SmartyPants: 1. There is no need need to seek for a legal interpretation of practice. The first canon of interpretation is that ordinary words must be given their ordinary meaning and technical words must be given their technical meaning. Within both contexts, it is clear what practice means, i.e the application of one's training.
Having said that, the key is that one cannot practice as a Solicitor going by that povision.
The Act is available online.
2. As a trained law graduate myself I can tell you categorically that at University level Law is a theoretical and academic pursuit that teaches you more of the what and the why but less of the how. upon graduation you are only marginally more enlightened as to the how than the layman. This is the reason we then proceed to the Law school/Bar school, where we are trained on the hows. What law School does is to teach you procedure. That is basically what you need in Law practice. Procedure deals mostly with interactions with the courts, filing of papers, preparing pleadings, making appearances, etc. These are the only things you do not learn in the university. If procedure (and bits of legal drafting and conveyancing) is what is taught in the law school, it stands to reason that your University training has given you enough knowledge to stand you apart from the non law graduate. There is a reason you must take a minimum number of core courses. On interpretation, while ordinary words must be given their ordinary meanings, where there is ambiguity as to how I understand the ordinary words what then happens? I have my views as to what practice means. As an example, is a person who has been called to the bar but is working in a paid employment practicing law? Who has the right of appearance before a court, who indeed is a legal practitioner? Practice therefore is not that clear cut Sir. |

SmartyPants: See, those who work only with their law degrees are akin to a person with a degree from another field doing the same work. For example, a degree holder in biology can read a few articles online and go on to draft contracts for people. That is fine, and it doesn't make them a legal professional.
See Section 2(1) of the Legal Practitioners Act copied here under:
2. Entitlement to practise (1) Subject to the provisions of this Act, a person shall be entitled to practise as a bar‐ rister and solicitor if, and only if, his name is on the roll.
While there is some merit in your analogy, i beg to differ on the interpretation that you have ascribed to S.2(1) of the LPA (LFR). It may take us further to check the definition clauses to determine how 'practice' has been defined. What does practice include? However, I will rather stick to your postulation for the time being. Kindly note though that it will be stretching it beyond reasonable proportions to assume that a person with any other degree will be able to take up the function that a trained 'law graduate' will be able to carry out. |

SmartyPants: 1. The write up says he is described as having graduated from the Nigerian Law School 2. You are not a lawyer, which he has described himself as, until you are called to the bar 3. You only become a barrister or solicitor when you are called to the bar. That is why the title reads: barrister and solicitor of the supreme court of Nigeria. Unlike in England, the roles of barrister and solicitor are fused, and even in England there are formal post-university training programs for both solicitors and barristers that is equivalent to the bar program in Nigeria.
To cut the long story short.
A law degree does not make you a lawyer nor does it make you a solicitor. It makes you a holder of a law degree. Interesting. So those colleagues who are working with only their Law degrees, what work do they do? Is this your position supported by the Legal Practitioners Act? If yes what section of that Law are you making reference to? I submit that while most people I know have proceeded to the Law School after their final year at the university, a few have stayed back and worked with their Law degree and they did solicitor's job which basically has to do with documentations, agreements, Land matters, etc. They can only qualify as Barristers after being called to the Bar. The distinction you made about about the position in England is apt and tends to speak to the line of reasoning most people have around that position even here in Nigeria |

NOC1: Are they talking about being a lawyer or a barrister?
People mistake this two things, however I read where they said he went to law school, he might have, but didn’t pass, so you can’t see his name on register but that doesn’t stop him from answering a law graduate.
On his biography as pasted here, he never claimed to have graduated from Law School, he ended it at his University degree. If that’s what he has been using to work he has no problem.
Is just like an Engineering graduate who is not registered with COREN you have Engineering degree but you are not a registered Engineer but not human can stop you from saying you graduated as an Engineer from university.
I know same is applicable to pharmacy and Accountancy Spot on. On the bolded, replace 'lawyer' with solicitor. Lawyers are called to the Bar of the Supreme Court of Nigeria when they have passed from the Law School and become qualified to be registered. Upon graduation from your university, you become qualified to practice as a solicitor and shall not appear before any court of record unless you have been called to the Nigerian Bar. Just stating the position as it is at law, I am not interested in the substance of this matter or the party affiliations of the dramatis personae |

