laudate: That is why I said it would be interesting to see what Fatoyinbo would say, when he is cross examined. If he breaks down and confesses on the stand, that he sexually assaulted her, when she was under-aged, would he be convicted or not?
What about the fact that her brothers and sisters confronted Fatoyinbo after the incident in Ilorin? Didn't you hear that the brother threatened Fatoyinbo, with a knife?
Didn't you hear that some COZA pastor's had to apologise to her family after that incident, on behalf of Fatoyinbo in Ilorin?
When all this comes up in court, and all these witnesses decide to testify against Fatoyinbo, do you think he would not be found guilty?
Finally, Bill Cosby did not state that he used drugs on that particular lady, who filed the case against him. He only admitted to using drugs in the past for casual sex encounters.
Just like Fatoyinbo, Bill Cosby also initially denied sexually assaulting those women. What happened at the end of the day?
Cosby admitted to drugging several women over the course of 2 decades. This particular woman's testimony was consistent with what the previous victims described. This is beyond circumstiantial evidence, it is solid evidence. You won't have such luck with Biodun's case. Goodluck getting those senior pastors to testify in court. You sid her brothers went to his house and threatened him when the incident occurred, yet her own testimony shows that nobody knew after the first incident, nobody knew after the second incident. She even went to take care of the pastor's wife after she gave birth to her first child. As a person with a functioning brain, you too reason am. Does this not sound like a conflict? When did the brothers find out? When did they threaten him? If they knew from the start, why did they allow her to go work for the perp's wife? I know in theis country we like to believe in fairy tales but absent of actual confession(unlikely), it would be a monumental task for any judge to find him guilty! |

laudate: He said it didn't happen....and that is what every suspect or every criminal says, when their crimes are first revealed.
Go to any police station. Even when anybody is arrested for committing a crime, they will first of all deny it, until evidence is produced. So Fatoyinbo's denial is nothing but a watery excuse.
He never addressed the specific details the girl mentioned. Neither did he provide any alibi for the days and events that she stated.
Yes, it had been many years since the incident took place. So any evidence from that time would be non-existent by now. But Bill Cosby in the US was sentenced in 2018 for sexually assaulting women in 2004. Which forensic evidence was used to convict him?
I do not expect that Fatoyinbo will be convicted, but I do expect that the whole truth will be revealed in court, and everyone will see that Fatoyinbo is lying, from whatever stories he decides to share on the witness stand, when he is cross-examined. Lol...You're funny. An incident that occurred 20 years or more ago, you expect him to give specific details of events from then? Are you alright? Let me ask you on July 5th, 2009, what did you have for lunch? Who did you hangout with? What happened that day? Can you see how silly your statement sounds? You do not expect him to get convicted but you expect the truth to come out, may I ask HOW? You mentioned Bill Cosby but you didn't acknowledge that he confessed to drugging the woman. You never found out that his purchase of the drug was traced, countless testomines from women claiming he used the same drug on them. You're seriously using that as a premise for this case? LMAO! |

laudate: She gave details, timelines and vivid description of how everything occurred. The pastor could not provide any concrete defence to refute her allegations. He only gave a watery set of excuses. And then stepped down from the pulpit.
Anyone who believes he has been falsely accused, would not be sitting down without making stringent efforts to clear his name. If I were in his shoes, and someone made such false claims against me, such a person would be behind bars in 24 hours.
Fatoyinbo does not have the guts to arrest Busola or sue her for defamation, because he knows she is right! In any sane climate, once you are accused of something this serious, you step down! Let's not use our 9ja stubborness and behave absurdly. He already stated that it did not happen, what more do you want him to say? In advanced countries when you accuse someone of a crime, you provide credible evidence to back it up. Your testimony of an event from 20 years ago with no independent witness, no rape exam, no shin shin is USELESS. All it gets is public sympathy, it would be interesting to see the judge that would convict him absence of real evidence! |

Freehuman: Not my business as a prosecution . I'll just tender circumstantial evidence which is the only evidence I'm likely to have, the defense counsel counters it and the Judge delivers his judgement. My argument has never been whether the evidence has weight to secure a conviction against the accused, my argument is that there is circumstantial evidence available contrary to public opinion that there is no evidence. Whether it has weight or not is another issue . Oh ok, in that case you're right. Her testimony alone is evidence, no argument here |

