From experience, whatever amount you pay or have payed as tax, LASG will always work an additional tax for you.
I have seen Lasppa District officer pay additional tax for her proposed build.
In the attached pix received for a client,(business owners that presented their tax clearance for each year) the husband and wife (MR and MRS) were asked to pay a sum of 650k each as additional tax.
Invariably, if you are seeking for building approval with the tittle MR and MRS. you will end up paying more for tax. At this point I don’t know if it is the amount of PAYE tax I pay that works for me. There is a property I was processing the governor’s consent with Mr and Mrs title. They levied my wife tax. All I did was to tell her to send me her US tax return and I promptly told them she doesn’t live in Nigeria and she pays taxes in the US with the return as evidence. That sorted the issue. I have had a lot of experience with tax issues both in Nigeria and the US and when I am on my right I don’t back down. I battled the US IRS over a $70k tax bill for 4 years and at the end of the day I won because I knew I was right and they were wrong and they only needed to calm down and see it (this one is a story for another time because one of the big 4 was the tax consultant and they made the mistake and didn’t want to admit). |

sonnie10: Them say that appeal na waste of time. I am interested in knowing the outcome. This year tax no be small. Almost all houses had significant increase in value, making the tax very high. Most are tempted to cash out now especially considering the economy. But where person go live if him cash out? Even rent is very high now. There way things are, na retirement such pass I got a $10k reduction in value from the appraisal but it doesn’t affect the tax because the full maximum 10% yearly increase (taxable) on last year’s value still puts the 2022 home value about $60k above that. If the new value keeps that means I will have maximum property tax increase for the next 2 years. I always do the online appeal though and it has worked every year until this year. |

somehow: A tax officer told me that the building tax in Lagos is dependent on the location and structure just as I said before.
Confirmed from 2 other officers from different tax offices in Lagos, afterall they had nothing to gain from me, so why would they say something not true?
I will stop here though and let others that went through similar situation share their experience.
Happy Sunday to us all. I finally see that we are talking about 2 different things. The items that depend on your building size and location for building permit processing are the sq ft calculation on building plan, fencing fee, application and registration fee, layout fee, processing fee, stage certification fee etc. In law there is nothing called a building tax. When you are assessed all of the above, as part of the processing you provide evidence of tax payment. If you provide it or don’t have it the verification is done with LIRS and if you have a tax clearance certificate based on PAYE in my experience that suffices. It is when you don’t have that they start levying indiscriminately. Anyways, like you said let’s let the matter rest. Me I sha will not let anyone cheat me on these issues when I know the right thing |

Imagine, same people will complain about paying to much tax in Naija. I laugh had when I heard that. When they go outside the country they have no choice then to pay like everyone. I have a friend running business that's racking in over 8millon monthly complaining to pay 10% tax, compare that to the West where you pay, income tax, property tax, grocery, Gas or petrol tax, clothing tax, almost anything you buy nah tax. The question is how many Nigerians paying tax, probably 18% compare to South Africa 45%, Ghana 30% , and Egypt 24%. Many of them don't, even pay the or so 15%. It should just be a matter of following the law and not introducing illegalities in the name of gathering more taxes. The law is clear on how these things should work but because our tax people are lazy they won’t follow through. Even the US that we complain about the taxes don’t just charge arbitrary taxes. It is a lack of accountability in service delivery that will make them hold up your application because of taxes when you submit genuine tax documents. The two processes should be different. An analogy is when people clear their cars at the port through customs and the same customs will waylay them on the road that they didn’t pay correct duty. Can’t we see the irony in that or are we just so used to anyhowness? |

The city sends everyone tax appraisal based on the value of their property , they don’t exempt anyone based on how their property was financed. What that means is that, if you own a house from whatever means, it does not negate that fact that it is an acquired taxable asset. I know this. I also get my yearly appraisal from Fort Bend County. In fact I just finished the appeal process. In Lagos State we have the equivalent - it is called land use charge and it is levied yearly and I believe takes the value of property into account. We are talking personal income tax here. Even in Texas, there is no state income tax just federal which is why property taxes are higher than some other states with state income tax. |

