe me, there are plenty cases on the LUA (which though you seem to like it so much, I must inform you is incidentally probably one of the most vilified laws in Nigeria - if not singularly the most vilified law. In my opinion, it is a crap piece of legislation which should have been expunged from the statute books long ago or at the very least, heavily amended). I could barely make head or tail of the rest of your post, so I cannot address that bit. But seriously, do desist spurting jargons which are completely false. |

Becomrrich:This is why it is said that it is better to be totally unschooled, than to be half-educated. The 1999 constitution is very valid. If according to your argument, it was not the "people" of Nigeria who agreed to the constitution, your National Assembly members whom you elected (and who therefore are the people's reperesentative) had and still have the powers to alter/modify or expunge the parts of the constitution that they do not like, and they have not done so (apart from a few minor alterations shich do not matter here), but instead they have "adopted" it implicitly and work thereunder. If for the sake of argument, you say that the 1999 constitution is invalid and void, the situation does not become like you would like to believe that Nigeria would become a nation without a constitution. No, what would happen is that the status quo ante would be restored and the 1979 constitution would go back to being the valid constitution. And if you argue that that isn't either, the situation would continue until we reach either the 1963 Republican constitution or the even further back, the 1960 Independence constitution (no one would say that it was not the people that agreed on the independence constitution and even the republican one). So please stop embarrassing yourself by sprouting all the nonsense you have said as it just shows how little you understand the law. Oh! and before I forget, two little points - (1) While the lands in the various states are not vested in the federal government as you stated, they are vested in the governor of each state as the owner of these lands. Although this ownership is a kind of trust, so that the governor holds or owns such lands in trust for the people of his state and cannot unjustly deny an "individual owner" the possession or "ownership" (ownership here is defined in a manner different from that vested in the governor) except it is for public interest etc. Thus, neither you nor I can "transfer", as you say, our lands to the Republic of Benin. Moreover, the alteration and determination of the boundaries of sovereign States is a whole different matter on another realm which involves international conventions and/or treaties/agreements BETWEEN sovereign States (as represented by the competent authority), NOT individuals. This takes you deeply past national laws into International Law (I refer you to the Bakassi Peninsula case between Nigeria and Cameroon). (2) The president does NOT have the power to alter any law whatsoever. Of course in a state of emergency, there are powers he may exercise, but that does not even apply here, so abeg leave story. Also, what the heck do you mean by constitution review? You talk as if a constitution review is an independent body (a constitution review means exactly what it says i.e. carrying out a review of the constitution). The Land use Act CAN be amended by the National Assembly. It can be amended the same way the constitution can be amended (you'd do well to go through the constitution again. Pay special attention to Section 315(5) and if you like, you may read it in conjunction with Section 9(2) for a fuller understanding). Bottom line, you'd do well, to read the laws you cite carefully and get an understanding of them before you start shooting off here with half-baked stuff. Better still, take your own advice and go to school. You can enroll for a law programme (In your second and fourth year of study, you will be taught constitutional law and land law respectively, and can take international law in your fourth of fifth year (Depending on the school)). Till you do any of these, stick to your area of competency. (Geez, that was quite tiresome) |
