You must understand that consent is a question of fact, and not law (with the exception of minors and disadvantaged persons where the law automatically presumes the absence of consent). Since its a factual issue, there are several factors that will be considered to determine whether consent was actually given. For example, consent, whether express or implied, can be withdrawn at anytime. You may also examine the mental state of the parties and several factors. The Tboss issue is not as straight-forward or as simple as you may think. It throws up many moral, social, religious, cultural and legal issues, which is why public opinion is largely divided on the topic. As you can imagine, each issue is extremely complicated. The only way to have a constructive discussion on the issue is to identify and address the various issues for what they are. |
Consent can be express or implied. It is express when there is a definite statement conveying the consent which is understood by everyone involved. For example, you ask someone for a pen to write with and the person says you can take it. Consent is implied when a person acts in such a way as to give the impression that s/he has agreed to something which a reasonable person would understand to mean approval. For example, you make a writing gesture to someone and the person nods and smiles. The problem with implied consent is that it can be quite ambiguous and subject to misinterpretation which is why there is a consideration as to whether a reasonable person would understand the actions to imply consent. |
