Exactly what I wanted. Thank you very much. and as is the habit of Oliver Twist, I need some more help. Please, I need advice regarding using my experience for NYSC. So, I taught in a school for a year for my NYSC but was not originally posted there, so I have no posting letter or acceptance letter to offer as further evidence, except of course my discharge certificate. Please, does anyone know whether I will have to provide more evidence in addition to the reference letter from the principal of the school? And to make things worse, I was always paid in cash (5k) because they did not use banks to pay corpers (it was in a village), so no payslips.

I agree with this line of thoughts.

That's why I always advise people to submit bank statements that show one's salary. The fact that someone submitted only FD/Tbills and got quick PPR does not mean everyone will be that lucky. The sample of applicants we see/hear about is small.

I know of some people that London VO called for interview and were asked about their jobs. Some people were even asked to submit photos. So, everyone should be prepared for ADR, which in my own opinion is not bad.

However, I won't advise too much docs as well as it can be counter productive. Submit reference letter and pay slips (if you can). If you are asked for ADR, provide the required information. If you can't provide the docs required, make sure you provide alternative docs and good reasons why you can't provide the required information.


I am glad you are aware that some applicants were asked to send pictures of themselves in their office. Hence it is not a hogwash. Even some applicants were asked to submit wedding and family pictures. When you see these requests, you wonder where they are driving at with this. Typically it exposes the uniqueness of each application.

I am afraid to say that too much documentation is not counter productive. If you have a fantastic scanner that can reduce the resolution of document, but still in readable format; please attach as many supportive documentations you can find to support your application. For instance; paystubs/payslips supports your claim as a genuine in terms of employment- it shows that you received monthly payment from your company and likewise monthly deductions as tax. Employment letter also justifies when you started employment and supports the reference letter. If you are fortunate that your employment letter and reference letter were signed by the same person, you definitely remove all doubts in terms of Eligibility and work Skills.

What is a CIC reference letter format? Are you aware people submit reference letter in plain sheet of paper and they still get PPR. The first thing is to understand the purpose of the reference letter and on the account of reading some many GCMS notes from multiple applicants from different countries; it is prove your A11.2 - Eligibility. To show that the work skills depicted in that reference sheets is actually true and comparable to the applicant NOC; adequate.

Submitting only reference letter may be sufficient for an ExxonMobil staff but not sufficient for an Ade & Sons Limited staff for eligibility purpose. Both companies are different in terms of reputation. So telling an Ade & Sons limited staff to submit only reference letter to justify his/her eligibility would be grossly insufficient.

It is equally the same as asking a self employed individual to submit only reference letter without supporting it with business registration documents, tax clearance, payslips and a sample of invoiced document (to show the work he/she has done in the past).

Sir, I am self employed and it is boldly written on CIC's website that the bolded document is what a self employed person should submit. I did over syllabus sef with it (but I did not submit pictures in the office and in front of our company sign and commendation letter and my clients hugging me letter) by submitting tax clearance and vat certificates. Today is day 51 post AOR. Submitting what is required by cic is the priority. It is that simple. Stop giving people who have done the right thing heart attack. My friend that submitted just reference letter from his dad's chamber where he works without website ati bebelo got ppr in 21 days. It is not cast in stone. Stop this panic reaction you are giving people. It's unfair to say the least.

It is equally the same as asking a self employed individual to submit only reference letter without supporting it with business registration documents, tax clearance, payslips and a sample of invoiced document (to show the work he/she has done in the past).

Hello Boss13,

With regard to the last point you made, it is not the same thing. According to CIC, a self-employed applicant should provide his/her articles of incorporation or other evidence of business ownership, evidence of self-employment income and documentation from third-party individuals indicating the service provided along with payment details (self-declared main duties or affidavits are not acceptable proof of self-employed work experience). This is exactly what you stated. Therefore, any self-employed applicant that wanna submit reference letter only is on his/her own.

