Amaechi “I started regretting my decision for joining and expending so much on APC when I discovered some top APC chieftains from CPC and ACN blocs were working clandestinely against my confirmation as Minister by the National Assembly. If you recalled,unlike other nominees,I attended several NASS screening sessions before I was attended to.I don’t know why they did it but if not for the firm stand of Dr Bukola Saraki,I wouldn’t have been confirmed as a minister. I will remain grateful to him. What they failed to do at the National Assembly they succeeded in doing when the President was apportioning ministerial portfolios. Against my wish,I was given minister of Transport. As if that is not humiliating enough,they removed the juicy department of that ministry( Aviation) and made it a semi autonomous Ministry under my Minister of State. I cannot exonerate the President from not knowing how I am being shabbily treated because my pact was with him and he knew what my dues were supposed to be but today,he has not redeemed any of the promises to me. I begin to ask myself everyday why I made such a political blunder. The most painful thing is that,my people who used to love me now hate me. They hate me for joining APC. Look,it is not about Goodluck or anybody. The people of Rivers see APC as a dubious arrangement and unanimously vowed never to support the party. If you want to prove me wrong,let Wike as powerful as he is now in the PDP try it by jumping to APC,he will never convince the people to go along with him. That is the mistake Akpabio just made. The people of Akwa Ibom,Cross Rivers and Rivers think same politically. APC can never be their choice of a political party. Don’t be deceived,these states do not want favors or anything from the CENTRE unlike most states. They are self sufficient and cannot be induced with anything. Take my case for example. A commissioner for Transport in Rivers State is more comfortable that a Minister for transport at the Federal. This is the truth. I have bore all travails I am suffering in APC with all equanimity but there comes a time where I have to start weighing my options and that time is now. Ibeh,let me tell you,I don’t think I have the will to work for APC any longer. I cannot point to anything they have done better than PDP except bad governance. I have been rendered politically indolent. The only tangible thing I have done of late is to be commissioning railway projects executed by the Jonathan’s PDP regime. Do you know how painful that is? It is as humiliating and painful as when a goalkeeper has to bring the ball from his own net put there by the opposing team. Ibeh,the reason I have not left APC is no longer what people will say about it. It is because I have not been approached by any serious party. You know with my political standing,I should not be the one to beg parties to accept me. They should court and beg me to join them. nwakibie3: Vice President Yemi Osinbajo says he is feeling sad over the trial of the Chief Justice of Nigeria (CJN) Justice Walter Onnoghen, on allegations of false and non-asset declarations.
The Code of Conduct Tribunal (CCT) had scheduled Jan. 14 for the arraignment of the CJN.
However, the process was stalled as the CJN failed to appear before the CCT; and a Federal High Court sitting in Abuja also ordered the CCT to halt proceedings.
Osinbajo, who spoke at the 2019 Online Publishers Association of Nigeria (OPAN) conference on Wednesday in Abuja, said that President Muhammadu Buhari had no prior knowledge of the arraignment.
The theme of the conference is “Free Press and Objective Reporting in the 2019 Election Year.’’
According to Osinbajo, Buhari’s approach is that institutions should do their work.
“ I can tell you for a fact that he did not even know about this until Saturday evening. He did not even know that there will be any kind of arraignment until Saturday evening.
“He has said categorically, do not interfere with whatever institutions are doing; sometimes, it has consequences such as we have today; such that people say how can such an important person be subjected to a trial without the Federal Government?
“But I can tell you without any equivocation whatsoever that he was not even in the know because it is a specific instruction that he gave.
“So , even where somebody else calls a public officer such as Ibrahim Magu of EFCC and says something or the other, he will say `no, no, no, Mr president has said I can do my work.
“My take is that I would rather not have a situation where senior members of my profession are being tried for an offence; certainly, I will rather not have that kind of situation.
“ So, I do not feel particularly good about it; as a matter of fact, I feel very sad; that it is going on at all, that is my position.’’’
Osinbajo tasked online publishers to go after details and check the facts before publishing; warning that online news was losing credibility.
The vice president said that elections had heightened ethnic and religious tensions and tended to threaten and challenge Nigeria’s unity and security.
“So, it is even more so, the case today that we just must be more responsive because anybody on their beds can launch a website, post images from anywhere in the world and tell whatever story he wishes.
“So, the online publisher is essentially in a poorly regulated space and can publish practically anything, even outright falsehoods.
“Perhaps because the worst that can happen is a libel action if your publication tarnishes a person’s reputation.
“The problem with the current situation is that online news may lose credibility; and that is a very bad situation because the loss of credibility is bad for everybody, bad for business and weakens an important social tool of public communication.’’
He suggested the encouragement and promotion of forums for online practitioners to engage and develop by interaction with others.
“As for elections, I think it affords an opportunity for an online publication to become well established as a credible and speedy source of news and information.
“News on election results will be so sought after that anyone who can provide them accurately and in a timely fashion will be the go-to-site, even in the future.
“The point to bear in mind is that integrity pays. Being the first to break the news, especially when it is unverified, might bring in some traffic initially, but it does not take that long to lose reputation.
“And once the credibility of the publication is damaged, people will not take the news seriously,’’ he said.
Earlier in a remark, OPAN President, Mr Austin Ogannah, said that the association as founded in 2011.
According to him, the idea is to have an association that self regulates practitioners in the online news media; so that members can hold one another accountable.
Ogannah said that the essence of the conference was to understand objective reporting in an election as captured in the theme.

