Yes, there are also two sides to a story, but something if prosecution rest, without even calling the defense, you will know that prosecution has lost the cast base on their arguments alone...so I am calling this for the guy that he was not stalking OP and to the extent that the guy's activities might have been irritating to the OP, the OP allowed and encouraged them and the OP refused to take the necessary and simple steps to stop them. |

Prymestrr:I do not know why, it should be the OP's place to plead on behalf of this guy...just as much as she should not ask that he should be fired, he should not use that emotionally charged atmosphere to influence the Boss to retain this guy. All companies have standard polices regarding things like these, leave the company to take whatever action they want to take. The Boss might felt pity due to the OP's pleading and retain this guy, but people like these are a liability to the company and the company will pay big time down the road. |
OP, it is people like you that makes majority of folks to think twice before helping someone in need. Now that, you have almost made up your mind about not honoring the Boss' invitation, guess who might loss their job if that perverts retains his? Yes! the poor security guy; the same guy that you complained to about your bad experience; the same guy that consoled you and offered to do something about it, yes! the same guy that went out of his way to do something about it. That Manager will work tirelessly to frustrate that Security guy, because he will now see him as a hindrance...All because you chicken out and your actions now effectively throw this poor security guy under the bus, whose only crime is that he help a sister in need, by trying to right the wrongs done to her. I understand your fears, but they are baseless, you are not going to ask for the manager to be fired (and who cares if he gets fired?). You are going to tell the Boss what happened to you, all you need to do is tell your side of the story and leave. If you do not want to go, at least write them a letter and drop it off at their office; thought, I will recommend you go. Sooner or later you have to face or confront your fears in life....And if you cannot confront this guy that you barely know and wants to take advantage of you, I do not know if you are capable of facing life itself. |

Yahaya was a safer bet for APC under these circumstances, but that does not mean that APC is out of the woods yet. Yahaya is just the best hand they can play in this situation. Now, if you go by the Electoral Act, there was no provision for the replacement of a candidate once polls have opened. The Act never anticipated the need for that, In fact the Act clearly stated that once polls are opened, you can no replace candidates...so that is where Faleke will have a case...Yes Faleke cannot inherit the vote already cast, but his case will be to fault INEC for allowing for the replacement of candidates after polls have been open and not because APC did not chose or that he have a claim to the votes already cast. With that, the best that can happen is that, the court will cancel the elections and order a new one...I believe this will be PDP's argument also, but Faleke will help them to make it. |
dominique:I understand your point, but that is not the definition of special needs, else most people will fall into that category e.g. People who use glasses, etc. In this situation, special needs will be an individual, who the institution have to make additional accommodation towards that is not done to every other students, in order to meet their needs, and people in this category often request for this type of special accommodation. She was just fine, did not request for special accommodation, all that happened was she forgot her hearing aid. And here is the real discrimination, if someone who can see moderately but have poor eye sight that prevents them from seeing far off e.g. sitting far off in the lecture theater; walks into that medical examining room without their glasses and they tested their ability to see further, to see if they can cope in the lecture room and that individual fail the test, do you think they will send that person away from school? The reasonable response will be to ask that person to go bring his/her eye glasses, which would have been the same response here. |
When I read 'Dislodged Boko Haram member been captured in Lagos', I had to quick quick look up the map of Nigeria to see if Borno State or Lake ChAd now shares border with Lagos...you never know, with these new state creations, mergers, etc, it could be possible...but it wasn't, my only guess is that those guys must have taken the next flight out if Borno to Lagos. |