laudate: I believe she is telling the truth, but legally speaking she is not likely to win the case, as the hard evidence would have perished long ago.
Eye witnesses that could testify in her favour, might also decline to come forward, if they are afraid of the controversy that could ensue.
It would be interesting however, to see the kind of defence the pastor would put up, in court. Can you name one logical/factual evidence that shows she's telling the truth? No sentiments, no emotional bias just straight up evidence. This will be the determining factor whether the case even makes it to court or not. |
Christianity Etc › Re: Timi Dakolo Married In My Church, I Knew Of The Rape-Pastor Yemi Davids by abbey621(m): 1:36am On Jul 05, 2019 |
Freehuman: When there is no direct evidence, the court has ruled, in many cases, that circumstantial evidence is enough. In the absence of documentary evidence oral evidence is enough. A reasonable man does not expect a gathering of elders and laymen to sign a document during a resolution, testimonies of the witnesses are sufficient.
I intended to address your submission that there was no evidence she could tender. Whether the evidence carries weight or not is the sole discretion of the judge after all the Job of the defense counsel is to make the evidence weightless.
And mind you cultism is related to the case. She said that when he was about to rape her , she wasn't seeing the pastor in him but she saw a cultist that he had always talked about being which made her keep quiet for fear of her life and that of her family members. The court does not know the meaning of forgiveness. Cultism is a crime and punishment is imprisonment, he cannot deny the allegation of cultism which he admitted. Telling your congregation that you are no longer a cultist does not absolve a person of the crime of cultism. A formal surrender or submission to the state through the police force would be a genuine proof of abstinence from cultism. Cultism therefore becomes the fact that induces fear on the victim. The Evidence Act does not only make facts related to the fact in issue admissible but also facts related to the facts related to the fact in issue. Sorry but you're mixing apples with oranges. There's no way the cultism angle will be used to convict someone of a rape that happened over 20 years ago, absence of any other strong evidence, there's just no way. Not in America, not in Nigeria! Now when you consider that the pastor is loaded financially and m,ust surely have a strong legal team, the case would be nothing but a circus show that would lead to no criminal verdict. Civil case is another matter, civil case they could use his promiscous nature and past against him easily but criminal, forgat am! |

Freehuman: Attached to this comment are screenshots of The Nigerian Evidence Act, 2011.
Under the English common law received into Nigeria by the Supreme Court ordinance of 1914 and Interpretations Act in section 45, Bukola Dakolo would have no case because of the common law doctrine of Res gestae which rendered Criminal cases useless if the evidence was not contemporaneous in time and place.
The law is dynamic and evolves to serve situations like this, thus the enactment of the Nigerian Evidence Act which renders the rules of common law void when it is inconsistent with the provisions of the Evidence Act.
Section 4 of the Evidence Act, 2011, attached below provides to the effect that evidence which occurred at a different time and place related to the fact in issue is relevant and therefore admissible in court.
Thus, the provisions of that section when read in Pari materia with sections 5-10 of the Evidence Act, makes circumstantial and character evidence admissible in court.
This is not an American Legal movie where videos (documentary evidence as defined by section 258 of the Evidence Act) and forensic evidence are required. According to the acclaimed victims story, her brother went to make trouble at the residence of the alleged predator when he became aware and there was settlement. That very act and testimony of witnesses of that act and the terms of settlement after the victim's brother's action, the involvement of the suspect in cultism at about that period is enough if corroborated as circumstantial and character evidence to prove the case. Even a baby lawyer would find it easy to get the case dismissed. What was the terms of the settlement, what method was used to make payment? Any written communication? Strike out the cultism factor because it has no bearing on the case, at the time of the alleged incident, he was already known as a religious influencer, in fact the victims own testimony would back that assertion, she felt safe enough to open the door for him. Listen well, circumstantial evidence is hard enough to be a basis of sound legal judgment not to talk of the witness relationship with the alleged victim. I SURE HOPE IT GETS TO COURT....Lol. |

Freehuman: A criminal case is not statute barred whereas a civil case is statute barred , that is , May not be entertained by the court when an action is commenced by the plaintiff through his legal practitioner after the time provided for by the law.
A case like rape cannot be instituted by a legal practitioner on behalf of Bukola Dakolo. In criminal matters, the state through the Attorney General, police or Director of Public prosecution is responsible for bringing the matter to court. However, the exception to that rule of law is that in extreme cases where the police or ministry of justice have failed to act over a certain period of time after their notification, a private legal practitioner can commence an action after receiving a special fiat from the Attorney General (commissioner or minister of Justice as the case maybe ). Let's not complicate matters, the case is simple. Prosecution, prove your case! This simple statement might seem like nothing but it basically renders the case dead on arrival. There's no physical evidence apart from her testimony, no DNA, no eyewitness, NOTHING! Anything short of his admission, there'll be no criminal indictment. |