You've made your point and it has been noted. Kindly let us move forward and stop this back and forth arguments about proving work experience. Let everyone do what will make them sleep at night.

The more you keep arguing, the more it will lead to the use of derogatory word. We cannot use 20 pages to argue and discuss how to prove work experience.

By way of introduction, Australia has a number of pathway to getting permanent resident status but the easiest is the skilled migration. Skilled migration, as the name implies means opportunity for both "academic skilled and technical skilled" people to migrate legally and permanently to Australia. The program was originally designed to address skill shortages in the country generally, so they came up with a system that attracts people who can meet the minimum requirements.

There are five visa subclass in the skilled migration pathway namely Subclass 189 (Independent), 190 (State sponsored), 489 (Regional/nominated provisional), 132 (Business Talent) and 188 (Business Innovation and investment, provisional). The three visa subclass, 189, 190 and 489 are for professionals, technologists, artisans and trade workers who can meet up to minimum of 60points for 189, 55points for 190 and 50 points for 489. Travel / Re-inspection Of The UK VISA Administrative Review Process July 2017 (PART ONE) by blessedgeorgeus(m): 9:31pm On Aug 27, 2017
An administrative review (AR) scrutinises an eligible decision to determine whether the decision was
the result of a case working error, as defined within Appendix AR of the Immigration Rules.3
AR2.11 and AR2.12 provide technical definitions of all case working errors. They include misapplication of
rules, policy or guidance and incorrect calculation of the period or conditions of leave.

Between 1 October and 31 December 2016 the Home Office received a total of 2,393 AR
applications.

The AR process is designed primarily to provide access to redress for those whose application
for leave to enter or remain in the UK has been refused. However, individuals who have been
granted leave in-country may also apply for AR if they consider that the period of their leave, or
the conditions attached to it, have been calculated incorrectly.

Prior to the 2014 Act, a system of AR already existed for refusal of entry clearance applications
made overseas under the Points Based System (PBS). This took the form of reviews by Entry
Clearance Managers (ECMs) of decisions made by Entry Clearance Officers (ECOs). The 2014 Act
widened the scope of AR to include decisions made in-country and ‘at the border’.

The original inspection reported data for AR decisions for the period 1 April to 30 September
2015. This showed that the percentage of successful ARs, those where the refusal or cancellation
decision was ‘overturned’ was 8% for in-country (191 out of 2,369), 22% for ‘at the border’ (21
out of 96), and 21% for overseas (102 out of 487).

The data from Figures 1 and 2 are not directly comparable, but the ‘overturn’ percentages
for in-country (3.4%) and ‘at the border’ (6.8%) are noticeably lower. The original report
drew attention to the fact that at 8% the in-country ‘overturn’ rate was already much lower
than might have been expected “in light of the Home Office’s own assessment in July 2013 of
the extent of caseworking errors in Managed Migration cases that had been lost at appeal.”
However, it found no evidence that the upheld/overturn rates had been questioned.

Findings and conclusions

Recommendation 1

Under Paragraph 34R of the Immigration Rules,7 an applicant who has been refused leave to
enter or leave to remain within an application category that attracts an administrative review
(AR) has, dependent on location, a time limit of 7, 14 or 28 days from the date a decision has
been ‘served’ to submit an AR request. Appendix SN of the Rules sets out when any refusal
decisions are deemed to have been served (that is, received by the applicant).

The original inspection found that decision notices did not sufficiently advise applicants of the
Rules regarding the deemed date of receipt, nor that applicants may be required to prove, when
requested, that their decision notice was received on a later date. Instead decision notices
simply stated: “You must apply for administrative review within x days of receiving the decision.”

This led to Recommendation 1, which the Home Office accepted.

The Home Office should make it clear to applicants in published guidance and on the online
application form that the deadline for applying for an AR is calculated from the deemed date
of receipt of the eligible immigration decision unless the applicant can demonstrate they
received this on a later date.

