Abia state and indeed the SE has not been fortunate to have visionary leaders since the advent of democracy in 1999. This is largely due to the migration of the best brains and able young people out of the region in search of better opportunities in the diaspora therefore leaving the states to few individuals who have taken and control political sentiments in the states. Secondly, the electoral system has also made it difficult for the few visionary ones to win elections. Abia state is a typical example of bad leadership succession starting from Orji Uzor Kalu to the present day leadership. Today where is OUK? Imo state, a sister state to Abia was almost getting it right in the last election, considering the preparedness of Ihedioha for the job and the profile of the major contenders, unfortunate the process was truncated. Until the indigenes, home and abroad task this set of leadership, no meaningful development will be achieved in the SE

I think the SC was constrained by the constitutional time frame window within which to resolve election cases, hence the rush to conclude and make a pronouncement based only technicalities. But the question is can the judgement stand the test of time? It is left to the PDP lawyers to proof that sufficient submissions were made during the initial hearing and which the Judges did not reckoned with.
On personal ground I am not a fan of Uzodinma but I wish both side good luck.

Exactly, the hearing will not be on new facts, but on the submissions already made at the final hearing. All they need do is prove that thier earlier position was sufficient enough to contest the result produce by Uzodinma and that the court had overlooked or not properly reckoned with some of their submissions.

I think the situation you pointed out can only happen in the north. Police killing of innocent citizens in the south is becoming alarming. This is part of the decay and directionless leadership we have in this country. This building is an edifice, if completed would have helped to open up that area. I remember passing through the compound many years back. The place was like a community of it own, a criminal den, surrounded by bushes. This is the same fate suffered by the old national secretariat at Ikoyi.
It's unfortunate that even the state government abandoned that axis, we have seen Epe and Ikorodu opened up, when will Lagos state government direct infrastructural investment towards Badagry. That axis has huge potential to Lagos state government, considering the fact that 2 huge trading centers; Alaba International Market and International trade fair complex are situated there, this trading centers attract people from all over West Africa.

APC as a body failed to screen their candidate properly or felt that impunity will prevail. Note that this is a pre election matter which should have been resolved before election but APC choose to get a court injunction on the eve of the election, which is not supreme.

To directly give response to you comment;
1. To stand for election you must meet all the requirement set by INEC which is empowered by the constitution
2. The requirement includes possessing the requisite academic qualification, evidenced by a certificates
3. One of the conditions to be a governor is, you must have a deputy and vice visa .i.e no governor without deputy or deputy without governor
4. Since both are jointly standing for the election under a party, a fault in one, is a fault by the other

The APC deputy governorship candidate should have perfected his document or step aside to avoid this mess, but their lawyers would have told them that they have a good case.

SC was more concerned with time frame within which to resolve election matters rather than examining all the issue raised at the tribunal and lower court. In other words SC narrowed the arguments and even over looked it own decision on Nwosu. No mater which divide you sympathise with, the truth must never be muddle up with politics. eventhough PDP did not provide a result, should the result provided by APC not be subjected to test and interrogation. Oya unilaterally produce WEAC exam result which waec cancelled.

Once the Supreme Court has entered judgment in a case, that decision is final and will remain so for ever. The law may in future be amended to affect future issues on the same subject, but for the case decided, that is the end of the matter.
Does it mean that if SC condems a person to death, and later new evidences exonerating the person comes up, there will be no review of the case? In this case the SC was looking at the time line of concluding the election matters and gave the judgement. Therefore, overlooked interrogation of evidences provided by Uzodinma. Now the timeline is met, but with wrong judgement, the aggrieved is at liberty to seek for judicial reveiw. Let wait and see what next.

Uzodinma's first order as a governor was contractors should stop work... Few days after Uzodinma went through the the records of Ihedioha's administration and found out that all contracts were awarded through due process and releasing that stopping contractors from carrying out their jobs which were duly awarded to them will bring a law suit against him, he made a u turn and ask them to go back to sites

I know some will be interested in hearing he awarded this and he awarded that. The first he did is to introduce the Treasury Single Account. Do know what this did? This eliminated the over 200 account control by the state government that encouraged corruption. Secondly, he has instilled due process within the government, sector. He awarded contract of one of the erosion site threating a major road to arab contractor, not the Okorocha quacks contractors. He has instilled confidence in Imo workers by paying up Salary and pension as at when due. He has invested into sport development by drawing a sport road map for the state and construction of sport facility in each local government. This is same thing fashola did in lagos. I was so glad with this because sport gave me focus as teenager. Ihedioha gave his policy thrust before the election, go to his website and you get there and the various things he did day by day. This is a man who has a plan. So what does Uzodinma have, corruption cases?
My position is that a man who has no efcc case against him and one who unanswered cases of corruption, rationally which will you choose.

