212(a)(6)(C)(1) findings are for material misrepresentation, and carry a lifetime barr on travelling to the US. If someone has a 6(C)(1) finding, while they are welcome to apply for a non-immigrant visa, there is a multi-step process:

First, one has to convince the officer they qualify for the visa they have applied for, and overcome the legal presumption of being an intending immigrant. (This is often difficult, as they, by virtue of having a 6(C)(1), are known to have misrepresented themselves in the past.) If the officer doesn't believe the applicant qualifies for a visa, the interview ends there.

However, if the officer does find the applicant to qualify for the visa, the applicant can ask the officer to file a waiver request for them, which can come either with or without the officer's recommendation for a waiver. (We don't decide on the granting of waivers - the Department of Homeland Security (DHS) back in the U.S. does.) Then, the ultimate decision on whether or not to temporarily waive the lifetime travel barr is made by DHS.

Had my interview today, wasn’t given the visa, my interview thus went like this.

VO: what countries have you visited the last two years
Me: 2016 Southafrica, 2017 UAE
VO: why are you going to Indianapolis
Me: To attend my bestfriends wedding where am to play the role of his best man.
VO: are you married?
Me: I and my fiancée ain’t ready to commit to marriage yet.

In conclusion, does it mean we should rule out US from our list of holiday locations for Life? As in, no remedy of any sort?

I understand Canada is linked to US, so does it mean we should also forget Canada as I plan to have our next baby there on medical tourism?

Please advise.

Hello The best thing is to let some time pass, and apply again when you think your ties are stronger. If asked, be forthright about the previous misrepresentation. It will make a big difference.

Me: *laughs* I actually have my aged grand mother who stays with me and I take care of my 4 siblings. My priority for now is to get them on their feet. Marriage can come later.

Hi everyone, i have been following this thread for months and its been very insightful and helpful..ill like to share my experience.

I have been refused a us visa four times before my this..i was refused 15 years ago twice when i applied for a student visa in lagos which was in 2003.

I wanted to ask if i could travel alone cos my wife 2 days ago received a letter in the post for her dream job interview and unfortunately it falls in the period we are originally scheduled to travel as a family and this is the only time i will be free to travel cos of my work.im only staying in newyork for 10 days..will it be a problem to travel alone even though i said in my ds 160 im travelling with my wife and children?pls guide me

Just came back now from us embassy lol story plenty they have standard, once u don't meet up na sorry o, Nigerians fidgeting like say oyinbo na God. Some people under tension some asking for favour lot . The best is go prepared. Travel and get good job history plus never tell lied to VO hmmmm that one na penalty to throwing o never ever lie abi play smart everything is before them that u did before.good luck o .I was denied for lack of ties.ese o

Bro, am an accountant been with my company for over 7 years, am married with two kids am sure she saw all this on my application but she never ask me any question regarding my family or abt work.. As u can see from my transcript. A guy before me has been to SA and UK but was also denied

So I went for my Visa interview yesterday and below is the transcript:

Me: pass over passport
Vo: where are u going in the US
Me: we are going to Florida
VO: any plan when in Florida
Me: plan to visit the Disney world with the kid and also attend some art exhibition at the museum of art DELAND. We will also do some sight seeing
Vo: u came here in January and your wife applied to give birth in the US, are u still planning to give birth
Me: unfortunately we lost the baby ( truth nothing but the truth) , hence we aren't planning to have a baby this time

Me: No, however in my January application I filled yes cos I thought my wife step mum's cousin qualifies as relative but was recently meant to realise she did not

Bros the countries na Italy, UK and China. It been more than a year since I went for my last interview so I can't really put down the complete transcript but I'm most definitely sure that he denied me because of the fact that I couldn't give him a concrete proof of my travel history.

The issue is the agent lied about the travel history he put - China, Italy and UK, and I have never been to any of these countries.
Now my new application I want to come clean and state that Haven't been out of Nigeria in the past 5years but I'm scared that the previous reason I was denied will pop up and the new vo will still deny me based on that first initial denial.

In my DS 160 form I filled Rhode Island and New Hampshire as locations am visiting .,my uncle stays in Rhode Island and my sister schools at New Hampshire. But what I think the VO thinks am I might be a redflag is cos New Hampshire is a border state to Canada ,just 1 hour 40mins drive to Montreal, Canada.

Gurus in the house what do you think went wrong .

Got to Us embassy for Interview today.Its was crowded as usual.I & my wife were denied. Alot of people got denied even if you have travel history.They granted most of the elderly people today.So sad