The suspected who is currently cooling off in police custody said he killed his 28-year-old wife identified as Maureen and two sons in a fit of anger, following an allegation of infidelity. The little daughter identified as Precious was however lucky.

The veteran shot-stopper revealed his decision on social media on Tuesday, declaring that after 20 years as a professional, he had elected to call time on a trophy-laden career.

actiondrilling: The Supreme Court has dismissed the appeal filed by Shell Petroleum Development Company (SPDC), which prevented First Bank of Nigeria Limited from paying the plaintiffs community a judgment debt now totaling N134 billion to the plaintiff community represented by 10 Ogoni Chief of Ejama Ebubu community of Ogoni in Rivers State.
In a ruling on Friday, Justice Kumai Bayang Akaahs said the notice of appeal filed by the oil giant was incompetent and struck out based on Order 8 Rule 7 of the court’s rules.
Justice Akaahs also said motion filed by Shell on July 16, 2018 had no leg to stand on it ought not to have been filed.
The Supreme Court consequently awarded N500,000 against Shell for filing an incompetent appeal in the court.
Citing authorities to back up his submission, the apex court held that since the notice of appeal filed by Shell sought to be amended was incompetent, no valid amendment could be effected because issues of fact or mix law and fact were raised in the original notice of appeal with leave of court.
He agreed with the submission of the lead counsel to Shell, Chief Wole Olanipekun (SAN) that an appellant who has a valid and subsisting appeal can seek the leave of court to do so, adding that in the instant case, there is no such valid notice of appeal that could be amended.
“Where the grounds of appeal are based on mixed law and facts and the leave of either the Court of Appeal or the Supreme Court is not sought and granted, the appeal is incompetent and neither the Court of Appeal nor the Supreme Court will have any jurisdiction to entertain the appeal.
“As the notice of appeal sought to be amended was incompetent, no valid amendment could be effected even though issues of jurisdiction were raised in the proposed notice of appeal.
“Learned senior counsel for the appellants stated that correct legal position that the appellant who has a valid and subsisting appeal can seek the leave of court to do so but in the instant case, there is no such valid notice of appeal that can be amended, Justice Akaahs held.
The suit was first commenced in 1991 before a Rivers State High Court sitting at Nchia Division, when the Ejama community represented by Isaac Osaro Ogbara, Victor Obari, John Oguru, Joseph Ogusu, G. O. Nnah, George Osaro, and Adanta Obelle, had sued Royal Dutch Shell Plc, Netherlands, Royal Dutch Shell Plc, United Kingdom, and SPDC over alleged oil spills in 1970 that occurred when Shell operated in the community. Judgment was entered for the sum of N6Billion in favour of the community by the Nchia High court. That judgment was conceded on appeal because the Supreme Court had in a sister case decided that States High Court have no jurisdiction in oil related matters. The Plaintiffs in 2001 refiled the suit at the federal High Court, Port Harcourt.
However, this 2001 case, presided over by Justice Ibrahim Buba claiming N17billion and interest thereon went through full trial. Justice Buba, after listening to the submissions of the parties in the suit, in his judgment in 2010, awarded N17 billion to the representatives of the Ogoni people.
The court equally granted the Ogoni chiefs 25 per cent interest charge on the principal sum of about N17 billion.
SPDC then appealed against the judgment and applied for a stay of execution of the judgment pending the appeal.
As a condition for granting the stay of execution, the court required Shell’s bankers, FirstBank, to provide a guarantee of the judgment sum plus interest.