...Election Petitions are *suis generis*, meaning that they are unique, have a life of their own, have special character and are governed by procedures peculiar to it.

It is a time conscious trial.

Under the 1999 Constitution as amended and the extant Electoral Act, 2010 as amended, the chances of the Supreme Court overruling itself in an Election Petition it has conclusively
*decided and disposed of* and in the particular case of Imo State is nil and non-existent.

We make this strong statement because among other things-

(a) there is no statutory provision for it, and

(b) the lapse of the almighty sixty days constitutional timeline within which the Supreme Court must hear and dispose of Election Petition appeals from the date of delivery of the judgement of the Court of Appeal has foreclosed any such novel window.

It is instructive that the Court of Appeal sitting in Abuja handed its judgement in the Imo Governorship Election Petition Appeals on 19 November 2019.

The Supreme Court in turn disposed the appeal on 14 January 2020.

Going by computation of time therefore, embarking on a street protest on 19 January 2020 and orally asking the Supreme Court to overrule itself is plain mischief calculated to embarrass and denigrate the integrity of the eminent Law Lords.

The sixty days timeline for disposing election petition appeals is a constitutional provision and a non-negotiable part of our electoral laws that must be rigidly obeyed as it is said to stand firm and unmoveable like the *Rock of Gibraltar.*


Even as the Oracle of the law, the Supreme Court is not entitled to rewrite, amend, add or subtract from constitutional provisions.

They must give effect to constitutional provisions however harsh or unsavoury the result may be.

That is what the Supreme Court held in its 2012 decision in the controversial Imo Governorship Election Petitition *PDP V GOVERNOR OKOROCHA & 10 OTHERS* in Suit No. SC/17/2012 delivered on 2nd March 2012.


It is important to further enlighten that the old case of *ADEGOKE MOTORS LTD V ADESANYA* (1989) 13 NWLR (Pt. 109) being bandied around here and there and cited as authority for the Supreme Court to overrule itself is inapplicable in the 2019 Imo Election Petition matter or any Election Petition matter.

This is because the said ADEGOKE CASE (Supra) is not an election petition matter.
It was a 1989 decision that did not have the contemplation of the mandatory requirement for conclusion of election petition appeals in the Supreme Court within 60 days as provided for in the present 1999 Constitition of Nigeria as amended
.


It remains to be said that in sync with their constitutional powers and relying on clear constitutional provisions and our electoral laws, the Supreme Court has disposed of the 2019 Imo Governorship appeals and can never revisit it.

This is again supported by the decision of the Supreme Court in an Election Petition case *PDP V GOVERNOR OKOROCHA & 10 OTHERS in Suit No. SC/17/2012 delivered on 2nd March 2012,* where Odili, JSC, held in a most profound manner and characteristic candour as follows-

*"...What is to be disposed has in a way hit the rock and can go nowhere else. That is to say the legal dispute or process has reached its final destination and is at grand finale...."*


We can then conveniently restate that when the Supreme Court finally disposes of an election petition, the legal dispute has come to a full and final stop at the last legal and judicial bus stop because of the special nature of election petitions and its time sensitive nature.

It is in public interest that there should be an end to litigation-

*Interest rei publicae ut sit finis litium* which is an alternative Latin phrase for *expedit rei publicae ut.*

Remember always that the Supreme is final but not infallible.

A new normal is possible!

Irrespective of whether SC will over tune it judgement or not it is important that Ihedioha seeks for the review. How do we develop our laws, is not by painstakingly testing them in court. If we continue quoting technicalities, then we should forget justice. The judgement has alot of loopholes. The SC atimes should go beyound the ordinary to ensure that justice is seen to have been done.
When the the SC was using doctrine of necessity did it not go out of normal to settle the issue facing the country then. Every case has it own uniqueness and ihedioha's own case is not an exception. SC should look at that judgement again and it many obvious flaws and find a way to be innovative, so to be seen that justice has been served. Some people will quote this case in the future to get flawed judgement.

I wonder what level of intricate and sophisticated stealing he will do with Imo state fund as a governor. If you are not blinded with APC/PDP sentiment, will you want a man of such character as you leader? Who cares what party he belong to, what imo state need is good and inspiring leadership, that will listen to the people, and protect lives and property of our people.