I am on the island, working from home since March. I want to get away next weekend so I will do Lekki - Epe- ijebu ode-sagamu-ibadan. Same route while coming back. My strategy has been more on how I travel outside Lagos through the airport at ikeja and I have resolved that I will leave island the day before, stay in a hotel close to the airport, I usually do Ibis, and then get into the airport early. Most important is the need to ensure that I do not travel except it is absolutely necessary. In my head there are not more than 3 more trips till end of year...one trip to Abuja soon, new yam festival in September and Christmas trip.
Can someone please confirm whether those hotels are now operational? I have been having limited contact with civilization...I drink at home or an estate bar, buy from the supermarket and generally stay indoors. This scam will soon be managed by God's grace. |

Essentially I believe a choice of a tablet is between iPads and Kindles. I think most people don't use tablets because a majority of persons have a smartphone and a laptop and the go-between (tablets) seem out of place. So true. I have 2 samsung galaxy tablets that my employer (company) foisted on me and they are here lying fallow. I use my smartphones for my mails and when i need to sit down and work in earnest I deploy the laptop. I wish I can sell them off without repercussion. |

fairfora: I concur with you with no apologies to my fellow yorubas but this crime is everywhere too. This nonsense has to stop. Last week Tuesday, my ibo friend's brother was abducted by rirualists and taken to ijebu area. He boarded the popular danfo yellow bus at ikeja along b/s and that was the last he could remember. On getting to the ritualists' den, he was stripped naked and his phone was taken from him but before then, he forcefully attempted to call his brother after regaining consciousness the moment they got to the place the phone rang and as he was trying to explain, they slapped him and collected. his brother asked what happened as he was hearing some background noise, and the phone went off. He kept calling to no avail. His brother said his sim was yanked off and thrown to one side where heaps of sim cards were sighted. He said he saw loads of shoes belonging to their victims they've killed, including school uniforms. He met some people there as well on their death row. People were killed in his presence. He said everyday, people kept coming to buy parts he concluded this business is done across the tribal lines. He said the accents of those who came suggested some of them were ibos too apart from yorubas and others.
To those who claimed God doesn't exist, I'm so sorry. Many have been wasted in ignorance under such a circumstance as this. His brother is a pastor in one of the pentecostal churches and he called his team to join him in prayers, including vigil. One of the pastors said his brother would come back home safe but prayers must be intensified.
My friend called to inform me and informed my pastor too who said the same thing, that his brother would return because he saw him in the midst of killers and the whole place was surrounded by blood that I should ask them to observe dry fasting but not break until 6pm of last Wednesday. My family also joined them in prayers. On the third day evening, he returned home. He narrated his shocking story. He said when he boarded the bus, discovered some passengers were sleeping but he wasn't bothered so he entered and that was all he could remember until when they were brought to this desolate den of ritualists. He said they bring people there everyday and people were being killed everyday. So, the killers would come to their midst and pick at random so he was picked the 3rd day. He was left with his boxer's shots and the "killerman" used a charm to touch his forehead and shouted suddenly that, but I've told you never to bring people like this to this place oya, return him now. That was how he was taken to a far place where he was dumped. He had to trek a long distance before he sighted a town. He now begged peope for money and clothe to cover his body. That was how God saved him.
Those idiots pick people everyday. People get missing everyday and never return home again. Many have been declared missing before and were never seen again. There are tirualist dens all over the country and this isn't peculiar to a particular tribe. Along owerri-port Harcourt Road, they kidnap people and taken into the den of killers around too. I remember a day I was going to bayelsa from owerri. I boarded a sienna car by NNPC at control area in owerri. The driver said somebody should lead in prayer after which he narrated what happened in that axis a few days earlier when a passenger bus was waylaid and all the passengers were marched into the Bush and were killed except a young girl who managed to escape with gunshot wounds in the night. Our politicians know these killers but would never reveal their hideouts because they patronise them. I remember a police commissioner deployed to ogun state at a time who exposed 2 dens. The man vowed to discover more via aerial helicopters surveillance.
This officer didn't let 6 months before he was transfered elsewhere. When you want to enter a public transport my people, either in lagos or elsewhere and you find some people sleeping, please don't enter and always pray for God's protection.
My friend said police also tried but couldn't do much. He said they could only track the last location when his brother last called him and said it's ijebu area. They kept saying they'd deploy their men there but never did as they were said to be awaiting the ogin state command's readiness. You sef believe this movie script as real life story abi? |