If you are a salary earner who earns 100k monthly but has #100M in your account for building , they would assume you have other source of income. Money does not grow on trees. There are only two ways to acquire money; either by earning it or by inheritance. For both, the law is that you must pay taxes from the money. That tax is what they are using the opportunity to ask and collect. Another assumption is that the money was earned in Lagos. If not, prove it.
However, it wouldn’t be fair for those with full verifiable taxed income to pay additional when building . But that has been the unhealthy, unlawful double taxation practice in Lagos.
The question is, based on salary structure, how many PAYE workers have cumulative salary of #100M through the life of their career? Remember, the FIRS has the power to audit any entity and most people might not want that. Invariably, this audit is what they do during this process. In my experience, vast majority of salary earners do not build outside of their income range except they are involved in some sort of corruption or have a very lucrative business on the side (most don’t and this cannot form the basis of the discussion). What is common is for salary earners to take a loan towards building and you cannot tax a loan as it is not income. The 100k earner building a 100 million naira house is an extremely unlikely scenario tending towards being impossible. |

I'm trying to understand your point in full. I think we are making an assumption that there is an amount of tax that should be paid for a type of house. That is not the law. There is no law that values the tax to be paid as a function of the house being built. They might use this for business owners to imply you are not declaring all of your income but for PAYE it is clear unless there is no paper trail of the salaries and allowances the worker earns. I trust my union, anyone tries this nonsense will hear it. |

Yansham: Just for clarity, did you mean your tax clearance from Delta state was what you used when Lagos State asked you to pay a tax of 2.5m? Is tax clearance from other states acceptable by Lagos state during the building approval process? Yes. By law you don’t pay double income taxes. If you don’t work in Lagos you are not supposed to pay taxes in Lagos. Don’t forget that there are other significant charges during the process that are not income tax. I will encourage anyone to fight their case if they paid their correct taxes in other states. Maybe if the value of tax you paid is small sha o they might frown at it. For me I had paid taxes to Lagos for 15 years before then even for a period when I wasn’t working in Nigeria so they really couldn’t complain. |

My wife's boss faced the same, he was able to scale through because of more than 30 years of tax payment both as an employee and employer..
A man like that was supposed to get a tax cut, but they denied him that.. Meaning they still indirectly got something from him.
The people (both public and private sector workers) in this country have turned the country into a product they have vowed to make profit from whichever way. When I was going to start my project in 2020, they assessed a tax of about 2.5 million because for 2018 and 2019, my tax state was Delta State due to my work location. All I did was send them my Delta State tax clearance for those years and that settled it. I joke with my colleagues that with the amount of tax I pay to Lagos State, they should be calling me every morning to ask what they can do for me. This is not bragging before brag-police come for me o, just to show that my PAYE is enough to sort all tax issues with LASG without paying a dime more. |

Imagine an ₦100k salary earner that has worked for about 5 years building a house in Lekki phase 1 worth ₦150m, without you thinking so deep, do you think his or her tax for that 5 years should cover for such build? I still am not comfortable with this though. Taxes should not be at the whims of those guys especially in the case of PAYE. I stand to be corrected but I don’t think there’s any law backing up such. If it is self-assessed tax for say a business owner then fine but an employee in a corporate organization should not be made to pay more tax because he’s building a house. |

somehow: If you're a salary earner, try getting your tax clearance certificate for submission. If not enough, they will get intouch with you.
If you're a business owner and have been paying your taxes, get your tax cert submitted to them too as stated above.
If you have never paid tax before, just wait for them to send you a letter or employ a tax expert to help you handle that aspect. The first line, why would a salary earner’s tax not be enough? It’s PAYE and should be accurate based on earnings |

Kingdemu: The setback here is having no hot water early mornings and late evenings as someone wrote has been his experience with the solar water heater. I believe solar water heaters come with different tank sizes so just buy an appropriate size and it should have hot water until the next heating cycle. I use something that approximates this though the heaters are not solar heaters. I have 2 x 100 liters central water heaters and the power is designed to come on for 45 minutes every day from my inverter only when my batteries are full. I also have an option for mains power on it which I never use because I never need it. I always have hot water with the 45 minutes heating every day from my solar inverters. |

Provided the woods are matured woods, the real danger is not that they will lose their strength (they will eventually), it is that they’ll warp so badly that using them on your project will be difficult or impossible.