This condition was complied with. But Shell’s appeal failed on merit because Shell failed to file a brief of argument in support of their appeal but instead claimed that they were granted leave to file an amended brief of argument, which the Court of Appeal found not to be correct.
Against that judgment, Shell proceeded to the Supreme Court where its lawyer, Olanipekun, SAN now leading Olawale Akanni (SAN) who was the company’s lawyer at the Court of Appeal when that appeal was dismissed, filed a fresh application asking for leave to amend the original notice of the appeal filed by Akoni in the Port Harcourt court of appeal registry in order for him to argue fresh points not raised at the court below and in order for him to argue 36 additional grounds of appeal.
Upon the new application at the apex court, the respondents’ lawyer, led by Lucius Nwosu, SAN, filed a preliminary objection. It must be noted that the appellants against whom judgment was entered at the court of appeal are Shell companies – Shell International DV of the Netherlands, Shell International of UK, and Shell Development Company of Nigeria Ltd.
Nwosu, assisted by Lawal Rabana, SAN and others, argued that the findings of the Court of Appeal dismissing their appeal were based on facts, adding that the law is that an appeal must arise out of the decision complained against.
He stated that if the decision complained against was based on findings of fact, the constitution requires that you cannot appeal them except you first seek leave of the Court of Appeal.
The respondents’ lawyer contended that since that notice of appeal at the Court of Appeal was filed without leave, it meant that, that notice was incompetent and cannot be amended because it would mean putting something on nothing and expecting it to stand.
However, in December 2017, the judgment creditors (Ogoni chiefs) commenced garnishee proceedings at the Federal High Court in Owerri presided over by Justice Lewis Allagoa.
They urged the CBN to pay them N122.53 billion out of FirstBank’s account in its custody.
THISDAY gathered that they calculated the principal sum of N17 billion and the accrued 25 per cent interest charge per annum to arrive at the sum of N122,533,403,392.
In January 2018, Justice Allagoa granted them a temporary order (garnishee nisi) ordering the CBN to pay them the sum from FirstBank’s account with it.
But the CBN asked the court not to make absolute the temporary garnishee order it granted six chiefs representing the Ogoni community, compelling it to pay the sum of N122.53 billion on behalf of FirstBank.
CBN’s lead counsel, Professor Fabian Ajogwu (SAN) while responding to the garnishee proceeding, stated that making the order absolute and compelling the CBN to pay out the huge sum would be against the interest of justice because the matter was still pending at the Supreme Court.
He also argued that compelling the CBN to pay the N122.53 billion from FirstBank’s funds domiciled with it could have far-reaching consequences for Nigeria’s oldest and biggest lender by assets and deposits, and a systemic impact on the rest of the financial system and wider economy.
With the dismissal of the Shell’s appeal last Friday, it is not clear if the application filed by the Ogoni chiefs seeking garnishee absolute against FirstBank and reserved for ruling by Justice Ibrahim Buba of the Federal High Court in Lagos would not be granted.
Reacting to the Supreme Court judgment yesterday, Nwosu said: “With this decision, therefore, all arguments of FirstBank that Shell was on a further appeal at the Supreme Court for which they were renging from honouring their obligation that was due by virtue of their guarantee has completely collapsed and as of today, the guarantee is standing at N134 billion, contingent liability of First Bank’s assets. And that there is a garnishee order nisi attaching First Bank’s money at the CBN which since had been served on the Central Bank.
“With this judgment now, the central bank is under an obligation to set aside that amount of money with interest still running from First Bank’s account to satisfy that judgment debt based on what the law says under garnishee orders.”