Re-inspection findings

Inspectors found that the most recent AR guidance (updated in April 2016) provided full details
to applicants to explain the time limits and set out clearly when an application is deemed to
have been received. The guidance also specified that, in instances when the date of receipt is
being challenged, the onus is on the applicant to provide evidence: “If the migrant claims they
received the in-UK or overseas decision on a later date, it is their responsibility to show when it
was actually received.

After examining the sample ARs from all three business areas (applications made in-country, ‘at
the border’ and overseas) and speaking to staff involved receiving and validating applications,
inspectors were satisfied that the original notice of refusal gave sufficient information to
applicants about how to submit an AR request.

Conclusion

The revised guidance published in April 2016 has addressed the concerns raised in
Recommendation 1. Recommendation 1 is now closed.

Recommendation 2

The original inspection identified inconsistencies in how caseworkers assessed and applied
Paragraph 34R of the Immigration Rules in relation to out of time AR applications.

This led to Recommendation 2, which the Home Office accepted.

Ensure caseworkers take all reasonable steps to check the actual date of receipt of the eligible
decision before rejecting applications on the basis that they are out of time.

Re-inspection findings
Applications made in-country and ‘at the border’

Inspectors found that Home Office staff validating applications were aware of the requirement
to ensure that dates were calculated correctly, and routinely used services such as Royal Mail
‘Track and Trace’ to confirm delivery dates. Of the 48 AR applications deemed invalid that
inspectors examined, 21 had been invalidated for being ‘out of time’. Inspectors found that this
was incorrect in one of the 21 cases.

Applications made overseas

Decision notices for overseas entry clearance applications are collected in person from the
relevant overseas Visa Application Centre (VAC). As a result, it was not possible for caseworkers
to use a postal tracking service to monitor when a refusal notice was received by the applicant.

In the 50 overseas ARs examined for this re-inspection, inspectors identified one in which the
applicant submitted the AR application out of time. In this instance, the overseas Decision
Making Centre (DMC) accepted the mitigating circumstances put forward by the applicant.
Despite being out of time, the AR application was validated and processed. Inspectors found no
instances of overseas DMCs rejecting applications incorrectly as out of time.

Conclusion
Clarifications in policy and revised training have led to improvements in dates for receipt of decision
and eligibility to apply for an AR being calculated correctly. Recommendation 2 is now closed

Recommendation 3

At the time of the original inspection, it was found that there was significant scope to improve
record keeping in terms of invalid AR applications, including correspondence with applicants. In
many cases, neither the electronic notes nor the notices of invalidity sent to applicants set out
clearly the reasons for rejection, including failure to record reference to the deemed date of
receipt where this was used to decide that the application was out of time.

This led to Recommendation 3, which the Home Office accepted.

Ensure that CID9 notes and AR invalidity notices state clearly why an AR application was
determined to be invalid.

Re-Inspection Findings

Applications made in-country and ‘at the border’

AR caseworkers of all grades told inspectors that they understood the importance of recording
accurate electronic notes. However, of the 48 AR applications deemed invalid examined by
inspectors, ten in-country applications had inadequate notes recording actions and the rationale
for decisions. Inspectors identified no issues relating to invalid ‘at the border’ applications.

Applications made overseas

Staff were aware of the requirement to record reason(s) for rejecting an AR application as
invalid. In the 50 overseas ARs examined for this re-inspection, inspectors identified five
applications that were invalid. Four of these applications had been rejected and electronic
casework systems and customer correspondence accurately recorded the reasons. One had
been incorrectly validated and considered. As detailed at Figure 2, the Home Office does not
collate centrally the number of AR applications submitted overseas and rejected as invalid.

Conclusion

AR caseworkers understood the importance of making accurate notes on electronic systems when
rejecting AR applications as invalid. However, the file sample indicated that in a significant number
of cases the notes made by staff validating in-country AR applications were inadequate. Therefore,
Recommendation 3 remains open for the in-country AR work area. Recommendation 3 can be
closed for ‘at the border’ and overseas ARs, but neither area should take this as a signal to relax

I put all my work experiences in work history when filling the EE form, they are asking for references, I am an entrepreneur and I have been for 6 years, for that I suppose my Business Name Certificate will suffice.