danny56:All that does not matter, what matters is INEC declared the elections inconclusive...had INEC declared Audu a winner, we will not be debating all these, because Faleke would have been on his way to be the next Govornor. Secondly, even if Faleke withdraws; the votes cast cannot be invalidated because in Amaechi vs INEC, the Supreme Court have ruled that, vote cast are for the party and not necessarily for a specific candidate, so APC would have easily chosen another running mate for Bello, so it will be Yahaya's lost. Thirdly, Yahaya can never be the Govornor, since he did not participate in the primaries, the electorate laws forbides him from becoming the Govornor, so if he takes PDP to court and by some miracles he wins, the best case scenario will be new elections, there is no scenario that will make him inherite the votes already cast and through them became a legally binding Govornor, even if APC does that, they will lose the Govornorship to PDP through the court system. Fourthly, Yes Yahaya can sue INEC for some errors, the truth is that, INEC would have easily called the election for Audu and declare him the winner because, it is impossible for PDP to win the rescheduled election giving the small amount of registered voters, but the reality is INEC did not do that and that call is subject to INEC's discretion i.e. They did not err or violate any law by not declaring Audu the winner, in essence you cannot sue them over an action the law have given them discretion over, so Faleke will come back empty handed. So, Faleke's only choice here is to remain the debuty or withdraw his candidacy and save any legal fees, he intend spending. |
raumdeuter:PassingShot is correct, if APC make Faleke the candidate they will to PDP in the court, because Faleke did not participate in the primaries as required by law. The cases you cited are not similar to the one at hand and as PassingShot had noted; if INEC had declared Audu, the winner of the election before he passed, even before he was sworn in, constitutionally Faleke would have been the neck Govornor and that situation would had be been similar to the cases you cited. I do not think APC like this choice, but legally they have been boxed into a corner donot have many viable alternatives that will stand the test of the law. Note that, regardless of this choice by APC, PDP will still go to court after the election, so knowing that, it will be foolish for APC to weaken their chances of winning. |

It is clearly stated that, INEC can only give return certificate to a candidate who pass through all the nomination proces, including the primaries, Mohammed did not fit that bill. And, they cannot conduct a new primary, the window for that has closed. So, APC is in a pickle, their only choice is between Yahaya and Faleke. |

