The most credible sources I have are confidential or requires subscription(LexisNexis, FBI database, Justia) due to the nature of my work(auditing), if you are willing to spend money on subscription to statista.com, you can also find more stats there but a simple search online shows that only about 5% of divorce cases in the USA actually involves a prenup

You are also right that duress must be proven by the party who claims it.

The key message here is that people should be aware that prenuptial agreement can be contested in court.

Everybody knows that it can be contested that was never my argument, he is saying all prenups are useless because the judge will side with the woman for any reason which is a comical way of reasoning. A competent lawyer makes sure all the conditions of the prenups satisfies the legal requirement and beyond.

Go back and read my comments, I said there's no way a judge can deny a prenup prepared by a competent lawyer, keyword is competent. In your rush to critique you missed that keyword, part of being competent is operating from a position that your client is the one with the burden of proof. A competent lawyer not only insists that the female also has a lawyer but there must be witnesses and a notary. A competent lawyer advises his client not to get a prenup so close to the wedding but to do so with at least 2-3 months before to remove the presumption of duress.

When talking about duress(coercion), I am well confident when I say less than 10% of all prenup related divorce cases in the USA are thrown out by a judge for duress, in fact those cases also involved outright illegal activities such as bullying, fraud etc, if this is your evidence that all prenups are a waste of time then you're a joker! Finally, my argument was never about the dismissal of a prenup but one created by a competent lawyer, there's a big big difference, yes we have exceptions but stop acting like those exceptions invalidates the remaining cases, that's a bullshit argument and you know it!

Claiming duress is different than proving duress, this is why a competent lawyer must draft the prenup, it must be signed by witnesses, be factual, fair and notarized. If all these things are present, the success rate of invalidating a prenup is lower than 10%, I challenge you to prove otherwise, this is not an argument, this is a fact based on experience and being conversant with the legal landscape in the USA, you don't have to agree

Partner LLC is the route to go. I was a S-Corp qualifier before I had to turned around and recertified under a new entity with a LLC. First in case you get sue by someone as a S-Corp your personal house can be included in liability settlement whereas with LLC only your entity is liable. The real kicker is in tax rate LLC corporate is 15% where S-Corp rate is your personal tax rate. That is why it is called Limited Liability Company

Not S corp, C corp! We are talking about two different things, even with multiple member LLC, you must instruct the IRS you want to be treated as a corp for tax purposes but with C corp, nothing ties back to your personal tax hence no divorce can affect you.

Are we talking about legally or are we considering sentiments? A prenup properly written by a competent lawyers, signed in front of witnesses and a notary will never be thrown out, California or not! You can't claim duress if the prenup was signed at least 2 months before the wedding and done in good faith. No LLCs are a no no, the IRS can still consider it as a nonentity if it is owned by an individual. A C corp is needed, it gives the most protection especially when you have a board.

While most men make most of the financial assets, the raising of children, keeping the household clean etc are part of the emotional investment in any marriage for most women. For a man to throw away a woman after all the years of emotionally investing in such partnership is an injustice. The court views marriages as partnership, both partners have equal shares in the partnership and when the business is being sold/liquidated, the proceeds must be split.

I'm not sure you read the sources thoroughly but the central premise is that there's no gay gene but a bunch of genetic factors that influences SEXUALITY. The vast majority believe the genetic makeup of an individual influences whether they are heterosexual, homosexual or bi. Sexual behavior is just about how someone chooses to express their sexuality but sexuality in itself is how a person sees him or herself which is what majority of the sources were alluding to.

You can't just make a claim without providing a credible source, disclaimed by whom? I think you've got backwards, prior to the mid 1990s it was believed environmental factors had more influence in shaping sexual orientation but from 1998 upwards, most of the researches have now linked genetics as the major influence. Again I'm not saying this is right or wrong, I'm just letting you know the results of recent research into the topic.

My number one concern is how old are the kids? As a father, I can't imagine not speaking to my boy for a week not to talk of months, so what gives? If your kids are old enough to talk, this age of technology they can send voice notes, MMS, recorded videos etc, expressing how much they miss daddy. Sometimes the best way to apologize is to do so through the eyes of innocence. If your kids are still toddlers and unable to speak, then you can still record videos and direct the narrative, apologize and even pray for him.

The vast majority of fathers out there can hold a grudge against their wives but find it very difficult to ignore their children. My advice to you is to forget about your external family issues and focus on your own issues. 9 weeks of not talking, for wetin?