Other jobs, I can't get references as two are now closed and one has changed names 3ce and new management and stuff, will employment letters only work? This isn't adding to our points, since I am not primary abi is it principal applicant?

I am a self employed person and i have been self employed most of my adult life...last time i worked for someone was during NYSC. I also worked at a farm (Agric student) for my IT and worked at my parents' businesses for a long long time.

Question is, how do you advice i handle the issue of work reference and the likes. Do i include my own business as a work experience and other ones i mentioned or its not acceptable.

I know most folks for the EE are people who have been in corporate employment and the likes...do self employed folks stand a chance or PNP is the way?

By way of introduction, Australia has a number of pathway to getting permanent resident status but the easiest is the skilled migration. Skilled migration, as the name implies means opportunity for both "academic skilled and technical skilled" people to migrate legally and permanently to Australia. The program was originally designed to address skill shortages in the country generally, so they came up with a system that attracts people who can meet the minimum requirements.

There are five visa subclass in the skilled migration pathway namely Subclass 189 (Independent), 190 (State sponsored), 489 (Regional/nominated provisional), 132 (Business Talent) and 188 (Business Innovation and investment, provisional). The three visa subclass, 189, 190 and 489 are for professionals, technologists, artisans and trade workers who can meet up to minimum of 60points for 189, 55points for 190 and 50 points for 489. I will explain how the points are calculated, occupation list and application in the subsequent posts.

You are the one to do the statutory declaration. As per which is better I don't think there is any difference really. I used a notary public for all my documents and got positive assessments with ICAA (with Vetassess you never can tell). I flee at the mention of that name! A word of caution for you though, I think you should do a pre-assessment or something with Vetassess first. My honest opinion cos I have been 'burnt' as per Internal Auditor assessment with Vetassess.

My current employer, a financial institution, has declined my request for employment reference to VETASSESS (internal auditor).

I saw something about a ''witness'' in Oga Bellong's sample. Just to be sure. Please, who is supposed to swear the statutory declaration of employment. Is it the applicant quoting his supervisor's details or the supervisor stating the applicant works with him?

Which is better/acceptable; a notary public or taking the declaration to the court for declaration?

So I received ITA yesterday but there's a snag because ECA wasn't completed by the time I submitted my EE profile. My questions will in three folds and I will appreciate if anyone can give guidance on how to proceed.

Here goes:

1) What do I do because the date quoted in the EE submission for ECA will be totally different from the ECA Certificate? Reject, edit and wait for next draw?

2) I have worked and lived in different countries in the past so knowing that I need security clearance in Nigeria, can anyone advise on how to get clearance in UK & America?

3) I currently work in a company I co-founded and knowing that there has to be reference Letter from place of work (also do I get from all my past employers), I will appreciate if anyone has a sample of the sort of letter to write plus who is it supposed to be addressed to?


Lastly, is there any other thing I should know about?

As for number one...just add an LOE. People have made changes from their EE profile to their post ITA profile. I did same myself.

Some have filled work experience in EE, removed post ITA. Some filled relative in Canada and removed same when they found out it does not affect cut off point post ITA.

I dont think being proactive will count as misrepresentation. Just add an LOE when attaching it. If i am not mistaken, you will be allowed to change the date post ITA because you will fill another long form..even longer than the EE profile. I believe thats what you are accessed on and not the EE profile. You will now be asked to provide docs to back up what you have claimed on this post ITA profile. For example you claim 3 jobs in post ITA form, you will see three place holders asking to upload 3 reference letters . Edit the form to 1 work history, and the place holder for reference will change accordingly to 1.

1. Reject the ITA as the date on your ECA will be different and that would amount to misrepresentation and a 5 year ban

3. reference letters have to be from jobs you are claiming points for and the maximum points is for 3 years. So every other job can go into personal history.