It is myopic of you to compare the America Jurisprudence to that of Nigeria. America do not prosecute gays, do you want Nigeria to also not prosecute gays? The laws in both Countries are different, moreso in the case of the WTC, the FBI investigated and did not find the Engineers criminally responsible or negligent, hence no charges were filed and there was a direct external force (two ariplanes) that impacted the building. However in the current case in Nigeria, there was no external impact, moreso the four Nigerian Agencies (The Coroner, NBBRI - Nigeria Building And Road Research Institute, COREN - Council for the Regulation of Engineering in Nigeria and BCPG - Building Collapse Prevention Guild ) inspected and investigated the situation and found the construction Engineers and owners liable and the Coroner then recommended that, they be prosecuted. In addition to not obtaining building permit, they also found the following inadequacies: 1. Inadequate beams of 750mm by 225mm (should have been 900mm by 300mm) 2. Inadequately reinforced columns (should have been reinforced with 12 x Y25 bars or 20 x Y20mm bars. Instead they used 10 x Y20 bars (as seen in the video released by SCOAN). 3. Inadequate bearing pressure for the central column due to the 2m x 2m x 0.9m foundations. 4. Failure to introduce rigid zones for bracing the structure and did not design the frames as an unbraced structure. 5. Failure to provide movement joints that could have absorbed any movement due to creep, contraction, expansion and differential settlement etc.. 6. 8 out of the 12 main beams of the structure failed because they were undersized, under-reinforced (both in tension and shear), the tension bars were poorly anchored to the column supports and 8 x Y20 was used instead of 14 x Y20. 7. The ground floor columns were slender and readily gave in to buckling. Regarding the 'Controlled Demolition Theory'; The Lagos State Fire Service carried out a 360 degrees survey and found no evidence of explosives, the Investigating Police Officer said, there was no evidence of the use of explosives at the site of the collapsed building, nor perception of any smell of explosives. The so call hovering aircraft theory was also debunk; the aircraft was flying at altitude of 1100feet, which is about 109 floors, i.e 103 floors higher than the 6 storey building, also the flight path shows a horizontal distant of about 137 meters between the plane and the building; therefore, the Aircraft did not actually hover direct above the collapsed building. NBRRI stated that..."the building failed as a result of the ground columns yielding due to excessive weight on the 750mm by 300mm columns and the 10 x Y20mm bars".....The BCPG stated that..."the a sudden and complete collapse of the building was inevitable because the building was not robust or stable enough and that a column failure by buckling can result in a sudden collapse like the one witnessed, more so because there were no rigid zones within the structure. They refused to take the necessary permits needed to construct such a building and made numerous engineering blunders and you call it natural? Now, the major reason that, people are focusing on the 'a minor at 17' is because, that is the undisputed fact in this case. The issue of rape, gang rape, etc is she-said, he-said and the truth is, no one here knows what really transpired behind those closed doors. Secondly, you have a very wrong view about rape; when you surmised that....it would been raped if she was deceived into it or forced irrespective of age. I see you as an intelligent individual, and for you to fumble this badly on a clear-cut definition of rape as it pertains to the Nigerian penal code is troubling; this fact is crystal clear and not subject to a debate, it clearly shows that you are not objective. In the Nigeria penal code, the age of sexual consent is 18; any such act done before the age of 18, even if it was one day before her 18th birthday, irrespective of the cooperation/consent of the minor involved is called rape period! The Nigeria penal code did not mince words about that, it is clear and direct. Thirdly, I sincerely believe that Mrs. Audu should fire their current lawyer and hire another one. Any lawyer that advise his/her client to release emails, or private contents publicly, is not worth their billings. You do not win cases on the blog or internet and anything you post publicly can be used against you in the court of law...my advice is for them to delete all those emails and chat and believe me, there are lots of damning evidence there...In a bid to prove her rape allegations false, the released contents have substantiated that she was a minor when these started and that offence is punishable in Nigeria by prison terms. Also, Mrs. Audu in her response has admitted against self-interest that, this lady has a mental issue and that, she will reach out to her to get her some help. I see an opening here for a good lawyer...because section 282 (1) of the sharia penal code in Nigeria states that, having sexual intercourse with a girl of less than 14 years or with a person of unsound mind, whether with or without her consent is rape. The truth is, both sides seems to have committed some crimes, she must have embellished the truth and accused them of some acts that might not have taken place or exaggerated some events, but the Audus by their own admissions have committed some offences here. |

I have read Sugarbelly's accusations, your prior post detailing edited emails, then this Mrs. Audu rebuttal; the truth is, non of these proved that Sugarbelly's accusations are lies, neither did Sugarbelly's story proved that, she is telling the truth either. But, one thing caught my attention in Mrs. Audu's rebuttal and that is her trying to curse Sugarbelly and wishing that all her accusations befall her in this life. As Africans, we do not take curses likely and some often fall back to them to prove their innocence and to portray that, the other side is at fault, and the rest of us sometimes takes the one doing the cursing seriously, because it is usually seen as a two edged sword...and no one can purposely wish themselves harm by invoking curses and damination. Surprisedly, if you read Mrs. Audu's curse, they are one sided and does not contain a test as to the truthfulness of the accusations...When I saw the topic heading about 'Mrs. Audu ....Cursing...' I was expecting to read her say it, the way we proclaim curses in Africa i.e. I was expecting to read something like... "If my husband did not rape Sugarbelly (or cause her to be raped) as he is been accused, may all the ills that Sugarbelly is talking about befall her in this life, but if my husband raped or had a hand in her rape, may ills, bad furtunate, e.t.c befall my husband and may such happen to my future daughter" Something along the above, will have given her curse more credibility, because she would been seen as having a stake in it depending on the side that is right. You can now see, why some people, myself inclusive are on the fence on this matter; because there is nothing out there to collaborate each side and please, do not be too invested in this case...only Audu and Sugarbelly knew exactly what took place, and each side will attend to present their case in the best possible light, while withholding elements, testimonies or evidence that will put them in a bad light...this is natural and it is just the human nature, we are all created to preserve self first and there is nothing wrong with that. |