Kalixx: The pastor doesnt owe anyone how he lives his life. Why should he decide to block the temptations? Do u block ur own temptations? Whose life is it? Why not start by telling the ladies to eliminate themselves from constituting being a temptation to him? Is having multiple partners against the law? U urself quoting, are u holy? Are u a virgin or a virgin till u married?
My point is, how do u know if his building of d church and everything was his own strategic way to bcom successful, then u now tell him not to enjoy women if he chooses to? Its his life. If members dislike him; they can quit. No gun on their heads. Abi na You're missing my point, no one is telling him how to live or not enjoy women. Heck let him live wild and free but let him also be aware that reputation is everything. People are less likely to defend you if you have a reputation for doing wild things. In this instance, rape is a very serious allegation. Some people crucify him not because they have concrete evidence but because multiple ladies are narrating their ordeals with him. From unwanted advances to illicit affairs, these makes it easy to label him as a bad man. Furthermore, you think you are talking about a mere man here, this is a senior pastor. His title makes him someone that would preach against immorality and so on, why do you think people wouldn't be upset when he acts immorally allegedly or confirmed? It's like a doctor preaching against obesity while weighing 500kg....lol |

DeLaRue: Actually, depends on what you call deep. The ocean is probably less than 2000 metres (2km) from Novare. 2kms of low-lying flat land is no barrier for a raging ocean. Standing less than 30 metres from the ocean, I could see Monastery, a landmark in that axis. Monastery is probably not more than 500m from the shopping mall.
Thinking about it again, it seems the mall and the immediate area including the Lekki Epe expressway sit on a small elevation, which might offer some protection. However, everything up to Monastery is very vulnerable, I think. The mall is more than 5km from the ocean, even monastary is more than 1km, I think the only people truly in danger are those on Atican and Okun Ajah. |

I know people react differently to Trauma but in all of 20 years, she didn't bother to confide in her parents or siblings? I keep hearing people say, why would she lie but just listen to the story, raped not once but twice, after being raped she went to work for the pastor and his wife. Continued to worship in the church and up to date no one, not even her siblings or friends could mention she confided in them 20 years ago or 15 years ago.
Yes we can all crucify a man because well let's face it he's a man and men have been known to be guilty in 90% of all rape cases but we've also seen cases where a man was sent to jail for over 2 decades for rape allegations only to be found innocent. In the end, this man only has himself to blame for being so loose with women and not taking his profession seriously enough to block out the temptations. Hope he learns his lesson! |

DeLaRue: Last year, I was in a group visiting a location behind Novare Lekki Mall (the last Shoprite on the Lekki-Epe Expressway). I had to excuse myself as we walked towards the ocean which was about 30 metres way. I just couldn't go any nearer the ocean.
I was shocked by how low-lying our location and the entire area up to Lekki-Epe Expressway was, in relation to the ocean. The ocean was literally above me, by at least 3 metres . This means the day this aggressive ocean surges, everything along its path up to and beyond Lekki Epe expressway could be under a huge body of water in no time. The threat is real and the result could be unprecedented in terms of loss of life.
Just thinking of the worst case scenario in the event of a deadly ocean surge in that area is horrifying. And nobody, not least the government, seem to have taken notice. You must have really gone deep behind Novare, I mean really deep for you to see the actual ocean. Areas close to the Expressway or the mall are safe but you see those building along Atican beach and the coastal line, it's only a matter of time before mother nature does her thing. |

how old was guy when this happenned.was he 20, 21...? The legal age in Nigeria is 18, anything below that and you're risking JAIL. Even if the girl walked around butt naked, you still have no right to sexually assault her. People who state that rape victims should not come out immediately are part of the problem. In any other incident, we would scream for legal justice immediately but because this is rape, we are saying the victims are too traumatized to get a rape kit/test done and file a police report? The fault here is not just at the alleged offender but the parents of the victim and the victim herself(a lil bit).
Bringing up an incident of many years ago where the evidence no longer exist and judgment is taken out of the legal context and given to the public will always end bad for both the victim and the accused. How does one prove an incident of over 10 years? How does one prove innocence against allegations brought by a female with a large following?
The best the man can hope for is to resign and hope this does not punish his wife and children. GUILTY or INNOCENT, justice here is a one way street where the victim, her gender, her popularity and first attack makes her much more credible than a pastor who is a flirt with big pockets. If the man truly feels he is innocent, then he should drag her to court and let it play out there, one thing with blackmailers is that once they are put to true legal scrutiny, their stories often fall apart. This is perhaps why going through social media is the smartest method she could have used to achieve her motive, good or bad! |