They agreed to embark on door-to-door and community-to-community campaigns to showcase the achievements of the president in the southeast zone since 2015, even as they expressed confidence in the ability of the president to continue to transform the country for the good of the people.
In a communiqué released after the well-attended maiden meeting of the South East APC presidential campaign council, held in Enugu, the leaders also passed a vote of confidence in the zone’s Director of Campaign, Sharon Ikeazor and pledged their support to enable her undertake the task of achieving victory for Buhari in the election.
At the meeting were Minister of Science and Technology, Dr. Ogbonnaya Onu, who represented Ministers from the zone, former governor Sullivan Chime who represented former governors, Southeast Zonal Chairman of the party, Mr. Emma Enukwu, National Auditor, Chief George Moghalu, APC gubernatorial candidates in the elections: Senator Hope Uzodinma (Imo) Senator Ayogu Eze (Enugu), Chief Uche Ogah (Abia) and Chief Sunny Ugwuoji (Ebonyi).
There were also Senator Ben Uwajumogu, Senator Andy Uba, Senator Julius Ucha, and Senator Margery Chuba-Okadigbo as well as National and State Assemblies candidates, former Ministers Chief Emeka Wogu and Professor Chinwe Obaji.
Also in attendance were State Chairmen from the five South Eastern states, National Working Committee members and political appointees including Mr. Osita Okechukwu, Juliet Ibekaku and Princess Gloria Akobundu among others.
The communiqué signed by Ikeazor said that the leaders resolved to ensure that President Buhari wins overwhelmingly in the South Eastern region.They also pledged to “reconcile, restore and reintegrate into our fold, our disenchanted members” as well as reinforce the need to “forget their differences from the fallout of party primaries and unite to win the presidential election and other elections for the APC.”
The leaders thanked the President for the confidence reposed in Sharon Ikeazor, saying she has a wide reach in the five eastern states and beyond based on her antecedents as a former National Women leader and member of board of Trustees of the party and promised to support her in her assignment.

The Secretary to the Government of the Federation , Boss Mustapha , says he believes the All Progressives Congress has won the 2019 elections .
According to him , the APC is only waiting for the Independent National Electoral Commission to announce the results.
Mustapha said this on Thursday during the Gombe State APC ’ s governorship campaign rally at the Olusegun Obasanjo Stadium in Kaltungo , Gombe .
The SGF said , “ We are only waiting for the announcement of the results. Just make sure you come out with your PVCs (Permanent Voter Cards ) and cast your votes because the Peoples Democratic Party cannot deceive again .

A former governor of the state, Senator Danjuma Goje, said Christians in the North did not enjoy key national appointments until the coming of President Muhammadu Buhari .
He said , “ Although (Yakubu ) Dogara has left the APC , he benefited from the party. He became the Speaker of the House of Representatives .”
On his part , Osinbajo said the APC was a party for everybody .

mrakeli62: Senator Eyinnaya Abaribe has told the Court of Appeal in Abuja that his standing surety for the leader of the Indigenous People of Biafra, IPOB, Nnamdi Kanu, is illegal.
Abaribe, in an amended seven grounds notice of appeal filed by his lawyer, Chukwuma-Machukwu Ume (SAN), urged the appellate court to relieve him of the role of surety for Kanu.
In the document made available to journalists in Abuja yesterday, Abaribe also asked the Appeal Court to set aside the November 14, 2018 order of the Federal High Court in Abuja which gave him and two others a two-month ultimatum to, each pay N100m bond for their inability to produce the Biafran activist.
Recall that Justice Binta Nyako of the Federal High Court in Abuja, had in her November 14, 2018 ruling, held that Abaribe and the two other sureties owed the court the duty of producing Kanu, whose absence since 2017 has halted his trial on charges of treasonable felony.
But the senator had also filed a brief of argument to challenge the Federal High Court’s decisions.
Relying on sections 55, 165(3), 167(3) and 488 of the Administration of Criminal Justice Act, and other provisions of the constitution, Ume argued that a public officer such as a senator was legally exempted from standing surety for a suspect.
The Senator’s lawyer blamed the Federal High Court for making a senator to be part of the sureties Kanu must present in April 2017.
Ume said, “The honourable trial court failed and or refused to take judicial notice” of the relevant provisions of the ACJA and the Nigerian constitution.
“Thus the honourable trial court had not done the needful under the law, otherwise it would have found that by law, the appellant (a senator) is legally exempted, ab initio from giving security for the good conduct or behaviour of a suspect.
“It is trite law that where a valid Act or law clearly states something, it is not within the powers of the court to go contrary to it.
“We, therefore, can see that the involvement of Senator Abaribe in the whole bail and surety quagmire was invalid, ab initio.”
Abaribe and two others had stood as sureties for Kanu before he was granted bail by the Federal High Court in Abuja on April 25, 2017.
