See, forensic science and morbid anatomy properly deployed will help reconstruct the story. An autopsy will reveal how sexually active he was before he died. His semen should be on the beddings. The defence team would sure have to do a lot to get her the minimum possible sentence. That act of withdrawing from the dead man's account makes it pretty difficult coupled with articles that suggest an attempt at identity concealment such as checking in with a fake foreign phone number and fake driver's license. Let her have her day in court and then I find it difficult to understand how an adult of 21 years of age would claim she stabbed someone in the NECK twice in self defence against sexual assault. Apparently the force is not commensurate to the threat.

1. The amount of blood that a man would lose before becoming unconscious and eventually dead is usually much. And a grown up man like Ataga knew the consequence of losing too much blood, so he would have attempted to get help if he was lucid.

2. In the event that he wasn't lucid enough to see the need to get medical help as a result of the supposed drug in his system, it would imply that he wasn't lucid enough to harm her.

A drunk man who is not lucid enough to escape the scene of fight threatening his life cannot be coordinated to engage in a physical brawl.

She claimed that Ataga used to take drugs but I want to believe that she introduced him to drugs perhaps to make it easier for her to kill him. It is unfortunate that Ataga is not here to tell his side of the story but it is not impossible that she laced his drinks with the drugs!

4. The most shocking part for me, is that she claimed to have killed her lover in self defence and she cleaned up, went home to her dad like nothing happened. She didn't have nightmares or behave strangely as to suggest to the dad that something was amiss.

This suggests to me that she is either a cold-blooded killer or she has the potentials and tendencies.

I feel for her, because no matter what she has messed up her whole life.

Thank God for your life that you aren't a lawyer otherwise these lines of defence will get your clients into trouble. These are my responses to your submissions:

1. Someone who accidentally killed in self defence wouldn't stab his or her victims several times. Usually, the intention in self defence is to destabilize the assailant and escape

2. Fear of what the law would say about having drugs in your system is not a defence in a possible murder or manslaughter case. It is never an excuse. There is a reason why drivers are not to abscond from accident scenes even if lives are lost. Leaving the crime scene without turning yourself in to the police leads to complications that wouldn't help the defence team.

3. Not leaving the State where the crime was committed is not the same thing as not taking flight from the crime scene.
Leaving the scene of the crime without reporting to the nearest police station for several days showed that she wanted to conceal her crime and evade justice.

Remember that she didn't even tell her dad of what happened even if she could have lied to her dad that she accidentally killed a man who wanted to rape her.

Further questions would reveal what happened to the blood stained clothes she wore on that day and the amount of blood at the crime scene.

Were there attempts to clean up the scene?

4. Assuming without conceding that the late Ataga gave her his pin while alive, the right to use that PIN and ATM card expires the moment he died to the knowledge of the girl.

How do you justify the "killing of a man in self-defence against sexual assault and withdrawal from the man's account after killing him in self-defence"?

A very good prosecuting counsel will take this girl to the cleaners fairly easily.

The plea of self-defense will not fly for the following reasons:

(1) Multiple knife wounds makes the self-defense line lame

(2) Not alerting the police authorities or the apartment managers about the attack on the man (even if it was for self defence)

(3) Absconding after the act

(4) Withdrawing from the dead man's account

Those 4 points will make it difficult for defence counsel to successfully pleas self defence as the reason for killing the man.

This lady will most likely get sentenced for murder or at least manslaughter. Hence your 4 years sentence is not gonna happen.

And remember that she was caught with a fake license and international number and these are additional facts that will establish her criminal tendencies.
